Welcome to CF Champlain!
You have been entrusted with the renovation or development of one of our tenants’
premises. It is our pleasure to welcome you and your client.
In the very near future, we will work together to complete this project. Please know that we
will do everything in our power to help you realize your objectives within the specified time
frames. However, it is our duty to ensure that our shopping centre continues to provide an
enjoyable shopping experience for both our customers and nearby retailers while work is in
progress.
This document sets out building regulations, as well as procedures to follow, in order to
enable you to realize your objectives while respecting our policies.

1. Set up an initial building site meeting with the shopping centre’s Operations Manager.
a. A copy of the building permit issued by the city of Dieppe. Contact for the
permit application:
b. Proof of insurance. The Contractor shall, at its expense, obtain and maintain in
force throughout the duration of the construction period, insurance in
adequate amounts for all risks normally insured against by someone
performing work like the Services. Without limiting the foregoing, such
insurance shall include:
3. Please affix the building permit from the issuing city to the hoarding.
1. Keep on site, at any time, the building plans approved by Cadillac Fairview. These
plans must be sealed by an organization professionally accredited in New Brunswick.
These plans must be on site at all times. Sites can be shut down if the appropriate
plans are not on site.
2. Coordinate the delivery of materials (other than by service corridors) with the
Operations Manager or the Security & Life Safety Manager. It is prohibited to use the
centre’s main doors to transport materials and equipment, without prior authorization.
Aerial work platform lifts (aka “scissor lift”) “Access Approval” must be obtained 48
hours in advance by calling CF Connect at 1-800-665-1000 or by email at
cfconnect@cadillacfairview.com.
Aerial work platform lifts “Movement Approval” in mall common areas must be
obtained in advance by calling CF Connect at 1-800-665-1000 or by email at
cfconnect@cadillacfairview.com.
3. Coordinate mall access before or after opening hours with the Operations Manager or
the Security & Life Safety Manager.
a. A 24-hour notice must be respected.
b. After opening hours access must be requested through CF Connect at 1-800-
665-1000 or by email at cfconnect@cadillacfairview.com.
c. Security office can be reached 24/7 at (506) 381-4551.
4. Have an inspected extinguisher as required by fire code (10 lb, ABC type), a first-aid
kit, eye wash stations and an evacuation plan at all times on the premises. Have a
posted list of the Contractor first aid providers, CF Champlain Security Emergency
contact information & Emergency services (911).
6. Ensure that a WHMIS sheet for all products used on the premises and controlled by
WHMIS is present at all times on the premises.
8. Protect the electrical wiring and the thermostat of shopping centre power saving and
HVAC systems. In case of doubt, please check with the Operations Manager.

9. Ensure adequate protection against the spread of dust by having in your possession
a sweeper and vacuum cleaner with appropriate filter. Please install filters on the
ducts and air returns to keep them clean and tidy up the surrounding area.
10. Keep the hoarding in its original state. If it is damaged, you will have 24 hours in
which to repaint and repair it.
11. Keep a copy of this document on the building site at all times.
Please note:
1. The floor must not be cut or drilled without the authorization of the Operations
Manager and such work should be performed solely by the contractor.
2. Before making a floor cut or drill, the Operations Manager must be contacted at least
72 hours in advance to make appropriate arrangements for the floor to be cut. Prior to
the concrete slab being drilled or cut, it must be X-rayed and a report must be
submitted to the Operations Manager for approval before any work. The general
contractor is responsible for any damage caused.
3. Any drilling of the roof should be performed solely by the contractor with the
authorization of the Operations Manager. In order to conserve the guarantee of a
specific roof, it is possible that a specific contractor is hired. Please check with the
Operations Manager.
4. Any work associated with the fire alarm system should be performed solely by the
property’s authorized contractor and with the authorization of the Security & Life
Safety Manager. All work associated with the fire alarm system, as connection,
programming and verification reports must be completed by the Landlord’s
contractor; Johnson Controls (Tyco Integrated Fire & Security) (506) 800-4304. Cost
to be at contractor’s expense.
5. Any work related to the structure of the building must be approved by the Operations
Manager.
6. All lockout work in the premises must be approved beforehand by the Operations
Manager.
7. Make sure that no noise, no odor and no vibration disturb customers and/or other
tenants during shopping centre opening hours between 10:00 am and 9:00 pm
weekdays and Saturday and 12:00 pm and 5:00 pm on Sunday. The property has the
right to stop the work if the noise, odor or vibration disrupts the centre’s operations.
8. Deliveries of materials or furniture will not be accepted in the centre during opening
hours (see above Work in Progress, item #3 for access outside opening hours”).
9. All hazardous, combustible and dangerous material must be secured and locked
when not in use. The owners reserves the right to have these material stored outside
the property (shopping centre).
10. It is strictly prohibited to operate any diesel or propane powered equipment within
the centre.
1. Draw up a list of deficiencies before closing the building site with the Operations
Manager, Owners’ Architect and the Coordinator, Client Design + Delivery. Otherwise,
the Coordinator, Client Design + Delivery will draw up a list of deficiencies based on
the plans approved, as well as guidelines set and discussions held during the course
of the work. The deficiencies report will be sent within 14 business days after the
building site’s closing.
3. Coordinate the removal of the hoarding upon completion of the work with the
Operations Manager. The contractor will dispose of it neatly and then clean the site.
4. After removing the hoarding, repair and paint in the appropriate colour the demising
caps, bulkheads, ceilings and any adjacent Tenant finishes affected by the work.
(See page 14 of this document for paint specifications to use).
A list of the deficiencies addressed, as well as the documents required by management, must
be forwarded before the construction deposit will be returned to the contractor, if
required.
So-called “Hot” Work is work involving an ignition source near flammable or combustible
materials. This kind of work often emits heat and sparks or flames capable of causing a fire.
The shopping centre policy’s objectives are to avoid all hot work associated risk. This way,
if it is possible to make the required works without having to use equipment producing
flames or sparks, this method would always be strongly recommended as an alternative to
hot work. Before proceeding with hot work, the contractor needs to obtain a hot work
permit from the Security & Life Safety Manager, at least 48 hours before the works (see
form in appendix).
Please note that the permit will not be issued if sprinkler protection is not operational.
*THE PERMIT IS VALID ONLY FOR THE DESCRIBED PERIOD. ANY EXTRA HOURS WILL
BE SUBJECT TO A NEW HOT WORK PERMIT.
IMPORTANT: Non-compliance with this regulation will result in a penalty of $1,500 per
non-compliant container.
Cadillac Fairview centres have adopted the Green at Work program, which shows their
commitment to respect the highest environmental standards.
Our waste manager, Miller Waste Systems, has developed a building material recycling
process in which all recyclable materials will be ship to a recognized recycling depot i.e.:
Eco 360, Tri-Province, and DR Recycling.
You must contact Miller waste Systems to obtain a recovery container for building
materials. Contact Miller Waste Systems for delivery of a Container at (506) 855-9783.
Allow 48 hours (business days) for delivery of the container.
Please note:
1. Miller Waste Systems will bill you directly for these costs;
2. Coordinate the location of the waste disposal container with the Operations Manager;
3. Waste container must be closed top and labelled with the contractor’s information,
4. Stationary containers must not be left in the parking lot away of the building;
5. The area around the container must always be kept clean and free of building debris;
a. Avoid materials that will result in excessive scrap waste due to sizing needs;
b. Salvage reusable materials during demolition;
c. Select materials that have recycled content;
d. Select renewable materials;
e. Select materials with low embodied energy and low maintenance requirements;
f. Adhesives, sealants and paints should have a VOC content that meets or
exceeds the local VOC limit requirements or Green Seal requirements;
g. Finished flooring should be environmentally certified;
h. Composite panels and agri-fibre products should contain no added urea
formaldehyde resins.
ADDITIONAL INFORMATION
1. It is strictly prohibited to park vehicles belonging to the contractor in the vicinity of the
building. Vehicles should be parked in the area designated by the Operations
Manager.
2. All repairs carried out by the shopping centre resulting from negligence on the
contractor’s part will be billed to the general contractor, with the addition of a 15% for
administration fee.
3. The contractor must be in the possession of all the equipment necessary to perform
the work. The shopping centre will not loan any equipment.
4. Loads may not be hung from the steel deck or the ceiling. Loads should be free-
standing.
6. It is strictly prohibited to dispose of any liquid waste in the shopping centre’s floor
drains, sink basins, man holes, storm water collectors, etc.
7. It is strictly prohibited to transport materials and tools through the mall entrances.
8. Cadillac Fairview employees and direct subcontractors are not authorized to sign the
contractor’s call sheet. Please ensure that a representative from your company
remains on site to sign subcontractor’s call sheet.
9. The contractor undertakes to comply, at all times, with all the Acts and Regulations in
force with regard to workplace health and safety, or other.
10. Please consult with the Operations Manager for all questions regarding Asbestos in
the premises.
11. The Operations Manager must be consulted when deciding on the HVAC Control and
Fire Alarm contractor.
FLOOR TILES
Floor tiles must be supplied by the centre at the contractor’s request. The price varies
according to the tiles. Fill and send the “tiles order” form with the date you want those tiles
delivered on the premises. The price is $17.00 per tile.
SPRINKLERS
All sprinkler work must be performed by qualified contractor authorized by the Operations
Manager.

The general contractor will notify the Operations Manager in writing, by using the form in
appendix, 48 hours in advance to clear the sprinkler zone. General Contractor and Sprinkler
Contractor are responsible to verify and confirm affected sprinkler zones(s) and to ensure
there are no cross connections within zones.
For each incident, the general contractor will be billed $125 + HST. Fill and send the
“sprinkler drainage request” form.
A request to drain the sprinkler system will be denied if a hot work permit has been issued
during the same period.
A pre work meeting is required to plan sprinkler shutdowns (prior to 48 hour notice) and
determine dates and time of drain and refills. If additional drains and refills are necessary
due to lack of planning or efficiency of work, extra charges may be applied.
Building service fees (sprinkler shut down, tiles, hot work permit, etc.) will be invoiced as
the requests are made. These costs will be directly deducted of the construction deposit
only if they are not paid at the end of the project.
Paint
At the contractor’s request, Operations Manager will provide the necessary color codes for
paint touch-ups of common areas. Colour matching and finishes of affected adjacent
premises is the responsibility of General Contractor.
SECURITY
The security of the premise is at the tenant’s cost and charge. The tenant is responsible for
the security of his own premise.
The shopping centre Administration reserves the right to request the presence of a security
guard in common areas if required by the nature of the work.
Charges will be levied on the contractor for a minimum of 4 hours by the Security
Contractor. Please see Security & Life Safety Manager for contact information.
* The costs will be invoiced to the contractor as the requests are made. These costs will
be directly deducted of the construction deposit only if they are not paid at the end of
the project.
The construction deposit is a guarantee of the work performed by the contractor on its
obligations under the present Construction Rules and Regulations, in addition to all
required work in the leased premises, approved by Cadillac Fairview. The construction
deposit is not a down payment for services to come.
It is agreed that the construction deposit will be interest free and that if Cadillac Fairview
charges all or part of the deposit on any unpaid amount, the full amount of the deposit must
be replaced at Cadillac Fairview’s request.
In the event that the contractor fails to pay invoices of any nature whatsoever or to carry
out work deemed necessary by the landlord, within the prescribed delay, then Cadillac
Fairview reserves the right, without notice nor further formality, and without prejudice to its
other rights and remedies, to use the construction deposit, in whole or in part, to pay those
due amounts.
All or the remaining of the construction deposit will be refunded to the contractor within 45
days following the last to occur:
⋅ the opening of the leased premises to the public;
⋅ the deficiencies have been corrected to the exclusive satisfaction of the landlord;
⋅ the remittance of all required documents mentioned in section 5 of page 10 of the
present Construction Rules and Regulations.
Should the contractor fail or neglect to meet the above-mentioned conditions, the rules
related to acquisitive prescription will apply.
b) Type ‘X’ gypsum board {5/8” (1.59 cm)} (concealed screw heads). Gypsum joint
concealed by ribbon tape.
c) Steel studs {3” (7.62 cm) x 5/8 @ 24” (60.96 cm) oc} (base adhering to the double
coated tape on the existing floor). Make provision for bracing required. Floor drilling is
not permitted.
d) The top part of the hoarding must be closed in 5/8” type ‘X’ gypsum board with steel
studding {3” (7.62 cm) x 5/8 @ 24” (60.96 cm) oc}. Polythene is not permitted.
e) Two steel fire rated doors {72” (182.88 cm) wide x 84 (213.40 cm)} and double door
frame with welded steel threshold.
f) The doorset to come with programmable electronic lockset with keys, hinges, closer,
smoke seal, door sweep and surface mount barrel bolts (top and bottom) on inactive
door leaf.
g) The door frame, as well as the base of the hoarding, must be finished with colonial
style moulding. The door must open inward (in the store/building site).
h) The colour of the hoarding is Sico 1600 #6184-53 Great White North. The hoarding
must be painted in this colour before anything is posted.
i) A 4’ x 6’ carpet must be laid in front of the door on the building site side.
j) Billposting on the hoarding is solely reserved for the Tenants (if authorized by the
Operation Manager). The contractor’s posters may not be displayed.
The jurisdictions in which we operate may have other protected grounds, and we will abide
by all applicable laws. We will not tolerate any behaviour which conflicts with these principles
and laws. Any employee whose actions are inconsistent with these principles will be
disciplined, up to and including dismissal for cause.

The contractor has read the present document entitled “Construction rules & regulations” and
undertakes to enforce its contents:
Each store manager has the responsibility to ensure that the employees of the store
park at edge of parking lot, at any time during the opening hours of the shopping
centre. It is the construction site manager’s responsibility to enforce this policy with
their teams of workers and subcontractors.
No exceptions will be tolerated and offending vehicles will be towed at the owner’s
expense without further notice. Landlord is not responsible for any damage and/or theft to
vehicles using the shopping centre parking lot.

The above List of offences is subject to changes and is given for information only and must not be
regarded as exhaustive. Recourse open to Cadillac Fairview is not solely limited to the imposition of
these fines. Any action contravening the National Fire Code of Canada, the provincial Fire Code and
Building Code, provincial health and safety legislation or any other applicable Act or Regulation, as
determined by Cadillac Fairview, may result in a fine between $10,000 and $100,000 by offence.
The fine amount will be established at the discretion of Cadillac Fairview.
