Procceeding The complainant alleged that the victim who was a bus
conductor died due to electrocution while he went out for a
morning walk.

In response, the Sr. Superintendent of Police (HR), Police Hqr,

UP submitted an action taken report dated 01.03.2023 along
with enquiry report of DCP, Police Hqr, Varanasi. It was
submitted that on 25.10.2022 the victim Sh. Nandlal Pandey
died due to electrocution when a live high tension electric wire
snapped on him. In this regard, a case vide Manduadih PS FIR
No. 318/2022 u/s 304A IPC was registered. As per post mortem
examination, the cause of death is “electrocution burn injury”.
Case is under investigation.

Vide proceeding dated 03.04.2023 the Commission directed as

under:

“The Commission has considered the material placed on record.

The action taken report of DCP, Police Hqr, Varanasi revealed
that live electric wire snapped on victim on 25.10.2022 caused
his immediate death due to electrocution. FIR has been registered
and case is under investigation. Therefore, let direction be issued
to the Commissioner of Police, Varanasi, Uttar Pradesh, to
submit updated investigation report of Manduadih PS FIR No.
318/2022 u/s 304A IPC within four weeks. Further, let reminder
be issued to the Principal Secretary, Department of Energy, Uttar
Pradesh, the Chief Managing Director, UPPCL, Lucknow, and
the District Magistrate, Varanasi, Uttar Pradesh, to submit action
taken report including inspection report of Electoral Inspector as
mandated under Section 161 (1) of Electricity Act, 2003, and
details of compensation paid to the NOK of deceased victim Sh.
Nandlal Pandey, within four weeks falling which the Commission
shall be constrained to invoke section 13 of Protection of Human
Rights Act, 1993, regarding personal appearance before the
Commission.”

In response, the Dy. Commissioner of Police, Police Hqr,

Lucknow submitted a suppl. report dated 04.05.2023 along with
enquiry report of ACP, Rohaniya, Varanasi. It was submitted that
case was under investigation for want of reply/ enquiry report
from the concerned Executive Engineer.

In addition, the Chief Engineer (Distribution), PVVNL, Varanasi

Zone, submitted an action taken report dated 25.07.2023 wherein
it was submitted that monetary relief of Rs. 5,00,000/- had been
paid to the wife of deceased Sh. Nandlal Pandey. Copy of proof
of payment along with FIR was enclosed with the report.


The Commission has considered the material placed on record.

Upon perusal of record, it is evident that FIR was registered and
case was under investigation. Further, monetary relief of Rs.
5,00,000/- had been paid to the wife of deceased Sh. Nandlal
Pandey.

In view thereof, no further action is required in the matter. The

case is closed. Inform the complainant accordingly.
