JUDICIAL AFFIDAVIT

The examination of LEE ANN D. CRUZ was conducted by ATTY.

JEZRAEL N. GROSPE in El Nido, Palawan. Her testimony will be
offered for the following purposes:

OFFER OF TESTIMONY

The testimony of the witness is offered to show and prove

the following:

That sometime in 2010, ASPERY D. DAIRO mortgaged to her a

parcel of land covered by Orihinal na Titulo Blg. E-31440
situated in El Nido, Palawan;
That ASPERY D. DAIRO gave to her the owner’s duplicate
copy of the title which she then kept in her house;
That sometime in 2011, after ASPERY D. DAIRO paid the
loan, she looked for the owner’s duplicate copy of the title
but failed to find it despite her diligent efforts;
That she executed an Affidavit of Loss of the said
owner’s duplicate copy of title on July 5, 2012;
Other matters to support the Petition for the re-issuance
of the said title by ASPERY D. DAIRO.

JUDICIAL AFFIDAVIT OF LEE ANN D. CRUZ

I am LEE ANN D. CRUZ, of legal age, married, Filipino,

and a resident of Malapacao Island, Bgy. Manlag, El Nido,
Palawan. I am a business woman.

My answers to the questions given to me by ATTY. GROSPE

are truthful for I am fully aware that I have sworn to tell
the truth and that if my answers to the questions are not
truthful, I can be held liable for false testimony or perjury.

Q1: Please state your name and your other personal circum-
stances.
A1: I am LEE ANN D. CRUZ, of legal age, married, Filipino and
a resident of Malapacao Island, Bgy. Manlag, El Nido,
Palawan. I am a business woman.

Q2: Do you know ASPERY D. DAIRO, if you know her?

A2: Yes. I know ASPERY D. DAIRO.

Q3: Why do you know her?

A3: I know her because sometime in 2010, she mortgaged to me
her property covered by Orihinal na Titulo Blg. E-31440
situated in El Nido, Palawan.

Q4: Where was the owner’s duplicate copy of the title when
the property was mortgaged to you?
A4: The owner’s duplicate copy of the title was given to me
by ASPERY D. DAIRO.

Q5: What did you do with the owner’s duplicate copy of title
after it was given to you?
A5: I kept it in my house.

Q6: Where is the owner’s duplicate copy of the said title?

A6: Sometime in 2011, ASPERY D. DAIRO paid her loan and I
looked for the owner’s duplicate copy of the title that
she gave to me. However, despite all my diligent efforts,
I could no longer find it in my house.

Q7: What did you do when you failed to find the owner’s
duplicate copy of the title?
Q7: I executed an Affidavit of Loss of the said owner’s dupli-
cate copy of the title on July 5, 2012. Here is a copy of
the said Affidavit of Loss.
Manifestation: The certified true copy of the Affidavit of
Loss presented by the affiant is marked as Exhibit “xx”.

Q8: What happened next?

A8: I came to know that ASPERY D. DAIRO caused the annotation
of the Affidavit of Loss in the copy of the title in the
Office of the Register of Deeds for the Province of
Palawan.
Manifestation: Entry No. ---------- in the certified true copy
of Orihinal na Titulo Blg. E-31440 is marked as Exhibit “xx”.

Q9: Why did you execute this Judicial Affidavit?

A9: I am executing this Judicial Affidavit upon the request
to me by ASPERY D. DAIRO to support her Petition for the
re-issuance of the owner’s duplicate copy of title before
the court.

Q10: Will you willingly sign this Judicial Affidavit to attest

to the truth of all your answers herein?
A10: Yes.
