III. FACTS OF THE CASE

7. At on or about 5:00 in the afternoon of October 16, 2016 at M.H. del Pilar St.,
Tacloban City, Mark Chan a resident therein, reported and sought police assistance on
a alleged killing incident of one Andrei Bernardo, 21 years old. PCPT JP Taduran,
PLT Juan Miguel Severo, PLT Sonny Merioles, and PLT Wilson Legazpi.

8. Initial investigation disclosed that accused was drinking at a sari-sari store at the
above-mentioned place. At around 5 pm, the sister of the victim, Andrea Bernardo
went to buy at the store. His brother, the victim, Andrei was on his phone at the
caimito tree in front of the sari-sari store. Andrea, while waiting, was suddenly
grabbed by the accused, Reynaldo Suarez. The accused called her Angela instead of
Andrea. The accused thought that Andrea was his ex-girfriend due to being drunk.
The accused was provoking Andrea and was asking her why she broke up with him.

She shrieked in pain and that was when her brother noticed the scene between the
accused and her.

9. Andrei, the victim, crossed the road and shouted, “Ayaw pagsugara tak manghud!”
He tried to detach his sister from Reynaldo's grip. The accused pushed Andrei. Andrei
punched Reynaldo and the accused fell to the ground. Andrei checked upon his sister
and they did not notice that the accused was able to stand up quickly. He grabbed the
victim and pinned him on the ground. They were fighting and struggling and the
witness, Andrea saw later on that her brother was stabbed at the right part of his body,
near the lungs. Reynaldo, the accused, quickly ran away from the scene.

10. Mark Chan, the owner of the sari-sari store, reported the incident to the police.
The accused, Reynaldo Suarez was apprehended by the police the next day, October
17, 2020.

11. The cadaver of the victim was brought for autopsy.

12. Please be informed that the case has been filed in inquest proceedings against the
arrested suspect before the Office of the Assistant City Prosecutor, Reyna T. Salazar
on October 21, 2020. Investigating Prosecutor hereby recommended the further
detention of the accused after finding probable cause on the referred case for
Homicide.
