This is a verified petition filed by the petitioners praying that after due notice and
Hearing, Fernando Carreon Raton be ordered to : produce the original copy of the Notarial
Will of Josefina M. Enriquez dated June 08, 1982; that the above-mentioned Notarial
Will be admitted to probate; that the letters testamentary be issued to herein petitioner
And/or his representative; and that the property mentioned in the Will particularly 111
Twin Pioneer, Don Carlos Village, CAA Compound, Pasay City covered by ARP/TD No.
C7-190-00424 and C7-190-00425be equally partitioned among the heirs mentioned in
the Will subject to reimbursement on the expenses of partition and payment of real
property taxes.
It is alleged in the Petition that: “Last May 10, 1990, the deceased Josefa M.
Enriquez died due to sickness, leaving a Last Will and Testament dated June 08, 1982
M. Rosendo De Guzman is named as the sole executor of the Last Will and Testament.
and in his default or incapacity to act, Mr. Abelar Pilaza shall act as executor Based on
information and documents provided by the decedent to the petitioner when she was still
alive, and as far as the petitioners know it was decedent’ wish that the semi-
permanent residential building located at 111 Twin Pioneer, Don Carlos Village , CAA
Compound , Pasay City be equally distributed among her heirs.”
That based on information and documents provided by the decedent to the
Petitioners when she was alive, and as far as the petitioners herein know , the names , ages
and residences of the surviving heirs, legatees, and devises named by the decedent in the
documents she executed, who are residents of the Philippines are the following, to wit:

That said decedent left property in the Philippines, with an assessed value of Php
84,000.00 and Php 64,000.00.

The Court finds the Petition sufficient in form and substance thereby it is given due
course. The initial hearing on the petition is set on October 19, 2023 at 01:30 o’clock in the
Afternoon.

Petitioner is directed to cause the publication of this Order at least once a week
For three (3) consecutive weeks before the hearing on October 19, 2023 at 01;30 o’clock
In the afternoon in a newspaper of general circulation in Metro Manila, selected by
Raffle pursuant to PD No. 1079, at his expense.

The Branch Sheriff is directed to post this Order in conspicuous places in Pasay
City.

Let the Office of the Solicitor General, City Prosecutor’s Office of Pasay City, all
heirs and respondent be furnished with a copy of this order together with the petition and
Its annexes at the expense of the petitioners.
