AFFIDAVIT OF LOSS OF TRANSFER CERTIFICATE OF TITLE

I, Jim Beam M. Tolding, of legal age, widower, Filipino citizen and a resident of
IC 47, Betag, La Trinidad Benguet, Philippines, after having duly sworn to in accordance
with law, do hereby depose and state THAT:

1. I am the lawful and registered owner and possessor of a certain parcel of land
located at Barangay Shilan, La Trinidad Benguet, covered by Transfer
Certificate of Title No. T-65375 and Assessment of Real Property No. 2010-
03-14-00870.

2. Since said property was transferred and registered in my name, I have been
using the title aforesaid as security or collateral on my several loans. Whenever
I am able to settle these loans and the title delivered back to me, I usually kept
the original owner’s copy of Transfer Certificate of Title No. T-65375 inside
one of the personal drawers in our house together with other business
documents;

3. The latest transaction where I used the property covered by the afore-cited title
was the real estate mortgage (REM) I executed in favour of Adamson Cuña
(Mortgagee). I therefore delivered to him (Cuña) the original owners duplicate
copy of Transfer Certificate of Title No. T-65375;

4. Lately, I was able to fully settle my mortgage obligation to the mortgagee.


Thereafter, the latter gave back to me the original owner’s copy of the title and
I placed inside a long brown envelop. I then and there proceeded to my
business area at Palmaville, Puguis, La Trinidad, Benguet, Philippines and
later, went to the La Trinidad New Public Market at Km. 5, La Trinidad,
Benguet. Thereafter, I went home to Betag, La Trinidad, Benguet;

5. After several days, I decided to process for the cancellation of the mortgage
afore-mentioned. I therefore locate and search for my long brown envelop
where I last kept the said original owner’s copy of TCT No. T-65375 since the
same is needed in the process. However, much to my disappoint and
frustration, I was not able to locate the same in places where I could have left
or kept it. Nevertheless, I tried hard to locate the said document in the said
premises, but still, I was not able to locate it;

6. Despite my earnest effort to locate or find the said owner’s original copy of
Transfer Certificate of Title No. T-65375, the same proved futile. I therefore
consider the same irretrievably lost and beyond recovery;

7. The said document was not cancelled, transferred nor delivered to any person
or entity for the satisfaction of any civil obligation, but due to the afore cited
reason;

8. I am executing this Affidavit to attest to the truthfulness of the foregoing facts


and for all legal intents and purposes this may serve.
