JUDICIAL AFFIDAVIT OF ANDREA BERNARDO

I, ANDREA BERNARDO, 25 years old, single, residing at Tacloban


City, after having been sworn to in accordance with the law do hereby
depose and state:

That Atty. Alan Abrigo is the counsel who conducted and supervised
my examination as a witness at his office at the 5th floor of Roque & Sons
Building, Salazar St. Tacloban City, Philippines;

That the questions are asked in the English language which I speak
and fully understand; and

That I am answering the questions herein fully conscious that I do so


under oath and that I may be criminally liable for false testimony or perjury.
Other information or requirements of Sec. 3, A.M. 12-8-8-SC as explained
to me by the administering officer, hereby deposes and states as follows:

PURPOSE: This affidavit / testimony of witness, ANDREA BERNARDO,


is being offered to discuss the circumstances that led to the death of victim,
ANDREI BERNARDO, and to testify that the aforementioned accused,
Reynaldo Suarez, is liable for the death of the former.

Q1: Do you swear to tell the truth and nothing but the truth?
A1: Yes, Attorney.

Q2: Please state your name and other personal circumstances for the
record.

A2: I am Andrea Bernardo, 21 years of age, single and resides in Tacloban
City. I am registered nurse currently employed at the Divine Word
Hospital.

Q3: Do you personally know the victim?


A3: Yes, attorney. He’s my twin brother, we live in the same residence
with our parents.

Q4: How about the accused in this case, do you know him?
A4: Yes, attorney, although we never had any personal interaction until
the incident.

Q5: How do you know him?


A5: I frequently see him drinking alcoholic beverages in the same sari-sari
store where the event happened.

Q6: How frequent do you see him drinking at the sari-sari store?
A6: Very frequent, attorney. While going to the hospital and going back
home from my shift, I would often see him at that sari-sari store
drinking with his friends at least once a week, and at most, thrice.

Q7: How long would he be drinking at that sari-sari store?


A7: I don’t really know, attorney. But once, I have noticed, while on my
way for my afternoon hospital shift, their drinking session was already
on-going even before 3 o’clock in the afternoon. Often times, twice or
thrice a week, I would see them drinking late at night, at about 11
o’clock in the evening, while on my way to my graveyard shift.

Q8: Where were you on October 16, 2020?


A8: I was at our Aunt Dely’s residence. We celebrated her intimate
“family-only” birthday party. I was also with my twin brother, Andrei
Bernardo.

Q9: Fast forward, what were you doing at around 5PM in the evening of
the same date?
A9: I was walking with my brother on our way home from Aunt Dely’s
birthday party. Our mother called to Andrei’s mobile number and
ordered us to buy something to eat for breakfast the next day. That’s
why we stopped at the Mr. Chan’s sari-sari store since it’s along the
way.

Q10: What was your twin brother doing while you were buying from the
store?
A10: While I was giving my order-list to Mr. Chan, I heard Andrei talking
with his girlfriend, Freya, in his mobile phone. He was standing under
the caimito tree in front of the same sari-sari store.

Q11: Just out of curiosity, what did you buy at Mr. Chan’s store?
A11: I ordered a loaf of bread, a can of sardines and 3n1 coffee sachets
from Mr. Chan.

Q12: Who were at the sari-sari store at that time?


A12: Mr. Chan, who’s the owner of the store, Reynaldo Suarez, the
accused, and myself.

Q13: Can you tell us what happened during that time after your purchase at
the store?
A13: Actually, I wasn’t able to complete my transaction with Mr. Chan. I
was standing outside the store, waiting, while Mr. Chan was gathering
my orders at the back of his store, when all of a sudden, Reynaldo
Suarez grabbed my left arm and called me Angela. His breath reeked
of alcohol, his eyes were red and swollen, and told me, “Angela, baby,

papanagutan ko ikaw. Diri ko kamo papasagdan. Ayaw pagsugara tat
anak, please.” I carefully removed my arm from his grip and told him
in a calm manner that I am not Angela. I was trying my best to
prevent any scene or unwanted argument since it was obvious that he
was intoxicated with alcohol. I noticed that my brother was still
talking with her girlfriend on the phone and was facing the other way.
Meanwhile, Reynaldo grabbed my right hand again and said, “Keano
mo ako bubulagan yana nga burod kana lugod? May iba ka nga lalake,
ano?”. This time his tone became louder and authoritative. I was
becoming more concerned of the circumstances and tried to forcefully
remove my hand from his grip.

Q14: What happened next?


A14. I shrieked in pain because he now tightened his grip on my hand.

Q15: And then?


A15: I saw my twin brother crossing the road, running towards us, and
shouted “Ayaw pagsusugara tak manghud!”. He tried to detached me
from Reynaldo’s grip as he can see that I was already in pain. But
Reynaldo was grip was really strong and he also tried to push my
brother with his other hand. He told him, “Ayaw hin samok, away
mag-uyab ini namon!” Then Andrei punched Reynaldo’s face, that’s
the time Reynaldo released his grip and fall to the ground.

Q16: What happened after that?


A16: Andrei asked if I already got my orders from the store, and I said not
yet, and he likewise checked my arms and hand.

Q17: What happened after this?


Q17: We did not notice that Reynaldo was able to get up quickly. He
grabbed my brother from behind and pinned him on the ground. I
screamed and ran for help from the nearby neighbors when I saw that

Reynaldo was holding and pointing a small knife at my brother’s
chest while Andrei was lying on the floor. Both of them were fighting
and struggling on the ground and everything was going so fast. The
next thing I saw were the two of them covered in blood, my brother
motionless in a supine position, and Reynaldo, siting on top my
brother, frozen, but still holding the knife in his hands.

Q18: And then, what happened after?


A18: I ran towards the both of them, I pushed Reynaldo as hard as I could
away from my brother. I immediately examined my brother’s carotid
pulse and breathing and check his body for fatal wounds. It dawned
upon me, that my brother was already lifeless. I cried and shouted for
help while I searched for his mobile phone in his pockets. I
immediately called the ambulance for help and called the police
afterwards. But the police officers informed me that a team was
already on their way to respond. In a couple minutes, a patrol car and
ambulance came and took me and my brother to the hospital.

Q18: Do you have anything else to say, Ms. Andrea?


A18: No more, Attorney.
