JUDICIAL AFFIDAVIT OF COMPLAINT

OF RUPERTA B. IGLORIA
(The taking of this affidavit was conducted and supervised
before Atty. Ronald S. Ruaya of the Public Attorney’s
Office of Liloy, Zamboanga del Norte.)

This Judicial Affidavit of RUPERTA B. IGLORIA is executed to serve as her

direct testimony as complainant in a case for grave threats and/or illegal possession of
firearms, as the case may be, against ALBERTO IGLORIA REFUGIO, the judicial
affidavit is offered to prove the following:

I. That the affiant is the complainant and eyewitness to the grave threats and
brandishing and aiming of a firearm by one Alberto I. Refugio.
II. That affiant heard the threats made by Alberto I. Refugio while the latter was
across the affiant’s house holding a handgun and provoking the husband of
affiant to a fight whilst repeatedly aiming his gun at affiant.
III. That affiant shall also testify to other matters related to this case.

Questions were propounded in Bisaya and English, languages known and

understood by the affiant while the corresponding answers were also given by the
affiant in both Bisaya and English, such answers are accurately translated herein, in
English, as given by the affiant.

JUDICIAL AFFIDAVIT PROPER

That I, RUPERTA B. IGLORIA, female, 53 years old, Filipino, married and

presently residing at Brgy. Poblacion East, Salug, Zamboanga del Norte, fully aware
and conscious that I am under oath, and with full knowledge that if my answers are
false, I can be subjected to criminal liability for false testimony or perjury, hereby
depose and say:

QUESTION AND ANSWER

1. Q: Mupamatuod ba ka nga ang tanan nimung isaysay nganhi kay puros

tinuod ug walay lain kundi ang tinuod?
Do you swear that the statements you make in this affidavit will only be the
truth and nothing but the truth?

A: Yes, sir.

2. Q: Unsa man ang imung katuyoan sap ag anhi dire sa opisina sa PAO?
What is your purpose in coming to the office of the Public Attorney’s Office?

 A: Nianhi ko para magpahimu sa akong affidavit para mupasaka ug kaso
batok kang Alberto I. Refugio (Alberto for brevity) kay siya nanghulga sa
akoa ug sa akoang pamilya samtang gadala siya ug pistola.
I am here to execute an affidavit in order to file a complaint against Alberto
because he threatened me and my family while he was armed with a
handgun/pistol.

3. Q: Kanus-a ug asa mani nahitabo ning imung isumbong nga

pagpangawat?
When and where did this alleged theft occur?

A: Nahitabo ni aniadtong Agosto 4, 2018 sa taknang mga alas-tres kapin

didto sa among lugar sa Brgy. Poblacion East, Salug, Zamboanga del
Norte, kay managsilingan raman mi ug duol ra mi ug balay.
This occurred last AUGUST 4, 2018, past 3:00PM in the afternoon in our place
in Brgy. Poblacion East, Salug, Zamboanga del Norte, because we are
neighbors with Alberto and his house is nearby.

4. Q: Unsa man ang eksaktong gibuhat ani ni Alberto nga pasakaan man
nimu siya ug kaso?
What did this Alberto specifically do that you decided to file this case?

A: Sa maong petsa ug oras, samtang ako ug akong anak nga menor de

edad nga gapalangan ug Angel Gabriela B. Igloria naglantaw mi ug salida
sa telebisyon, nakabantay nalang kami nga nay ga singgit-singgit sa gawas,
ug pag dungaw namo, nakita namo kini si Alberto nga didto sa gawas sa
iyang balay, ga tindog ug ga atubang sa amohang direksyon ug nagsinggit
singgit, nabantayan sad namo nga naa siya’y pistola dala.
On the said date and time, as I and my minor daughter Angel Gabriela B.
Igloria were watching television, we noticed that someone was shouting outside
so when we looked out, we saw Alberto who was outside his residence,
standing and facing in our direction and shouting. We also noticed that he was
holding a pistol.

5. Q: Unsa man ang gisinggit singgit aning Alberto?

What was this Alberto shouting about?

A: Gasinggit singgit ni si Alberto nga mugawas daw akong bana kay mag
duelo daw silang duha, permi siyag balik balik ug singgit nga mag duelo
sila sa akong bana, pero kay wala man ang akong bana sa maong higayon,
walay nigawas sa amoa. Samtang ga singgit singgit siya, iya pud gition sa
among direksyon ang iyang pistola, ug kini gadala ug dakong kahadlok sa
ako ug sa akoang menor de edad nga anak.
Alberto was incessantly shouting that my husband should come out so that they
can duel/draw, he constantly repeated this loudly, but because my husband was
not around at that time, no one came out. As he was shouting he also aimed his
pistol in our direction which brought immense and immediate fear out of me
and my minor daughter.

6. Q: Unsa pud inyo gibuhat samtang ga singgit ug gation-tion ni si Alberto?

 What did you do while Alberto was shouting and aiming his gun at your
direction?

A: Kay nahadlok naman kaayo mi, nitawag mi ug pulis, ug ang akong

bata, nag video kang Alberto aron naa mi ikapakita sa iyang gibuhat
(Copy of said video is attached herein as Annex “A”). Sa dihang naabot
ang pulis sa mga pipila ka minuto, kalit rapud ning gilabay ang iyang pusil
ug dali dali niyang tagbo sa pulis gawas sa iyang balay ug iyang
gikaistorya. Wala man ko niduol sa ilang panag istorya mao nang wala
pud ko kabalo ug nganu wala nila gi search ang balay ni Alberto pero
perti Nakong hangyo nga isearch kay naa lage pistola si Alberto, pero ang
pulis wala raman pud kapakabana (PNP Incident Record Form attached
herein as Annex “B”).
Because we were afraid, we called the police and my daughter started recording
a video of Alberto, so we would have something to show to the authorities.
When the police arrived after a few minutes, Alberto suddenly threw away his
gun and hurriedly walked to greet the police and they started talking. I did not
come close that’s why I didn’t know why they did not search the house of
Alberto. I pleaded with the police to search the house for the pistol, but the
police did not bother to do so for some reason.

7. Q: Unsa man diay trabaho aning Alberto?

What is the occupation of this Alberto?

A: Retired Marines mana siya, mao pud siguro rason nganung wala nag
search ang pulis.
He is a retired Marines, probably the reason why the police did not search his
house.

8. Q: Sa gibuhat ni Alberto nga pagsinggit ug pagtion sa inyuha, unsa man

imung nabati?
When Alberto threatened and aimed his pistol at you and your daughter, what
did you feel?

A: Nasinati gyud nako ang dakong kahadlok kay mura naman gyud mi
niyag pusilon sa iyang pustora ug pagpanion sa iyang pistola.
I felt great fear because it seems as though he would shoot us by the way he
was positioned when he aimed his gun at us.

9. Q: Unsa relasyon nimu aning Alberto? Ug naa ba mo panag bikil?

How are you related to Alberto? And do you have any disagreements?

A: Si Alberto ig-agaw ug tagsa sa akong bana, ug naa sila dili

pagkasinabot kay nag akusar ni si Alberto nga yuta daw sa iyang mama
gibaligya sa akong bana, pero kini dakong bakak.
Alberto is a first-degree cousin of my husband, and they have a disagreement
regarding the accusation of Alberto that my husband sold the land of his
(Alberto) mother, but these are all lies.

10.Q: Nagka areglo mo sa Barangay?

 Were you able to settle at the Barangay?

A: Wala sir, kay wala mani siya nitungha sa dihang gipatawag na ni sa

lupon sa barangay, mao nang ania ko kopya sa Certificate to File Action
gikan sa barangay (Hereto attached as Annex “C”).
No sir because when this case was called before the Lupon, he would not
appear that is why I obtained a Certificate to File Action.

11.Q: Wala nay pangutana ang abogado, naa pa ka ikadugang sa imung

affidavit?
The lawyer has nothing more to ask, do you have any more to add to your
affidavit?

A: No, none at this time sir, unless further asked.

12. Q: Andam ba ka mupirma ug mupamatuod sa imong gisaysay aning

maong affidavit?
Would you be willing to sign this affidavit and attest to the truthfulness
thereof?

A: Yes, sir.
