RE: Request for Evidence of I-140 Immigration Petition for Dr. Good Faith (EB-1(b)
Outstanding Professor/Researcher)
On November 11, 2009, we received a letter of Request for Evidence regarding the I-140 petition for Dr.
Good Faith. I am the CEO of XXX, Inc and am providing the following, as requested, in support of Dr.
Faith’s petition:
Exhibit 1:
1. Submit evidence that the beneficiary has at least three years of experience in teaching and/or
research in the academic field. Experience in teaching or research while working on an advanced
degree will only be acceptable if the alien has acquired the degree, and if the teaching duties were
such that he or she had full responsibility for the class taught or if the research conducted toward
the degree that has been recognized within the academic field as outstanding. Evidence must be in
the form of letter(s) from current or former employer(s) and must include the name, address, and
title of the writer, and a specific description of the duties performed by the alien.
i. Support letter from Dr. Faith’s former employer, Dr. KK, Chair of Department of Molecular
Biology and Genetics at XXX University, with Dr. KK’s CV.
ii. Dr. Faith’s CV.
Exhibit 2:
2. Submit evidence that the petitioner employs at least three full-time employees in research positions.
Evidence should include but is not limited to copies of each employee's most recent W-2 and an
indication of the position held by each employee. Please also submit documentary evidence that
the petitioner has achieved documented accomplishments in the filed.
i. Most recent W-2 forms for employees employed at the end of 2008 and an unemployment
form documenting new employees hired during 2009.

Exhibit 3:
3. Submit evidence to establish that the petitioner had the financial ability to pay the proffered wage
as of Aug 18, 2009, the priority date, and continues to have such ability. Such evidence must
include annual reports, U.S. federal tax returns, or audited financial statements. In addition to the
documents listed above, you may also include additional evidence, such as profit/loss statement,
bank account records, personnel records. If you employ 100 workers or more, you may submit a
statement from a financial officer of the organization, establishing your ability to pay the proffered
wage.
i. Recent U.S. federal tax returns of the company.
ii. Grant award letters and financial support from The National Institutes of Health (NIH). The
company has received several grants totaling approximately $1,200,000 for the period 2008-
2011.
Exhibit 4:
4. Provide a copy of the beneficiary's most recent pay voucher. The voucher that you provide must
identify both the beneficiary and the employer by name, and specify the beneficiary's gross/net pay,
income received year-to-date, income tax deductions withheld, and the length of the pay period.
i. A copy of Dr. Faith’s most recent pay voucher.
Please note that in Dr. Faith's original I-140 application package, submitted on August 18, 2009, we
enclosed the following:
1. Evidence of Dr. Faith’s original scientific or scholarly research contributions to the academic
field.
- Dr. Faith’s research, immediately after publication, has been included in teaching materials at the
University of XXX.
- The experimental materials Dr. Faith created have been requested by his colleagues and circulated
in the scientific community.
- Many experts have expressed their opinions about Dr. Faith's outstanding contributions to his field
and enthusiastically supported Dr. Faith's application for a US permanent resident. With diverse
backgrounds, those experts are from both the U.S and Europe, and include professors from well-
known universities, a department chairperson, a member of the U.S. National Academy of
Sciences, an editor of a scientific journal and a pioneer in industry. The references, which are
summarized in the table below, were taken from the recommendation letters found in the original
I-140 application.

2. Evidence of Dr. Faith’s authorship of scholarly books or articles in the scholarly journals with
international circulation.
- Dr. Faith has published six original scientific papers, including five first-author papers in the
area of Molecular Biology and Genetics. These papers have been published internationally in
prestigious, peer-reviewed journals such as Developmental Biology and Plos Biology. According to
Institute for Scientific Information (ISI) Web of Knowledge, Developmental Biology is rated in the
top 3 regarding the total citations and ranked No.1 with respect to the number of articles
among all scientific journals in its area. Plos Biology is ranked No.1 with respect to impact
among all international journals in the category of biology.
- His work has been independently cited by scientists/researchers from twenty (20) different
institutions in seven (7) different countries, including U.S., France, Germany, Japan, China,
India and Brazil. Those citations can be found in papers published by twenty four (24) different
international scientific journals including top journals such as “Nature”, “Genes &
Development”, “Aging Cell”, and “Oncogene”. As a demonstration of the importance and impact
of his work, his papers have been cited by seven (7) scientific reviews in his field to date.
3. Additional evidence supporting that Dr. Faith is recognized internationally as outstanding in his
field.
- Dr. Faith has been invited to act as a judge in evaluating the work of the others in the scientific
community. He has been asked to peer review journal submissions for the scientific journals in his
area such as XXX.
- Dr. Faith has been selected to present his work at several prestigious international and national
meetings in front of thousands of scientists from all over the world.
In summary, Dr. Faith has made outstanding contributions in the field of molecular biology and genetics
and he has been recognized as an exceptional young scientist by many experts in his field. His presence in
the United States will constitute an invaluable asset to his field and offer significant economical and social
benefits to the United States. I believe that this letter, together with the original I-140 application package,
has clearly demonstrated that Dr. Faith has met the criteria for EB-1(b) petition (Outstanding Researcher)
and I trust that his petition will be granted. Should you require additional inputs or information in support
