SUBJECT : REQUEST FOR COURT CLEARANCE FOR DISPOSITION

OF CONSFISCATED AGARWOOD

Endorsed herewith is the Memorandum dated May 17, 2023 from CENRO-
Nasipit incompliance with the Memorandum dated March 8, 2023 of RED Nonito M.
Tamayo, CESO III directing said office to review/check status of the case and secure
clearance relative to the confiscated agarwood.

In response, Regional Trial Court Br. 3 of Butuan City, issued an order dated
May 10, 2023 to confiscate, forfeit and disposed in accordance with the law,
pursuant to its judgment dated May 26, 2022, for Criminal Case No. 2019-764

On the other hand, MTCC also issued an Omnibus order dated May 4, 2023
requiring DENR Regional Office and the custodian to appear and bring the subject
evidence “agarwood” for the prosecution to assess and comment on the disposal
clearance request In Criminal Case No. 73476

Attached copy of the Court clearance and the Omnibus Order for reference.
