No.2030/Prose(Vig)SBP dtd.20.07.2023 of the S.P., Vigilance, Sambalpur vide Memo
No.395 Dtd.03.08.2023.
Sambalpur intimating therein death of the sole accused namely,
Lambodar Sethy received by this Court, being accompanied by
death enquiry report dtd.19.07.2023 and xerox copy of Death
Certificate of the said accused obtained by Sanjay Ku Pattnaik,
S.I of Police, Vigilance, Sambalpur Division from Anjukta Sethy,
widow of the deceased-accused along with the xerox copy of
Identity proofs of said Anjukta Sethy are put up before me today.
On perusal of the aforesaid letter & enclosures with reference to
the charge-sheet of this case, it appears from the xerox copy of
the Death Certificate issued by the competent authority that on
10.06.2023 accused Lambodar Sethy has expired at Paikmal,
Similipal, Naktideul, Sambalpur. The death report of accused
Lambodar Sethy along with Xerox copy of his Death Certificate
is accepted. Hence, the case against accused Lambodar Sethy is
abated and accordingly the case stands disposed of today. The
bail-bond is cancelled and the surety is discharged from the bail-
bond.
The seized G.C notes of Rs.500/- (Rupees Five hundred)
and Rs.50/- (Rupees Fifty) as mentioned under the respective
item Nos.2 and 3 of the charge-sheet are directed to be returned
to the complainant, if the same has not yet been reimbursed to
him, but in the meantime if it has been reimbursed to the
informant, the seized G.C notes are directed to be confiscated to
the State, the seized documents as mentioned under item Nos.4 to
13 of the charge-sheet are directed to be returned to the respective
persons/offices from which those were seized and the sealed box
received from R.F.S.L, Sambalpur as mentioned in item No.1 of
the charge-sheet is directed to be destroyed four months after
expiry of the appeal period, if no appeal is preferred and in the
event of appeal, if any, the seized articles are directed to be
disposed of as per orders of the Hon’ble Appellate Court.
Send an extract of the order to the S.P, Vigilance,
Sambalpur for information and necessary action.
