JUDICIAL AFFIDAVIT OF WITNESS DENNIS T. DELA CRUZ

I, Dennis T. Dela Cruz, married, of legal age, Filipino citizen, and a resident of
Merry Mount Dr., Sta. Maria, Zamboanga City, Philippines, after having been duly sworn
to an oath in accordance with law, do hereby depose and say, that:

PREFATORY STATEMENT

The person examining me is City Prosecutor Armee Jay L. Cresmundo, with office
address at Justice Hall Building, Sta. Barbara Road, Zamboanga City, Philippines. The
examination is being held at the same place. I am answering his questions fully conscious
and answered it in a language that I understand, and that I do so under oath and may face
criminal liability for false testimony and perjury.

QUESTION AND ANSWER

Q1: Do you swear to tell the truth and nothing but the truth?
A1: Yes.

Q2: Please state your name, age, address and occupation.

A2: My name is DENNIS T. DELA CRUZ, thirty-five (35) years old, residing at Merry
Mount Dr., Sta. Maria, Zamboanga City and working for REYVER as driver.

Q3: What is your relationship with REYVER ESTRADA?

A3: He is both my employer and my childhood friend.

Q4: How many years have you worked with REYVER?

A4: I have worked for him for twelve (12) years.

Q5: Do you know TRIXIA ESTRADA?

A5: Yes. She is the wife of REYVER. I live with her and REYVER as a stay-in driver.

Q6: Do you know HEATHER DE BELEN?

A6: Yes. She is the stay-in housemaid of REYVER AND TRIXIA. She is also one of
the staff of Reyver’s suppliers prior to becoming a stay-in housemaid.

Q7: Do you know how long she has been working for the spouses?
A7: She started working for them around September 2022, Atty.

Q8: Have you observed anything odd about the relationship of REYVER and
HEATHER?
A8: I have witnessed three occasions which caused me to question their relationship,
Atty.

Q9: Can you elaborate on these occasions?

A9: It was around February 12, 2022. I remember the date because it was a few days
before valentines, REYVER told me to schedule a lunch reservation for two on
February 15, 2022 at the Garden Orchid Hotel located in Canelar, Zamboanga City.

Q10: What else did you do?
A10: He also told me to go get his purchased item in a jewelry shop. When I arrived in
the said shop, I checked the receipt and found that the purchased item was an 18-
carat necklace with H pendant amounting to eighteen thousand seven hundred fifty-
five pesos only (PHP 18,755.00).

Q11: Is there anything odd about this?

A11: As soon as I received the purchased item, I thought to whom shall be this necklace
be given? Is this for TRIXIA or for someone else? The pendant clearly showed that
it is for a person whose name begins with letter H.

Q12: What happened next?

A12: Moving forward, on the 15th day of February, at about 10:30 in the morning,
REYVER notified me to prepare as we will depart as soon as possible. When we
were in the car, he told me to proceed at Tetuan Church as his client was waiting
for him.

Q13: Did you observe anything unusual?

A13: Thereafter, I saw a woman whom I recognized as a staff of one of REYVER’S
suppliers whose name is Heather. This woman happened to have multiple
transactions with REYVER in different occasions, mostly beyond office hours.

Q14: What happened next?

A14: I drove them at Garden Orchid Hotel where the lunch reservation was made. I saw
REYVER holding the small paper bag which I recognized to be the purchased item
that I claimed in the jewelry shop.

Q15: Can you elaborate on the second occasion you saw Reyver and Heather together?
A15: The second occasion took place sometime in May 2022. I drove REYVER at Winn
Hotel for a client meeting.

Q16: What did you observe that is unusual?

A16: While I was sipping my coffee at the lobby of the hotel, I saw HEATHER, the same
woman whom REYVER had lunch reservation in February 2022. I waited for
REYVER for 6 hours and while I was seated in the corner sofa of the lobby, I saw
him and HEATHER holding each other’s hand as they stepped out of the elevator.
I was shocked with what I saw.

Q17: What did you do?

A17: I just did not mind it because I know that Reyver is just meeting with a supplier.

Q18: Is there a third occasion that you wish to share?

A18: The third occasion happened when HEATHER was employed with REYVER and
TRIXIA as a stay-in housemaid. At about 12:30 in the midnight on November 5,
2022, as I was going to the comfort room which was close to HEATHER’s room, I
saw a light and the door was ajar. I heard a soft voice moaning. I was curious and I
peeped, I saw HEATHER on the top of REYVER and they were both naked.

Q19: Did REYVER or HEATHER see you?

A19: No. They did not see me, but I saw them clearly as there was light from the lamp.

Q20: Did you confront them about the third occasion?

A20: No, I could not bring it up to REYVER. But I sent a text message to HEATHER
out of my concern to TRIXIA, the wife of REYVER.

Q21: Are you talking about these messages we have here which you have screen shot,
marked as Exhibit D?
A21: Yes, Atty.

Q22: What was your text message to HEATHER when you told her what you saw on the
third occasion?
A22: I sent HEATHER a text message which reads as, “Heather, nakita ko kayo ni
Reyver na may ginagawa sa kwarto mo. Payong kaibigan, itigil mo na iyan. Maawa
ka sa sarili mo at kay Trixia.”

Q23: What was the reply of HEATHER when you told her what you saw on the third
occasion?
A23: I will read directly from our text messages, Atty. I confronted her about the third
occasion and she replied, “Wala kang pakialam kung may namamagitan sa amin ni
Reyver? Kasalanan ko ba kung sa akin niya hinahanap ang hindi maibigay ni
Trixia? Nagmamahalan kami at iyon ang mahalaga. Nandito ako para sa kanya at
hinding hindi ko siya pababayaan katulad ng ginagawa sa kanya ni Trixia.”

Q24: After such occasion, did you bring it up again with HEATHER?
A24: No, Atty. I could not even look at HEATHER as what she did is an immoral act. I
only associate with her in task related activities, other than that, I don’t have
anything to do with her.

Q25: Did you bring this up with the spouses after telling HEATHER about it?
A25: Although REYVER was my childhood friend, I could not bring it up to him. But
with TRIXIA, I felt that I am obliged as she also treated me like a family. But I did
not have the courage until after the incident last March 2, 2023.

Q26: I do not have any further questions. Is there something you may want to add, omit,
or alter in your statement, Mr. Dela Cruz?
A26: Nothing more, Atty.

Q27: Do you affirm and confirm the truthfulness and veracity of all the statements you
stated in this judicial affidavit?
A27: Yes, Atty.
