COMPRO
This Compromise Agreement (the Agreement) is made and entered into this 12th day of
November 2022 at Naga City, Camarines Sur, by and between:
THE HEIRS OF SPOUSES MODESTO S. BAWA & CRISANTA V. BAWA,
Represented by REBECCA BAWA-ARTIAGA, Filipino, of legal age, married
to ALFONSO ARTIAGA, Filipino, and with residence and postal address at Zone
1 Palestina Pili Camarines Sur (hereinafter reffered to as the “First Party”);
-AND-
SPOUSES CARLO P. DELFINO & ADA POMPOSO-DELFINO, both
Filipinos, of legal ages and with residence and postal address at Mabini St.,
Bagumbayan, Ligao City, Albay (hereinafter referred to as the “Second Party”).
WHEREAS, the First Party is the lawful owner of a parcel of land covered by the OCT No.
9584 with EP No. A-063126-A and the Second Party is the Plaintiff/Complainant to an Ejectment
Case filed before the MTC Pili docketed as Civil Case No. 2821 (the “Case”);
WHEREAS, for the purpose of buying peace, the parties have agreed to enter into this
Agreement subject to the terms and conditions indicated below;
NOW THEREFORE, for and in consideration of the foregoing premises, the parties hereby
agrees as follows:
1. The First Party hereby acknowledges the Second Party as the lawful owner of a parcel of
land with an area of THREE THOUSAND ONE HUNDRED EIGHTY THREE (3183) SQUARE
METERS covered by OCT No. 9584 (LOT 2, LOT 4 and LOT 6 of PCS-E2015000035) by
virtue of a contract of sale entered into by Modesto Bawa and his children sometime in
2012.
2. The First Party shall also turn over possession of the 3183 square meter property in favor
of the Second Party upon signing of this agreement.
3. The First Party shall also prepare an Extrajudicial Settlement with Sale between the Heirs
of Modesto Bawa and Carlu Delfino for the 3183 square meter property.
4. In turn, the Second Party shall withdraw the Complaint filed before MTC Pili and
terminate the proceedings in court. The Second Party shall also cause the cancellation of
the Notice of Lis Pendens annotated on the Title before the Register of Deeds of Camarines
Sur.
5. That access and possession of the property shall be given only to the Second Party upon
cancellation of the Notice of Lis Pendens.
IN WITNESS WHEREOF, the parties hereto have mutually and voluntary agreed to the
stipulations and sign this Compromise Agreement this 12th November 2022 at Naga City,
Camarines Sur. Philippines.
