It is the opinion of this Assistant State Attorney that no criminal charges be filed in this case for
the following reasons:

On June 11, 2023, the victim walked into the City of Miami Police station to report she was the
victim of a sexual assault at the Kaseya Center during a Heat game on June 9, 2023. At first, the
victim wanted to remain anonymous and refused to provide a formal statement. The victim told
detectives that she was at the Courtside Club located in the Kaseya Center on the night of the incident,
where she met the subject. The victim stated the subject asked her to go with him to the restroom and
she agreed. With the assistance of security and the bodyguard, she entered the restroom with the
subject. Once in the stall, the victim sat down on the toilet and the subject entered and attempted to put
his erect penis into her mouth. The victim stated she told him "no" because the arena's restroom is not
the right place and asked him to wait to get to the hotel. According to the victim, the subject continued
his attempts until the victim stood up. At this point, the subject turned the victim around, placed her
against the wall, and attempted to penetrate her anally. The victim stated she resisted and was able to
get away. The victim asked the detectives for legal advice, which they informed her they were not
permitted or qualified to give. The victim then asked detectives if they thought Mr. McGregor would
like to "settle" or "pay her oft" if she did not pursue charges. Once again, the detectives told the victim
they could not provide legal advice. The victim then left, stating she wanted to think about how to
proceed.

On June 12, 2023, an attorney contacted the lead detective on behalf of the victim. The attorney
agreed to bring the victim in for a statement. A statement consistent with the original report was taken
from the victim by Detective Lopez and Sgt. Cotilla. The statement was audio recorded and reviewed

by this Assistant State Attorney. The victim stated she regularly goes to the Courtside Club and knows
some of the people who work there. During the recorded interview, the victim went into more detail
about how, prior to going to the men's restroom with the subject, she was dancing with him and he
seemed

"really into her." The subject asked the victim to go back to the Four Seasons with him and she
responded, "okay." At some point, the victim stated the subject went to the restroom. A few minutes
later, an unknown male who was previously with the subject came out to get her stating, "Conor told
me to come get you." The victim stated she agreed to go with the male because she believed they were
going to the Four Seasons hotel. When they got to the bathroom, the security guard (who she knows)
would not allow her in and the victim told him, "Ralph, let us go in, he (McGregor) wants us to come
in there. The security guard refused, but she eventually went in. The victim then explained how she sat
down to urinate, at which point the subject tried to penetrate her mouth with his erect penis. The
victim stated she told him to stop. The victim was able to get up and the subject forced her against a
wall and tried to put his penis in her anus. The victim stated she told him, "No, not here." The victim
stated the subject eventually backed up and she was able to leave. The*victim stated that, once back at
the table, the subject returned but did not want anything to do with her. The victim stated she left
shortly after.

Detectives contemplated a controlled call wherein the victim would call the subject and
confront him with the allegations, but they learned from the victim's attorney that she (the attorney)
had already contacted the subject's attorney and offered to settle the situation "amicably." The attorney
stated she thought defense might want to get in front of the situation before it hit the media, and she
wanted to give "the offending party the opportunity to right the wrong" before going to police. Based
on the subject being tipped off to the possibility of an investigation, detectives opted not to attempt a
controlled call,

Detectives and this ASA reviewed CCTV footage from the night of incident, which was
provided by Kaseya Center and is part of the case file. The video shows the victim waiting outside the
men's restroom with a large group of people. The victim waited for approximately four minutes until
the subject approached her, took her hand, and led her into the restroom. Another woman is seen
accompanying her into the restroom. While the victim and the subject are in the restroom, other
patrons are allowed in two at a time. After approximately five minutes, the victim exits the restroom
and waits by the door. Approximately three minutes later, the subject exits the restroom and they leave
the area together. The second female leaves the restroom shortly after. After leaving the restroom, the
victim and the subject continue to be seen together in the club on CCTV until parting ways at
approximately 12:40.

The following witnesses were interviewed by detectives and this ASA reviewed their audio
recorded statements, A summary of their statements is as follows:

The bathroom attendant provided a statement to detectives on August 29, 2023. The
interview was in Spanish, but a Spanish speaking Assistant State Attorney helped
translate. The bathroom attendant was inside the bathroom when the rape allegedly
occurred. He remembered the subject and the victim coming into the restroom and going
into the same stall. Another female came into the restroom with the victim and subject
but did not go into the stall. The bathroom attendant stated the subject and the victim

were in the stall for approximately ten minutes, maybe less. While the subject and the
victim were in the stall, the bathroom attendant did not hear any signs of distress or
sounds that would corroborate that whatever was occurring was not consensual. When
the victim and the subject exited the stall, the subject took a photo with another male in
the restroom and the victim left. The victim did not have any injuries and did not seem
upset.

The head of security for the Courtside Club provided a statement on June 20, 2023. He
knew the victim because she was a regular at the Courtside Club, and he was working on
the night of the incident. The supervisor did not see the victim or the subject enter the
restroom, but he saw a crowd at the door to the restroom and went inside to see what was

happening. When he entered, he saw two females in the men's restroom. He asked the
victim what she was doing in the men's restroom and she stated, "pleasure doing
business." The victim did not say anything to him about being raped or sexually
assaulted. The victim then went back to her seat and continued to socialize with the
subject.

Detectives took a statement from the server assigned to the subject's table. The server
stated the subject came into the Courtside Club at half time. When he arrived, a crowd
was asking for selfies, video, etc. The server saw the victim in the subject's section, and
she saw the subject and the victim speaking to each other. After the half, the subject
went back to the game and the victims stayed at his table. The subject returned after the
game and continued to engage with the victim, The server did not see the subject or the
victim go into the bathroom—she was focused on her tables. The victim did not leave
the club until the subject left. The victim seemed "fine" throughout the night and did not
mention that anything happened.

Detectives took a statement from another server working on the night of the incident. This
server was assigned to the section adjacent to the section where the subject was seated.
The second senrer stated the victim was at thc club first. The subject arrived after the
half. This server also did not see the victim or the subject go into the bathroom. She
confirmed the victim did not leave until closing and was still interacting with the subject
until he left. The victim seemed fine throughout the night and showed no signs of
distress.

Detectives took a statement from the table server assistant assigned to the subject's table.
The subject had an entourage of people around him. The assistant saw the subject and
the victim talking to each other but did not hear the conversation. He also saw them
dancing together. At some point, the assistant saw the subject go into the restroom and
helped clear the crowd behind him. The victim and her friend waited for a few minutes
outside the restroom. While the victim was waiting, the assistant asked her how she got
into the VIP section and the victim responded with something to the effect of, "just being
me." According to the assistant, the subject then came out of the restroom and the victim
pushed him back toward the restroom and the three went in. The assistant did not follow
them into the restroom. When the group came out, everything seemed normal and the

victim returned to the subject's table. The subject returned to the game. The assistant
stated he saw the subject pay attention to other girls later in the night, but the victim and
her friend still seemed very interested in the subject.

Detectives took a statement from the subject's assigned security guard. The security
guard was assigned by the Courtside Club, as is their practice when hosting a celebrity.
The security guard is also very familiar with the victim because she is a regular. As to
this incident, the security guard said the victim at first seemed to lead the subject toward
the restroom and then waited as he went in. The security guard accompanied the subject
into the restroom and blocked the door while the subject went into one of the three stalls.
While waiting for the subject, the victim kept trying to bypass security to enter stating,
"he wants me in there." The subject then exited the stall and grabbed the victim by the
hand and led her into the stall. The subject and the victim were in the stall for a few
minutes. The security guard did not hear signs of struggle or calls for help. The victim
then exited the stall. She did not tell the security guard that anything had happened and
was acting normal. The victim called the security guard the next day to tell him she had
been sexually assaulted while in the stall. The security guard added that he thinks the
victim's

allegations are false because he did not see or hear anything indicating whatever
occurred was not consensual.

Finally, detectives interviewed the victim's friend who was with her on the night of the
incident. On the night of the incident, the victim called the friend and wanted to go to the
Heat game but did not have tickets, so they decided to go to the Courtside Club. The
friend had never been to the Courtside Club, but when she arrived it was clear the victim
had been there before and knew the people who worked there. The friend also did not
know the who the subject was but saw him enter with an entourage and assumed he was
some sort of celebrity. The friend stated she and the victim had about two drinks each.
The subject initiated contact with the victim and she and the victim were invited into his
VIP section. As for what occurred in the men's restroom, the friend accompanied the
victim and the subject to the outer door. The friend waited with the victim while the
subject went inside the restroom. The subject then came out and took the victim by the
hand to lead her into the restroom, and the victim grabbed the friend's hand. Once inside
the restroom, the victim and the subject went into the same stall. The friend stayed by the
sink waiting. While waiting, shc did not hear anything out of the ordinary. The friend did
not hear any signs of struggle or force. When the victim exited, she did not tell her friend
anything had happened. The friend and the victim stayed the rest of the night. On the
way home, the victim did not say anything about being sexually assaulted and even
called her mother to tell her she had met Connor McGregor. The victim did say
something about being willing to have sex with the subject at the Four Seasons, but not
in a bathroom. The next day, the victim sent a text to the friend with their bill (to split)
saying, "had fun last night." Again, the victim did not mention any sexual assault.

The subject invoked his Miranda rights.

Under Florida Statute 794.011, the crime of sexual battery requires the State to prove beyond a
reasonable doubt that the victim did not consent to the sexual activity. Based on the witness statements
and other evidence available in the case, the State would not be able to meet this burden in this case.
It is a one on one allegation.
It is a delayed disclosure.
The subject opted not to make any statements.
Contradicting and/or no corroborating witnesses.
Insufficient evidence.
Other:

In light of the above facts and circumstances, the State would not be able to satisfy its burden of proof
beyond a reasonable doubt.
