WAIVER AND QUITCLAIM

We, SPS. MA. JOSEFINA P. ALBANIA & EMMANUEL V. ALBANIA, both of


legal age, both Filipino Citizens with residence and forwarding address at 1906-C
IMMACULADA ST., TAYUMAN, TONDO, MANILA, PHILIPPINES, after having been
duly sworn in accordance with law, hereby depose and state that:

1. We previously entered into a Contract to Sell (the, “Contract to Sell”) with New San
Jose Builders, Inc., (NSJBI) for Unit No. 1918 tower B of the VICTORIA DE MALATE
Project dated __________ subject to the terms and conditions stated there.

2. That on ________________, we voluntary and irrevocably transferred/assigned all


our rights, title, and interest, in said Contract to Sell of Unit 1918 tower B as well as any and all
payments made in connection therewith in favor of JEREMIAH A. BOLOS, of legal age,
single, Filipino Citizen and a resident of 6 HOMER ST. FILINVEST 2, BATASAN,
QUEZON CITY, PHILIPPINES.

3. That we hereby release, remise, and forever discharge, and by these presents do
release and forever discharge, NSJBI, its officers and employees, from any and all claims,
demands, causes and actions, damages, costs, expenses, attorneys fees and obligations of any
nature whatsoever, known or unknown, in law or in equity, which we may have now, or may
hereafter have, arising out of or in any way connected with the contract to sell and all payments
made in connection therewith which we have freely and voluntary transferred/assigned to
JEREMIAH A. BOLOS,, and any other legal agreements/covenants with NSJBI, and hereby
covenants and agree that we will never commence, aid in any way, prosecute or cause to be
prosecuted any action or other proceeding based upon any claims, demands, causes of action,
obligations, damages, or liabilities which are the subject of this Waiver and Quitclaim and agree
to indemnify and hold in NSJBI free and harmless from and against any and all such claims,
demands, causes of action, obligation, damages or liabilities.

4. That we have freely and voluntarily executed the foregoing Waiver and Quitclaim, to
attest to the truth of the foregoing, and for what other legal purpose/s it may serve.
