The Letter of Consent – Regarding Personal Information

With respect to the participation in training course(s) held by the Company, I as a participant of the training
course(s) (the “Participant”) acknowledge and agree to the following terms and conditions.

Article 1 (Personal Information)

The term ‘‘Personal Information’’ in this Letter of Consent (this “Letter”) shall mean such information regarding the
Participant as is provided to the Company upon the participation in the training course(s) including but not limited to
his/her name, work place address, work place phone number, e-mail address, cell phone number, nationality, food
issues or medical issue (if any), smoking or non-smoking, date of birth, Passport number, personnel number,
company name, department, title, job, date of joining the Company, machine service activity experience, machine
operation experience, working experience, records of training results, and records of training courses
attended/completed.

Article 2 (Use of the Personal Information)

1. The Company shall use the Personal Information for the purposes as indicated below:

(1) to prepare, conduct and manage the training course(s); and

(2) to improve continuously the contents of training courses and its material and the training system as a whole.

2. The Company shall use the Personal Information in accordance with the applicable laws and regulations in
Japan, and shall not use the same for the purposes in conflict with those of this Letter, except the case where the
Company is required to use the same in the exercise of its legitimate rights.

Article 3 (Confidentiality)

1. The Company shall treat the Personal Information with due care and shall in no event disclose the same to any
third party without the prior written consent of the Participant; provided, however, (i) that the company may disclose
the same to its subsidiaries which hold training course(s) for worldwide participants and (ii) that the said confidential
obligation shall not apply to such Personal Information as:

(1) is required to be disclosed to a governmental authority pursuant to an applicable law;

(2) is necessary for the Company to disclose the same in the exercise of its legitimate rights; and

(3) is in public knowledge prior to the time of disclosure.

2. The Company shall see to it that, in the event the Personal Information is disclosed to a third party with the prior
written consent of the Participant pursuant to Section 1 of this Article, such third party shall be bound by the same
confidentiality obligations concerning the Personal Information as set forth therein.

I hereby certify that I duly acknowledge and agree to the terms and conditions set forth in this Letter of Consent as
above.

I, Recipient, undersigned, hereby agreed as follows:

(1) Recipient shall use all the Technical Information and any other proprietary information that the Recipient
received along with the Technical Information from Komatsu Ltd. solely for the Purpose described in the Item 5
above.

(2) Recipient shall keep all the Technical Information and any other proprietary information that the Recipient
received along with the Technical Information from Komatsu Ltd. confidential and shall not disclose or transfer the
same to any third party without prior consent of Komatsu Ltd.

(3) In case that the Recipient discloses the Technical Information and other proprietary information received from
Komatsu Ltd., in part or in whole, to a third party with prior consent of Komatsu Ltd., the Recipient shall impose the
same obligations on the third party as the Recipient assumes herein and shall indemnify Komatsu Ltd. for any loss
or damage incurred by Komatsu Ltd. because of failure in the third party’s performance of any of the obligations.

(4) Recipient shall maintain all materials which have the Technical Information and any other proprietary information
that the Recipient received along with the Technical Information from Komatsu Ltd. in strictest confidence and shall
return the same to Komatsu Ltd. after the use of it, upon the request by Komatsu Ltd.

(5) In relation with the disclosed Technical Information listed in the Item 4, the Recipient shall abide by any
conditions reasonably imposed by the applicable export control laws and regulations and those imposed by
Komatsu Ltd. based upon its global export control policy. It is acknowledged that the diversion contrary to Japan
laws and regulations or other export laws and regulations is expressly prohibited.
