OF CONSFISCATED AGARWOOD

Endorsed herewith is the Memorandum dated May 17, 2023 from CENRO-
Nasipit relative to the aforesaid subject.

On March 8, 2023, Regional Executive Director Nonito M. Tamayo CESO III

issued a memorandum directing CENRO-Nasipit to review/check status of the case
and secure court clearance relative to the confiscated “agarwood” under RCO No.
134-20, 133-20 and 192-20 with criminal cases number 73476, 73677 and 2019-764.

In Criminal Case No. 2019-764, Regional Trial Court Br. 3 of Butuan City,
issued an order dated May 10, 2023 for the issuance of court clearance in favor of
DENR to confiscate, forfeit and disposed in accordance with the law, pursuant to its
judgment dated May 26, 2022.

In Criminal Case No. 73476, and 73677, MTCC issued an Omnibus order
dated May 4, 2023 requiring DENR Regional Office and the custodian to appear and
bring the subject evidence “agarwood” for the prosecution to assess and comment
on the disposal clearance request.

Attached copy of the Court clearance and the Omnibus Order.
