TRAINEE SERVICE AGREEMENT

This Service Agreement is executed on 21THday of the month of JANUARY of the year
2024 BETWEEN:

MAGNUSINNOVATIVE TECHNICAL SERVICES PVT. LTD., incorporated in KERALA,


(ID NO.U74200KL2011PTC029370), 2nd floor, JSS Tower, Nilambur Road, Manjeri, Kerala, India,
Pin-676121, Website: www.magnusinnovative.com, hereinafter called THE EMPLOYER of
the FIRST PART.

AND
1. Mr. VISHNU PRASAD aged about 18 years, S/O PRASAD P permanent resident of,
MULLUVENGAPURATHU VAYALA ,KOTTAYAM,686587 , KERALA hereinafter
called as TRAINEE TURNED TECHNICIAN.

2. Surety/relative preferably parent of the person (hereinafter called SURETY).

WHEREAS

The person named above as No.1 amongst the second part applied to the company for training
and employment in servicing and repairs of Cell Phones, Laptop & Desktop computers and
pursuant to the application the company has appointed him as TRAINEE turned
TECHNICIAN on the terms and conditions contained in the offer letter together with this
service agreement under which he is required to undergo training as determined by the
company;

The person named No.2 above the relative/parent of the No.1 (father/mother/uncle) has
undertaken to stand surety to the No.1 in these presents;

The 2 persons of the second part have all understood their definite roles in this agreement and
about their obligations arising out of this agreement and have of their own free will and volition
undertaken to fulfill all the terms and conditions of this agreement.

THIS SERVICE AGREEMENT THERE FORE WITNESSETH AS FOLLOWS:

The TRAINEE TURNED TECHNICIAN agrees and undertakes to do the following acts, deeds and
things:

1. The basic training period for the TRAINEE TURNED TECHNICIAN will be TEN MONTHS from
21st JANUARY 2024 to 20TH NOVEMBER 2024, during the basic training period the Trainee
should keep minimum 85% of attendance for eligible service center training.
2. After the basic training period, the Technician hereby agrees to work in anywhere in
India in any firm/company/franchisee/ service center as instructed by the Employer, on behalf
of Employer, for a period of ONE YEAR from 21st NOVEMBER 2024 to 20th NOVEMBER
2025
3. The total duration of the contract including training period will be ONE YEAR and TEN
MONTHS. i.e., from 21st JANUARY 2024 to 20TH NOVEMBER 2025

4. Duration of above mentioned training period will be extended with unauthorized leaves of the
technician. Unauthorized One leave will be calculated as equal to three leaves and which shall
be added to the total contract period.

5. The TECHNICIAN should be trained by the EMPLOYER in servicing and repairing of all model
mobile phones and smart phones. The EMPLOYER shall give training to the TECHNICIAN with
the latest technology and machines with the assistance of technical experts

6. All the expenses related to the training and work, travelling and accommodation will be
provided by the EMPLOYER. The EMPLOYER will incur an expense of an amount of
Rs.2,54,000/- for the TRAINEE TURNED TECHNICIAN, among which the TRAINEE TURNED
TECHNICIAN shall remit his fee of Rs.1,68,000/-.
7. During the TEN MONTHS training period, the TECHNICIAN shall not be entitled to receive
any stipend. During the ONE YEAR work period, the TECHNICIAN has agreed for the stipend to
be payable by the EMPLOYER in the manner indicated below:-

a. From 21st NOVEMBER 2024 to 20th MAY 2025, Rs. 5,000/- per month.

b. From21st MAY 2025 to 20th NOVEMBER 2025, Rs 6,000/- per month.

8. Once the agreement period is over, the employer will arrange the employment to the
Technician anywhere in India with a salary of Rs.20, 000/- to 40,000/- per month as a Onetime
effort. The Employer will not have any further responsibility after the placement given to the
trainee turned technician.

9. The Technician will also be entitled to receive an additional incentives payable at the end of
the month in the following manner:-

a) Servicing of cell phones up to 150 handset in a month – No incentive


b) From151 handset onwards each handset the apprentice is entitled for
incentives @ Rs.30/- per handset.

(The Technician shall maintain personal diary, counter signed by the supervisor/manager/owner
of the franchisee/branch/service center of the EMPLOYER).

10. Employer shall provide accommodation with cooking facility at the place of training/work.

11. TECHNICIAN shall not work with any other company/firm/service center/ employer during
agreement period. If such problem is found by the employer, the EMPLOYER has right to
terminate this agreement and he shall pay the stipulated Training amount of Rs.86, 000/-
(eighty six thousand) to the EMPLOYER.

12. If the TECHNICIAN is terminated or resigns due to the reason of the TECHNICIAN, the
TECHNICIAN hereby undertakes that he shall refund, Rs.86, 000/-(Rupees eighty six
Thousand), as the expenses incurred for giving training and other facilities.

13. Technician shall not indulge in outside work except company’s handset.

14. Employer has agreed to provide one day leave per week.

15. All illegal activity such as downloading video, copy writing is strictly prohibited by company
during agreement period. If any illegal activity is found, the employer is not responsible and
only Technician is responsible.

16. Technician only is responsible for any loss during repairing due to miss handling of handset
or service tool and etc.

17. Technician has agreed to work under the service center supervisor and Technician shall
work under the decision of Employer.

18. If any service center or franchisee head delays to give Technician’s stipend or incentive,
technician must inform employer immediately, such case employer will give their salary or
incentive directly.

19. If the technician works irregularly or fail to work properly and absents to work without
permission, the employer may cancel the contract by giving 15 days notice and also the
employer has the right to claim stipulated Training balance Fee amount of Rs Rs.86, 000/-
(Rupees eighty six Thousand only) from the TECHNICIAN. If the employee leaves before the
training period, the employer can claim the actual expense which he incurred for the
TECHNICIAN.

20. Technician shall not have alcohol, narcotics and other items of intoxication during the
employment period at the working and accommodation areas.

1. Technician must obey the rules of employer or Franchisee of Company and obey the seniors
for development of employer.
22. In the period of employment, if the Technician meets with an accident or is injured, the
employer is not responsible.
23. The Technician shall not indulge in any illegal activities during the agreement period.
24. The Employer in its absolute discretion may transfer Technician from one location to
another depending on the requirements.

25. The Technician is required, to maintain a discipline specific log book wherein he has to
record all repairs and works done by him every day.
26. The Technician is guilty, if any of the following acts:-
a) Serious misbehavior/misconduct (during working hours);
b) Neglect of work responsibilities;
The Employer may cancel the contract by giving 15 days’ notice and is entitled to claim
stipulated Training Fee amount of Rs.86, 000/-(Rupees eighty six Thousand only)
27. The trainee turned technician shall complete the entire course duration including the
compulsory training period. Otherwise turned technician is not eligible to obtain training
certificate and experience certificate.
28. The Technician shall:

(a) Promote and expand the services of the Company wherein he is employed by the Employer
and work diligently to obtain orders therefore.

(b) Act loyally and faithfully and obey the orders and instructions of the Employer.

(c) Keep proper books of accounts and records of all enquiries and transactions relating to the
products/handsets and submit reports from time to time to the Employer.

29. Employer has right to terminate this agreement if any condition from this agreement is
violated by the Technician, he shall pay the stipulated Training Fee amount of Rs.86, 000/-
(Rupees eighty six Thousand only)
The SURETY agrees and undertakes to do the following acts, deeds and things:

1. The Surety shall keep perpetual watch over the Technician and assure his strict
adherence to all the terms and conditions hereof.
2. The Surety shall in the event of violation and breach by the technician bear the burden
enabling the company to recover the damages /compensation amounts. The Surety shall
be jointly and severally liable with Technician for payment of all amounts that may
become due and payable under the service agreement.

3. The surety hereby confirms that he/she has entered into this agreement together with
the Technician voluntarily and after being fully aware of all legal consequences of this
service agreement.
4. This agreement shall be construed and enforced in accordance with the laws of the state
of Kerala India. All actions to enforce or interpret this agreement, whether by court
action or arbitration, shall be maintained in Manjeri, Malappuram, Kerala. If any term or
provision of this agreement shall be held invalid or unenforceable, the remainder of this
agreement will not be affected, and will be valid and enforceable to the fullest extent
permitted by law.
5. BY understanding the terms and conditions of the Trainee Service Agreement, the
trainee hereby signs and thereby accepting the terms and conditions and join the
MAGNUSINNOVATIVE TECHNICAL SERVICES PVT. LTD as a trainee on this 21st day of
JANUARY 2024.
