AFFIDAVIT OF ADJUDICATION BY SOLE

HEIR OF ESTATE OF DECEASED PERSON
WITH DEED OF ABSOLUTE SALE

I, PEPITO ABATAYO, of legal age, married and a resident of

Poblacion, Tagbina, Surigao del Sur, after being duly sworn to in
accordance with law hereby depose and say:

1) That I am the only surviving heir (son) of one named

Hilarion Abatayo who died intestate in Cebu City on May
26, 1983 ;

2) That said deceased left a valuable asset consisting of a

real property known as Lot No. 728-A, Pls-425-D, situated
in Poblacion, Tagbina, Surigao del Sur containing a total
area of 1.5096 hectares, described under Tax Declaration
No. 08-16-0001-00289, bounded on N: 01(729), E: 03(28-B),
S: National Highway, and the W: 01(729), in the name of
Hilarion Abatayo (deceased) ;

4) That said deceased left no debts;

5) That pursuant to Rule 74, Sec. 1 of the Rules of Court, I

hereby adjudicate unto myself the above-described asset
for purposes of collection, withdrawal and encashment in a
banking institution and for such other purposes by means
of this affidavit and hereby files same with the duly
constituted authorities and with the request that said
adjudication be made effective without judicial
proceedings as prescribed by the aforementioned Rules of
Court.

That for and in consideration of the sum of NINETY THOUSAND

PESOS (P90,000) Philippine Currency, to him in hand paid by MARY
ANN C. LUMANTAS, of P-2, Poblacion, Tagbina, Surigao del Sur;

Pepito Abatayo, do hereby SELL, TRANSFER and CONVEY,

absolutely and unconditionally, unto MARY ANN C. LUMANTAS,
Filipino, of legal age, married and a resident of P-2, Poblacion,
Tagbina, Surigao del Sur, portion of the above-described parcel of
land, consisting an area of ONE HUNDRED EIGHTY (180) Sq. Meters
(or 12m x 15m), together with all its improvements thereon.

IN WITNESS WHEREOF, I have hereunto set my hand this 22 nd day

of October 2009 at San Francisco, Agusan del Sur.

ACKNOWLEDGMENT

BEFORE ME, this 22nd day of October 2009 at San Francisco,

Agusan del Sur, personally appeared the above-named persons
represented to me to be the same persons who executed the
foregoing instrument, and they acknowledged to me that the same
are their free acts and deeds.

This instrument consisting of two (2) pages including this

page has been signed by the parties and their witnesses at the
left margin of each and every page hereof.
