BETWEEN

LEETU EDUCATION SERVICES PRIVATE LIMITED

AND

STUDENT

BORROWER

(in case different from Student)


JOB GUARANTEE POLICY

This policy ("Policy") defines the terms and conditions of the Moneyback Job Guarantee provided as
part of the Full Stack Web Development Job Guarantee Course offered by AttainU.
LEETU EDUCATION SERVICES PRIVATE LIMITED, is a company incorporated under the relevant
provisions of the Companies Act, 2013, having its corporate identity number U80904KA2018PTC111746
with its registered office at number 811, 1st Floor, 10th A Main Road, Indiranagar 1st Stage Bengaluru -
560038, Karnataka, India, hereinafter referred to as the "Company" (which expression shall unless it be
repugnant to the context or meaning thereof mean and include its affiliates, group companies,
successors and permitted assigns);

Student is the customer enrolled in Company’s Full Stack Web Development Job Guarantee Course.
(hereinafter referred to as "Student"), which expression, unless it is repugnant to the context or meaning
thereof, shall be deemed to mean and include all its successors and permitted assigns);

In case the Student is paying the fee of the course via one of the Company’s Finance Partners then
Borrower is the main Loan Borrower. In case the Student is paying the fee directly to the Company in the
form of EMIs then Borrower is the Student. In case the Student has paid the course fee directly to the
Company upfront, then there is no Borrower and the terms in the policy related to Borrower will not be
applicable.
(hereinafter referred to as "Borrower"), which expression, unless it is repugnant to the context or
meaning thereof, shall be deemed to mean and include all its successors and permitted assigns).

Each of the Company, Student and the Borrower are hereinafter individually referred to as a "Party", and
collectively referred to as the "Parties".
WHEREAS:
A. The Company is engaged in the business of providing educational training and placement
support in the field of software development ("Business").
B. The Student has expressed their desire to enrol themselves into the Training Program (as
defined below) of the Company with the Borrower’s support for paying the Course Fee.
C. As a part of this course, the Company provides the Job Guarantee Policy which applies to
the Company, Student and Borrower.
D. In consideration for the enrolment process into the Training Program, the Company,
Student and Borrower agree and acknowledge to be bound by the terms and conditions, to the
extent applicable to the relevant Party, set out in this Policy.

FOR STUDENT ENROLLED IN THIS COURSE THE COMPANY AGREES TO EXECUTE THE
MONEYBACK JOB GUARANTEE IN ACCORDANCE WITH THE TERMS AND CONDITIONS
SET FORTH BELOW.
BY ENROLLING IN THIS COURSE THE STUDENT AND THE BORROWER AGREE TO
COMPLETE THE TRAINING AND PLACEMENT PROVIDED BY THE COMPANY IN
ACCORDANCE WITH THE TERMS AND CONDITIONS SET FORTH BELOW FOR THE
MONEYBACK JOB GUARANTEE TO BE APPLICABLE.

1. DEFINITIONS AND INTERPRETATIONS

"Training Program" means the program of study conducted by the Company for a tenure of 7
Months.

"Learning outcome assessment" means any test/project/FPRT/interview or other sorts of


assessment done for the purposes of judging the course skills learnt by the student till that point.

"Allowed batch transfers" There is one batch transfer allowed (voluntary)

"Monthly Tests" The Company shall conduct tests on a monthly basis to test the preparedness of
the Student which the Student agrees and acknowledges to undertake and pass as part of the
Training Program.

"Project Work" The Student agrees and acknowledges that as part of the Training Program, it is
required to successfully work on Software Development Projects for better learning.

"Final Placement Readiness Test (FPRT)" The Student agrees and acknowledges that as part
of the Training Program, the Company shall conduct an interview readiness test prior to the
Student appearing for Employment interviews to test the preparedness of the student to appear for
interviews with the Employer.

"FPRT Attempts" These are the number of attempts which will be given to students to pass the
FPRT. Maximum 3 attempts will be given to pass the FPRT.

"Expulsion Events" At the occurrence of any of the Expulsion Events the Company shall, at its
sole discretion, have the right to expel the Student/lapse Money back policy for that student.

"Placement Period" 7 months Placement period starts after clearing the FPRT and passing all the
projects.

"Completion Tenure" It is the tenure which includes 7 months of intensive training plus 7 months
of Placement phase, the 7 months placement period will start after FPRT clearance + all projects
passing as defined above. In addition to the completion tenure defined above, the course will be
marked as complete for a student only when the student successfully passes the
FPRT.

2. COMMON CLAUSES

A. If a student receives an offer of Employment within the Completion Tenure, then, such
student shall be deemed to be employed for the purposes of this policy, notwithstanding the
fact that the actual joining date of Employment falls outside the Completion Tenure.

B. Course duration/Completion Tenure can get extended/reduced. Sometimes depending on


the pace of the batch the course might get extended/reduced by some time. In the end, we
want to make sure that none of our students gets left behind. To ensure this we sometimes
have to repeat lectures or slow down the pace of the batch.

C. During the course tenure, the Students shall not be allowed to consider any Employment in
any sector other than Information Technology (IT) sector and shall only focus on
preparation and interviews being arranged by the Company. If a student intends to take up
a Non-IT Job then they will have to take written consent from the company and in such
cases, job guarantee does not apply.

D. The student has to make their best efforts to seek Employment immediately following
completion of the Training Program. A student should not ask for a time gap at any time
during the course or during the Placement phase. If a student asks for gaps then Job
guarantee does not apply. For Eg: After the course completion a student asks for a 1-month
gap before applying for interviews then Job guarantee does not apply.

E. The student agrees that all the information that is provided to Company during admission is
true and accurate and that he/ she has not provided any false, misleading or deceptive
statements or omissions of fact; If the information comes out as misleading/false then Job
guarantee will not be applicable.

F. A fair Code of conduct is expected from the student - at all times, with all representatives
of the Company. Students should behave in a professional manner at all times, if at any
time it is found that the students have misbehaved with the representatives then the Job
Guarantee does not apply.

G. The Company shall have the right to amend, inter alia, the course structure, delivery,
curriculum, instructors, and mentors of the Training Program from time to time at its sole
Discretion. Students would need to follow such changes as and when required, failure to do
so will lapse Job guarantee.

3. ADMISSION RELATED CLAUSES

A. The Company agrees to provide the student with the Training Program and hence one
must undergo the 7 months intensive program to be eligible/considered under the Job
Guarantee policy.

B. The student unconditionally agrees and acknowledges that in lieu of availing of the Training
Program, the Student shall be paying the Complete Course Fee along with the Registration
Fee on or before the course starting date to the Company or to the NBFCs as may be
decided by the Company in its sole discretion from time to time, in accordance with the
terms and conditions contained herein. Any lapse with the Course Fee will make the Job
guarantee Policy inapplicable. Further, the fee collected till that point will be non-refundable
and will be used to meet the expenses of the seat taken up by the student in the batch.
This is explained below with an example.

Example - In the case of NBFC payment if the student does not pay any EMI or in the case
of direct payment if the student does not pay any EMI as per the schedule, then the JG
Policy will also lapse.

C. The admission process is considered completed when the student has completed the
below step as applicable as per their payment method after paying the Partial/Full
Registration Fee. Failing which the admission will stand as cancelled. The company, at its
sole discretion, might provide an additional buffer period of no more than 7 days for
completing the below steps.
• The student needs to submit the relevant documents for credit assessment
through NBFC if opted for the NBFC EMI option and must complete the Post
Approval process within 2 weeks from the registration date.
• Directly pay to the Company, the Complete Course Fee in One Time (Full
Payment) as finalized with the Company.
• Pay 1st Installment under 4 months Direct/NBFC instalment.

D. If the student decides to not attend the course at any point or opts to drop off, they are
liable to complete the payment (NBFC / Direct). This fee will be used to meet the expenses
of the seat taken up by the student in the batch. In case of non-payment, we (or our
financial partner) reserve the right to pursue all remedies applicable in the case.

E. Since the borrower is a part of the agreement, Company can reach out to the
borrower at different points for the course fee payment/employment verification. The
student agrees to extend complete timely cooperation towards the same. In the event of a
Non-cooperation Job guarantee will not be applicable.

4. TEACHING RELATED CLAUSES

A. General Clauses

● All “Learning outcome assessment” can, at the discretion of the company, include
interviews, besides the written part, covering all parts of the curriculum taught so far.
In such cases, to clear the assessment, the student must also clear the interview.
Note that from time to time, the assessment process can be changed/enhanced for
the purpose of betterment, at the sole discretion of the company.

B. 80% of Attendance in Main Live Sessions

Note - Attendance will only be considered as per the Company’s Attendance taking
process.
• It is mandatory for the students to maintain =>80% attendance in the live
sessions during the course period. This means students can miss 20% of the
live sessions in emergency situations.
• If in case any student takes the batch transfer to the immediate next batch then
the attendance % will be the overall percentage of both the batch (previous batch
and current batch) in this case the student should maintain =>80% including both
the batches.

C. Final Placement Readiness test (FPRT)

● It is mandatory to clear the FPRT with 60% marks or higher in each module (Min
60% marks are required in all the modules which are easily attainable).
● Placement Tenure of 7 months will start from the time the student clears the FPRT.
● Max. 3 attempts will be allowed to clear the FPRT.
● If a student is not able to clear the FPRT with min. 60% marks in each module after 3
FPRT attempts, then the JG Policy will lapse.
● Being absent in any FPRT or its accompanying viva will be considered a fail grade.

D. Projects
• There will be two projects conducted during the course period.
• Project assessment will be done through interview evaluations (Viva)
• In these projects, there are 2 important requirements -
• The student will be required to write & submit the source code for the
project.
• The student should submit a report for the project.
• Not completing any of the above two steps will automatically result in a fail grade
in the project and the job guarantee will not be applicable if the projects are not
completed successfully.

E. 80% of Homework Submissions

• It is mandatory for the students to submit =>80% of homework during the course
period. 20% relaxation is given for emergencies.
• If in case any student takes the batch transfer to the immediate next batch then
the homework submission % will be the overall percentage of both the batch
(previous batch and current batch) in this case the student should submit and
maintain =>80% including both the batches.

F. Test
• Every month a test will be conducted during the course period and it is
mandatory to attend the test and its interview evaluations. (viva)
• No retest will be conducted for the same.
• Not appearing in the monthly test will be automatically marked as failed.

G. 80% of Test Appearance/Attendance

• It is mandatory for the students to attend the test which is conducted during the
course period and should maintain =80% of appearance/attendance
• If in case any student takes the batch transfer to the immediate next batch then
the test appearance % will be the overall percentage of both the batch (previous
batch and current batch) in this case the student should attend the test and
maintain =>80% including both the batches. 20% relaxation is given for
emergencies.

H. 50% Test Aggregate Marks

• It is mandatory for the students to maintain =>50% aggregate marks in individual


modules during the course period.
• If in case any student takes the batch transfer to the immediate next batch then
the test aggregate % will be the overall percentage of both the batch (previous
batch and current batch) in this case the student should maintain =>50%
including both the batches.

I. Batch Transfer

• When a student receives a batch transfer then all the terms mentioned in the Job
guarantee policy of the new batch will automatically become applicable to the
student.

5. PLACEMENT RELATED CLAUSES


A. Once registered, each student must participate in the placement activities and should be
immediately available to join the company.

B. Students can withdraw their candidature before the Company’s placement activities start,
before that student has to give AttainU in writing that they don’t want Job guarantee
support and will not come to AttainU in future asking for Placement support.

C. Graduating students who wish to pursue their startup/agency/freelancer ambitions instead


of seeking placements may opt-out of the placement process by obtaining formal approval
from Company’s Placement head, they will have to submit in writing that they don’t need a
Placement now or in future as well.

D. The participating placement entities view the student as an ambassador of the Company.
Students are therefore cautioned to display civility and good professional conduct while
interacting with external entities. For this purpose, the student must regularly check the
emails, messages, or notices from the online portal, Slack, and comply with the actions as
required within the indicated timeline. Non-adherence to the timelines may lead to denial of
the subsequent process outcomes such as interviews etc, if any student does not follow the
above at any point in time, then the Money back job guarantee policy will lapse for the
particular student. Students are not allowed to deliberately miss the interviews or leave the
interviews in between without any reason, further students are not supposed to keep on
rescheduling the interviews or misbehave with the interviewers. If there is some emergency
then the student first needs to send a written request to reschedule the interview. If the
students do not follow this clause then the Job guarantee does not apply.

E. It shall be mandatory for short-listed students to appear for the interview. Failing to appear
will result in a lapse of the Job guarantee and money-back policy. In emergencies, students
can drop an email (Up to a limit of max 2 times)to the Company and try to reschedule it.

F. Participating companies often ask for projects and assignments before the start of the
interview process. Students have to submit all such projects/ assignments within the
deadline and with 100% effort, failure to do so will lapse the money back Job guarantee.

G. If a student gets a pre-placement offer (PPO) from an Organisation, he/she will be


considered as placed for the purposes of the Job Guarantee Policy.

H. Students will have to do a Minimum of 4 AttainU Job applications every week (this includes
actively participating in the assessment activities of the hiring partner) and 3 self-job
applications daily.

I. Self-Application:
• Along with the companies which are coming through Company, the student also
has to self-apply and keep Company informed of the progress on the same, to
min. 3 relevant companies every day starting from the day AttainU shifts them
into the Placement phase.

• and keep reporting to the Company team regarding the same. The reporting
process will be as defined by the Company and subject to change from time to
time.

J. The company follows a one student, one job offer policy. So, it becomes mandatory for the
student to accept the first job offer. Upon receiving the first job offer, the student will be
automatically considered as placed and removed from the list of students awaiting job
offers.

K. In the event of students appearing for multiple recruiting companies’ selection process for
final placement, it would be mandatory for the student(s) to accept the first offer and join
that company. Failure to do so will lapse the Job Guarantee.

L. If a student is not replying to Company agents/employees over email even after 6 days of
Follow Up then Job Guarantee does not apply.

M. In case the student finds a suitable opportunity by themselves (Internship, Full-Time Job,
Contract, Freelance), he/she must inform the placement team within 24 hours and can
accept that job offer, in this scenario student(s) shall not come back to AttainU for
Placement support in future.

N. It is mandatory for all the students to submit their offer letters to the Placement team within
24 hours of receiving the offer letter.

O. The student is not allowed to take up a non-software engineering job without written
consent from the Company, if a student wishes to take up such a job then they will have to
submit in writing that they want to start their career in Non-IT and do not need Placement
support from AttainU at the moment and in future as well.

P. The company will attempt to find suitable job opportunities for students but to make the
best use of the opportunity for the enrolled student, the student should be open to
relocating to any location in India since he/she recognizes that it is highly inconvenient and
less probable to secure the best opportunities for Employment in the home city or any
preferred city of a Student. Provided however that, the Company agrees and acknowledges
that it shall primarily consider the preferred city in India for Employment
of a Student but in case there is no good opportunity for Employment in the preferred city
of such Student, then, he/ she shall be open to seeking opportunities for Employment in
other cities of India. In case of any failure of the Student to comply with the provisions as
defined in this clause, then, such Students will not get a Job Guarantee.

Q. If the student wants to apply in only a particular profile then the Job Guarantee does not
apply. Suppose a student says they will apply only in frontend Jobs / in jobs in only a
particular city / in jobs offering more than a particular high package, the Job guarantee
does not apply.

R. Along with Placement support, AttainU will provide mock interview support (Free of cost)
for better preparation of interviews. All students are required to book and attend at least 2
mock interviews every week.

S. Job obtained at any point during the course will be considered a successful outcome. Any
kind of tech job would be considered a success. (fulltime / parttime / contract / remote /
foreign / intern / freelance).

T. If a student is not available to take up a job during the placement period then the job
guarantee policy does not apply to that student.

U. Similarly, if a student is not comfortable giving interviews to the companies in English then
the job guarantee policy does not apply. This is because the majority of the companies use
English as the professional language of communication and also conduct their interview in
English as well.

V. This course is meant for freshers or beginners in the Web development domain, No Job
guarantee will be given in case of an existing job or past job experiences in the tech
domain. For instance, if a student holds 1-year experience in the IT domain and expects a
particular package or is employed currently at 8LPA and expects a higher package
suppose 10LPA, the Job Guarantee policy does not support these, so in these cases, the
Job guarantee policy will not be applicable.

W. The company does not provide International employment support, if a student intends to
seek International employment then the Job Guarantee does not apply and Money back
policy will lapse. In such cases, before leaving for international territories the students have
to complete all the formalities with the company and clear all their dues if any.

6. Expulsion Clauses - Policy Lapse Events


A. Placement is an outcome of learning. Ultimately a student needs to clear interviews set
with AttainU Hiring partner companies to get a job. So efforts matter very much on the
student's side as well. If a student follows all the course requirements and then also doesn't
land a job within 7 months after the course completion then the course fee will be refunded
back.

B. If any of the aforementioned clauses in this policy is not followed by the student then the
Money back policy will lapse and AttainU will not be liable to refund the amount to the
student. Every student is expected to fulfil the minimum required efforts mentioned in this
policy to be eligible for the money-back policy.

C. 4 (Four) consecutive non-informed leaves by the Student in any of the live sessions
conducted by the Company as part of the Training Program.

D. If a student is found indulging in any Plagiarism in tests/homework/projects/fprt/hiring


company interviews/data reporting (job application & interview).

E. If a student is found marking any proxy in attendance/homework submission/test.

7. Refund Clauses

A. All Pan associated Bank Account statements: Students who fulfil the minimum expected
efforts but are not able to land any job during the Placement phase would be eligible for a
refund (Post strict employment verification) for the same they will have to submit some
documents as and when asked. Including -
• Form 26AS
• Stamped Undertaking certifying that student does not have a job in the tech
domain
• Last 12 months Bank Statement
• ITR for the period of the program

B. Income Verification (ITR): Students who will ask for a refund will have to furnish all the
Income/Income tax-related documents of theirs and their family members as required for
income verification.

C. If at a later point the company finds that the claim is not genuine - then legal remedies will
be undertaken.

D. The refundable amount would only be the amount received as payment, i.e exclusive of
GST, discount or interest paid by the company to NBFC in case of NBFC.
