Introduction;

Non-institutional correction is a privilege granted by a court to a person convicted of a crime or criminal


offense to remain with the community instead of actually going to prison. The community corrections
are an effective way to reduce crime. This is majorly through learning a close supervision of the
offender. The close supervision ensures that the offender abides to the rules and regulations stipulated.
The use of variety of officially ordered program based sanctions that permit convicted offender to
remain in the community under supervision as an alternative to active imprisonment.

By non-institutional correction is meant the accused is tried under the Law and the Rules of court, after
trial had, he was sentenced and the judgement being final and executory and the time of appeal lapsed,
he has to serve his sentence.

Under the Revised Penal Code as amended, there are crimes that need not be served by imprisonment.
There can be applied for Probation, subject to the sound discretion of the Court having Jurisdiction of
the case.

There can also be suspended service of sentence, again subject to the sound discretion of the court. The
protection of law-abiding members of society by keeping convicted offenders from preying on society.
The reformation and rehabilitation of offenders in preparation for their eventual reintegration to the
mainstream of society and helping them lead a normal life after release.

Now if the crime was committed by person(s) the convicted accused need not be imprisoned but a
separate rule be applied. The advantages of this is that it is less costly on the part of government, the
offender's family need not suffer since the offender will not be sent away from them and he will still be
able to go on with his life and livelihood thereby enabling him to support his family and not to be far
away from his children.

So depending upon factual circumstances of the case, it can be argued that not all those convicted need
go to jail, institutionalized; which is proof positive that in Philippines under the Revised Penal Code as
amended, there is still a ray of mercy.

Not all convicted offenders have to serve their sentence behind bars. Some are allowed to stay in the
community, subject to conditions imposed by the government. They are either granted Probation,
Parole, Conditional Pardon or Recognizance.

It is important to know and study the community based or non-institutional correction because
community correction are an effective way to reduce crime. Rehabilitation will be more effective as the
convict will not be exposed to hardened criminals in prisons who will only influence him to a life of
crime; Rehabilitation can be monitored by the community thus corrections can be made and more
effective; Cost of incarceration will be eliminated which is extremely beneficial especially to a cash-
strapped goverment.
Conclusion

Efficient and effective non-correctional administration plays a vital role in promoting rehabilitation,
reducing recidivism, and contributing to the overall well-being of individuals involved in the criminal
justice system in the Philippines. By implementing the recommendations outlined above, the non-
correctional system can be strengthened to better address the needs of inmates, facilitate successful
reintegration, and promote a safer society.

It is essential for the government to prioritize the allocation of resources towards comprehensive
rehabilitation programs, ensuring that inmates receive the necessary support to overcome the factors
that contribute to their criminal behavior. Furthermore, ongoing training and development for non-
correctional staff members are crucial to enable them to perform their roles effectively and
compassionately.

Transparency and accountability mechanisms must be established to build trust and confidence in the
non-correctional administration. Regular audits and independent oversight will help identify areas of
improvement and address any potential issues promptly.

Lastly, collaboration and partnerships with various stakeholders can bring together diverse expertise and
resources to enhance the non-correctional system's outcomes. By working together, the government,
community organizations, educational institutions, and private sectors can develop innovative
approaches and holistic solutions that promote successful rehabilitation and reintegration.

Recommendation

By implementing these recommendations, the non-correctional administration in the Philippines can be


transformed into a system that not only punishes but also rehabilitates, providing individuals with the
necessary support to reintegrate into society and lead productive lives.

• Improve Community Service – I think this program requires offenders to perform community
service, such as cleaning up public areas, helping in charity events, or providing assistance to people in
need. This program aims to instill a sense of responsibility, empathy, and citizenship in offenders.

• Promote restorative Justice – This is a good program since it involves bringing together the
offender, the victim, and the community to discuss the harm caused by the offender's actions and find
ways to repair the harm. This program aims to promote reconciliation, healing, and accountability.

• Counseling and Therapy - This program provides psychological counseling and therapy to
offenders who have committed offenses due to emotional or psychological issues. This program aims to
address the root cause of the offender's behavior and provide them with the guidance and support they
need to overcome their issues.

• Education and Job Training - This program provides education and job training to offenders,
helping them acquire the skills and knowledge they need to secure employment and become self-
sufficient. This program aims to reduce recidivism by providing offenders with a path towards a stable
and productive life.
