WHEREAS, the building permission has obtained No
77-2019 issued by City Council in Hurghada, Red Sea

WHEREAS, the Seller is the owner and the developer of
a project on the aforementioned plot of land holding the ‫وﺣيﺚ أن الﺒاﺋع هو اﻤﻟاﻚﻟ والقاﻢﺋ عﻰﻠ ﺗﻤﻨﯿﺔ مﺮﺸوع القرﯾﺔ الﺴ ﯿاﺣيﺔ أكوا‬
brand name (Aqua Infinity Resort) (hereinafter "‫انفﻨﯿت رﯾزورت ويﺸار اﻟهيا ﻓﺎﻤﯿ بعد "ابلقرﯾﺔ‬
referred to as the “Resort”);

WHEREAS, the Purchaser wishes to buy from the Seller ‫وﻤﻟا ﺎﻛن اﻤﻟﺸرتى ﯾرﻏب ﻰﻓ رشاء وﺣدة ﺳكﻨﯿﺔ من الﺒاﺋع ابﻤﻟﻨتﺠع مع الﺰﺘامه‬
a unit located in the Resort, subject to the terms and
conditions set forth herein, and after reviewing the
‫بﻜﻓﺔ الﺮﺸوط واﻷﺣﻜم الواردة ﻰﻓ هذا العقد وذﻚﻟ بعد اﻃالعه عﻰﻠ‬
master plan of Aqua Infinity Resort and engineering ‫اﺨﻤﻟطﻂ العام ﻷكوا ﺗروبﯿﻜل رﯾزورت والرﺳومات الﻬﻨدﺳ ﯿﺔ اخلاصﺔ ابلوﺣدة‬
drawings subject to this Agreement, has become aware ‫الﺴكﻨﯿﺔ ﺤﻣﻞ هذا العقد وعﻠ مبواصفاهتا وموقعﻬا وقﺒلﻬا وأنه عاﯾﻬﻨا اﻤﻟعاﯾﻨﺔ‬
of its specifications, location and facilities, has accepted
them and has undertaken to comply with all the terms

and conditions of this Agreement, and use the Resort in
accordance with the following agreed conditions;

Now, therefore, the present contract is written ‫ ﻓقد ﺣرر هذا العقد بي ﻃرﻓيه بعد أن أقرا بﺄهلﯿهتﺎﻤ القانونﯿﺔ‬،‫و بﻨاء علﯿه‬
between the Parties hereto who declared that ،‫ﻹبرام مﺜﻞ هذا التعاقد و ﺳالمﺔ ارادهتﺎﻤ من الﺸواﺋب اﻤﻟفﺴدة للرضاء‬
they have full capacity to conclude and enter into ‫و بعد أن أقرا ﺑﺮﺴﯾن أﺣﻜم هذا العقد عﻰﻠ خلفهيﺎﻤ العام واخلاص‬
the present contract and that their wills,
respectively, are free from any defect that would ‫واتفقا عﻰﻠ اﻵﺗ‬
impair their consent hereto. Both Parties have
also acknowledged that this present contract
stipulations are valid against their next of kin and
legal successors. Therefore they have agreed on
the following:

Article (1) Preamble Provisions ‫( اﻟﺘﻤﻬﯿﺪ‬1) ‫اﻟﻤﺎدة‬

1.1. The foregoing preamble and all annexes ‫ ﯾعترب اﻟﻤﺘﻬﯿد الﺴابق واﻤﻟالﺣق اﻤﻟرﻓقﺔ ﻤﺟﯿعﻬا‬.1.1
hereto shall be considered an integral and ‫جزءا ﻻ ﯾتﺠزأ من هذا العقد ومﻤﻜال ومفﺮﺴا ﻷﺣﻜمه‬
complementary part of this Agreement. The :‫وﺗﺸ ﻤﺘﻞ ملﺤقاته عﻰﻠ التاﻟ‬

Article (2) Subject of the Agreement ‫) محل اﻟعقﺪ‬2( ‫اﻟﻤﺎدة‬

2.1. The Seller hereby sells, assigns and ‫ اﻟﻜﺋﻨﺔ‬00 ‫ ابع وأﺳقﻂ وتﻨازل الﺒاﺋع اىل اﻤﻟﺸرتى عن الوﺣدة رمق‬1.2
transfers to the Purchaser, as a freehold and
free of any rights of any third party, the unit No:

or decrease) in the Resort as specified in the

Finishing Specification in Annex (3) and the
Unit Plan in Annex (2) (hereinafter referred to .‫ﻷﻏراض الﺴكنﯿﺔ اخلاص ﻓقﻂ‬
as the “Unit”) for private residential purposes
only.

2.2 In addition, the Purchaser shall, in ‫ ﻛﺎﻤ ﯾكون للﻤﺸرتي وﻓقا لﻸﺣﻜم القانونﯿﺔ اﻤﻟطﺒقﺔ ملكيﺔ عﻰﻠ‬.2.2

provisions, acquire co-ownership of the ‫وﯾكون نصﯿب ك ماﻚﻟ ﻓهيا بنﺴ ﺒﺔ قﻤﯿﺔ اجلزء اﺬﻟى ﻪﻟ ﻰﻓ ادلار؛ وتالﻓيا‬
ground and the parts of the building of the
Unit intended for the common use in ‫ﻷي شﻚ ﺗﺮﺴي اﻤﻟلكيﺔ الﺸاﺋعﺔ اﻤﻟﺸار اﻟهيا أعاله عﻰﻠ اﻤﻟﺒﻰﻨ اﺬﻟي تقع‬
Proportion to the value of the part of the ‫ﻓيه الوﺣدة واﻷرض اﻤﻟقام علهيا دون ﻏﺮﯿه من مراﻓق تقع خارج اﻤﻟﺒﻰﻨ و‬
building acquired. The common parts are the ‫يﺸﻤﻞ هذا الﺒﯿع ﺣقوق اﻤﻟلكيﺔ اﻤﻟﺸرتﻛﺔ ﻰﻓ اجلدران الرﺋﯿﺴ ﯿﺔ و اﻤﻟداخﻞ‬
main walls, the entrances, stairs and yards, of
the unit. For the avoidance of doubt, this co
.‫و اﻷﻓﻨﯿﺔ و اﻤﻟصاعد للوﺣدة الﺴكﻨﯿﺔ ﻓقﻂ‬
ownership shall only apply to the building in
which the Unit is located and the ground on
which that building is erected, but not to any
facilities outside the building.

2.3. In addition, the Purchaser shall have a


right to utilize the common facilities of the ‫ ﺤﯾق للﻤﺸرتي اﺳ تعﺎﻤل اﻤﻟراﻓق اﻤﻟﺸرتﻛﺔ ابلقرﯾﺔ‬،‫ ابﻹضاﻓﺔ اﻟ ذﻚﻟ‬.3.2
Resort, in common with the owners of other .‫ابﻻشرتاك مع ابﻗ مالك الوﺣدات‬
units.

2.4. Both Parties agree that the Seller shall ‫ ومن اﻤﻟتفق علﯿه بي الطرﻓي من اﻵن أن تﻈﻞ ملكيﺔ أﺳطﺢ‬.4.2
have the sole property of the roofs; where ‫ وﻻ ﺤﯾق للﻤﺸرتى أو خلﻓھﻢ‬.‫العﺎﻤرات) الروف( ملكيﺔ خاصﺔ اتمﺔ للﺒاﺋع‬
neither the Buyer nor his universal or singular
successor shall be entitled to claim the Seller .‫العام أو اخلاص مطالﺒﺔ الﺒاﺋع بﺄي الﺰﺘام ﺨﯾﺺ ﺳطﺢ اﻤﻟﺮﺸوع‬
with anything pertaining to the project's roof.

Article (3) Purchase Price ‫( ﺛﻤﻦ اﻟﺸﺮاء‬3) ‫اﻟﻤﺎدة‬


3.1. As a matter of fact, both Parties hereto have
conclusively and irrevocably agreed that the ‫) جﻨﯿﺔ‬000( ‫ اتفق ﻃرﻓا العقد عﻰﻠ أن مثن الوﺣدة‬.1.3
Purchase Price for the housing unit subject-
matter of this contract is equal (00 GBP) ,‫اﺳرتلﯿﻰﻨ وذاﻚﻟ نﻈﺮﯿ ﺣق ملكيﺔ عﻰﻠ الوﺣدة ﺳالفﺔ اﺬﻟكر‬
The Purchaser has settled the sum of
(000 GBP) during signing this Agreement as

remainder of the Purchase Price, amounting

3.2. The Purchaser shall pay 8% due at the ‫ وﯾعترب هذا اﻤﻟﺒلﻎ‬,‫ يﺴ تﺤق عﻨد اﺳ تالﻬﻣا‬8% ‫ ﯾلﺰﺘم اﻤﻟﺸرتي بدﻓع‬2.3.

maintenance of the Resort. The Seller has a ‫ ﻛﺤد أقﺼ عﻰﻠ مصارﯾﻒ اﻤﺨﻟس‬10% ‫ وﺤﯾق للﺒاﺋع اضاﻓﺔ ﻧﺴ ﺒﺔ‬.‫مقدم‬
right to request payments for the maintenance

every five (5) years and must be paid up front.
The Seller has the right to adjust the
maintenance fees however

The adjustment must not result an increase in ،‫ اذا ﻢﻟ ﯾقﻢ اﻤﻟﺸرتى بﺄداء اﻤﻟﺒالﻎ اﻤﻟذكورة عالﯿه وﻓقا للﺮﺸوط الﺴابقﺔ‬.3.3
the contribution exceeding ten percent (10%) as

3.3. If the Purchaser fails to make payments in
accordance with the above provisions, he shall
be liable to pay interest at a rate of 5% (Five ‫ اذا ما ﺟاوز التﺄخﺮﯿ ﻰﻓ ﺳداد أى من أقﺴاط مثن الﺮﺸاء مدة الﺴ تﺔ‬.4.3
percent) monthly on the outstanding amounts
until full settlement of the relevant amount due

at the date of next payment. ‫ ويف هذه اﺤﻟاﻟ‬.‫ﺣاﺟﺔ اىل اﺧطار أو انذار قضاﻲﺋ أو اﺳ تصدار ﺣﻢﻜ قضاﻲﺋ‬
‫ من مثن الﺮﺸاء ﻛتعوﯾﺾ اتفاﻲﻗ وﺠﯾوز للﺒاﺋع‬%30 ‫ﺤﯾق للﺒاﺋع مﺒلﻎ ﯾعادل‬
3.4. If the delay in the payment of any part of the
purchase price exceeds six (6) weeks, the Seller
‫ ﻛﺎﻤ‬.‫ﺤﺑﺴب اﻷﺣوال اﻻﺣﺘفاظ ﻬﺑذا اﻤﻟﺒلﻎ من اﻷقﺴاط اﻤﻟﺴددة ابلفعﻞ‬
shall have the right to terminate this Agreement, ‫ وذﻚﻟ‬,‫ﺤﯾتفﻆ الﺒاﺋع ﺤﺑقه ﻰﻓ أن ﯾطالب بتعوﯾضات اضاﻓيﺔ لﻬذه اﺤﻟاﻟ‬
without need for legal procedures, without ‫ﻛتعوﯾﺾ رضاﻲﺋ ومصارﯾﻒ ادارﯾﺔ مﺘفق علهيا بي الطرﻓي وﻏﺮﯿ خاضعﺔ‬
prejudice to the right of the Seller to dispose of ‫ و ﺗرد تﻚﻠ اﻤﻟﺒالﻎ يف خالل مدة زمﻨﯿﺔ مﺴاوﯾﺔ للﻤدة‬،‫لرقابﺔ القضاء‬
the Unit as it pleases and refunding the amounts ‫ و عﻰﻠ أن ﯾﻢﺘ رد‬،‫اليت قام الطرف الثاﻲﻧ ابلﺴداد خاللﻬا و بذات الكيفيﺔ‬
previously paid by the Second Party thereto
after deducting 30% (thirty percent) of the total
.‫تﻚﻠ اﻤﻟﺒالﻎ بعد القيام ببيع الوﺣدة للﻐﺮﯿ‬
Purchase Price as consensual compensation and
administrative expenses not subjected to judicial
supervision. The said refunding process shall
take place in a period of time equals to the
period of The Purchaser's settlements and using
the same method of payment. The Purchaser will
be refunded only after the housing unit is sold to
a new purchaser.
Article (4) Representations and ‫( اﻟﻀﻤﺎﻧﺎت واﻟﺘعﻬﺪات‬4) ‫اﻟﻤﺎدة‬
Warranties
4.1. The Seller hereby represents and warrants :‫ﯾضﻤن وﯾقر الﺒاﺋع أن‬.1.4
that: ‫أنه ماﻚﻟ القرﯾﺔ وﻪﻟ بذﻚﻟ اﺤﻟق ﻰﻓ بﻨاء وبﯿع والتﺮﺼف ﻰﻓ الوﺣدة؛‬
He is the owner of the Resort and, therefore,
Has the right to build, sell and dispose of the Unit ‫ﻻ ﯾوﺟد أى قيود عﻰﻠ اﻤﻟﺸرتى ﻰﻓ رشاء الوﺣدة و اﺠﯾارها للﻐﺮﯿ؛‬
There are no restrictions on the buyer on purchase ‫ﻤﺟﯿع الﺮﻀاﺋب والرﺳوم اﻤﻟتعلقﺔ ابلوﺣدة واﻷرض اﻤﻟقام علهيا الوﺣدة ﻢﺗ‬

All taxes and duties related to the Unit and
the land on which the Unit is built have been paid;
.‫و الوﺣدة خالﯿﺔ من أﯾﺔ ﺣقوق للﻐﺮﯿ‬
all necessary permits for the Unit have been
granted; and that The Unit is free of any rights of
any third party.

Article (5) Delivery ‫( اﻟﺘﺴﻠﯿﻢ‬5) ‫اﻟﻤﺎدة‬
5.1. The prospective date of delivery will be ‫ ويف ﺣاﻟ تﺄﺧر‬31/12/2024 ‫ ﯾكون اترخي ﺗﺴلمي الوﺣدة اﻤﻟتوقع يف‬.1.5
31/01/2024. In case of any delay in payment by the
Purchaser, the date of delivery shall be extended by
‫ ﯾﻢﺘ مد اترخي الﺘﺴلمي بذات مدة التﺄخﺮﯿ مبا ﻻ ﯾقﻞ عن‬،‫اﻤﻟﺸرتي يف ادلﻓع‬
the period of delay, but by not less than one (1) ‫) و ﯾتعي أن ﯾﻢﺘ اﺧطار اﻤﻟﺸرتي‬30/05/2025( (1( .‫شﻬر واﺣد‬

shall be notified to the Purchaser in writing.
5.2. Both parties have agreed that the Seller is ‫ اتفق الطرﻓان عﻰﻠ أن الطرف اﻷول عﻨد تﺄﺧره عن الﺘﺴلمي يف اﻤﻟوعد‬.2.5
obliged to pay a penalty in favor of the Purchaser in
‫( اذا ﻢﻟ ﯾقﻢ‬30/06/2025( ‫ أشﻬر‬6 ‫اﺤﻤﻟدد ﻬﺑذا العقد ﻪﻟ ﻓرتة ﺳﺎﻤح‬
the event the Seller has had a delay in handover in
excess of six months (30/06/2025) after the agreed ‫ ﺟ( ) ﻤﺧﺴﺎﻤﺋﺔ‬500) ‫بعدها ابلﺘﺴلمي ﯾلﺰﺘم ﺑﺴداد ﻏرامﺔ شﻬرﯾﺔ قدرها‬
handover date. The penalty is defined as (EGP 500) ‫ وﻰﻓ اﺠﻤﻟﻤﻞ ﻏرامﺔ التﺄخﺮﯿ ﻻ ﺗزﯾد‬,‫جﻨﯿه مﺮﺼي ﻻ ﻏﺮﯿ( اىل أن ﯾﻢﺘ الﺘﺴلمي‬
(Five Hundred Egyptian Pounds) monthly but not .‫ من مثن الوﺣدة‬%3 ‫عن‬
more than 3% of the Unit price.
5.3. The Seller shall not be liable to the Purchaser
for any failure to meet the delivery date caused by
any Act of God or Force Majeure, including but not ‫ ﻻ ﯾكون الﺒاﺋع مﺴ ﺌوﻻ ﺠﺗاه اﻤﻟﺸرتي عن عدم قدرته عﻰﻠ اﻻلﺰﺘام‬.3.5
limited to floods, storms, nature powers, strikes, ‫ مبا يﺸﻤﻞ عﻰﻠ ﺳبيﻞ‬-‫مبﯿعاد الﺘﺴلمي لﻈرف خارج عن ارادته أو قوة قاهرة‬
revolutions, political resolutions, national security .‫الثورات الفيضاﻧت و العواصﻒ و اﻹﺮﺿاابت و اﺤﻟروب‬-‫اﻤﻟثال ﻻ اﺤﻟﺮﺼ‬
regulations and acts of war.
5.4. The Seller reserves title to the Unit until full
settlement of the purchase price and the
maintenance deposit. .‫ ومﺒلﻎ الصﯿانﺔ‬.‫ وﺤﯾتفﻆ الﺒاﺋع مبلكيﺔ الوﺣدة ﺣت ﻤﺗام ﺳداد مثن الﺮﺸاء‬.4.5
5.5. If the Purchaser refuses to accept the Unit on
the date of delivery despite completion of the Unit
in accordance with the terms of this Agreement or ‫ يف ﺣاﻟ رﻓﺾ اﻤﻟﺸرتي قﺒول الوﺣدة يف اترخي الﺘﺴلمي عﻰﻠ الرﻢﻏ من‬.5.5
does not accept the Unit for a period of thirty (30)
days despite notification, the Purchaser shall be

5.6. The Purchaser may not prevent, hinder or
delay performance by the Seller of all remaining ‫ أو ﯾﺆﺧر اﻷعﺎﻤل اليت ﯾقوم ﻬﺑا الﺒاﺋع‬،‫ ﯾعوق‬،‫ ﻻ ﺠﯾوز للﻤﺸرتي أن ميﻨع‬.6.5
constructions and finishing in the Resort or any
renovation thereof. The Purchaser shall not be

5.7. In the event that the Seller fails to build the
sold Unit after 6 months have passed since the
‫الانهتاء اﻤﻟذكور أعالة ﻓيتعﻬد الﺒاﺋع بدﻓع اﻤﻟﺒالﻎ اﻤﻟدﻓوعﺔ من مثن رشاء الوﺣدة‬

refund the paid amount of the purchase price back

Article (6) Transfer of Title ‫( ﻧﻘﻞ اﻟﻤﻠﻜﯿﺔ‬6) ‫اﻟﻤﺎدة‬
6.1. The Purchaser shall bear the costs of the ‫ ﯾتﺤﻤﻞ اﻤﻟﺸرتي نفقات اجراءات ﺗﺴﺠﯿﻞ نقﻞ اﻤﻟلكيﺔ دلى مكﺘب‬.1.6
Registration procedures for the transfer of title at ‫ ﻛﺎﻤ ﯾلﺰﺘم اﻤﻟﺸرتي بدﻓع ﺎﻛﻓﺔ الﺮﻀاﺋب والرﺳوم‬،‫الﺸﻬر العقاري اﺨﻤﻟتﺺ‬
The competent Real Estate Registry Office and the
Purchase shall pay all taxes, fees and other Charges ‫والﻨفقات اﻷﺧرى اﻤﻟتعلقﺔ ابلوﺣدة اليت تفرضﻬا اجلﻬات اﺨﻤﻟتصﺔ عﻰﻠ الوﺣدة‬
levied by the authorities concerning the unit as per ‫ﺣﺴب هذا العقد وتصﺒﺢ التﻜلﯿﻒ مﺴ تﺤقﺔ ادلﻓع عﻨد ﺗﺴلمي الوﺣدة‬
this contract. These costs become payable on delivery ‫ ﯾتعﻬد الﺒاﺋع مبﻨﺢ اﻤﻟﺸرتى توكﯿﻞ رمسى عام‬.‫اﻤﻟذكورة‬
of the said unit. The seller undertakes to give the
buyer a general power of attorney

Article (7) Assignment of the Agreement ‫( اﻟﺘﻨﺎزل ﻋﻦ اﻟﻌﻘﺪ‬7) ‫اﻟﻤﺎدة‬


7.1. Until the payment of the full price, the ‫ ﺣت ﻤﺗام ﺳداد ﺎﻛمﻞ اﻟﻤﺜن ﻻ ﺠﯾوز للﻤﺸرتي التﻨازل عن الوﺣدة ﺤﻣﻞ‬.1.7
Purchaser may not assign, transfer, mortgage, ‫هذا التعاقد او أى جزء مﻬﻨا للﻐﺮﯿ أو نقﻞ ملكيهتا أو رهﻬﻨا أو تﺄﺟﺮﯿها أو‬
lease, sell or otherwise dispose of the Unit, the
subject of this Agreement or any part thereof and ‫بﯿعﻬا أو اجراء أى تﺮﺼف قانوىن أﺧر ﯾتعلق ﻬﺑا أو التﺮﺼف ﻰﻓ أى ﺣق‬
may not dispose of any of its rights under this ‫من ﺣقوقﺔ الثابتﺔ مبقﺘﻰﻀ هذا العقد للﻐﺮﯿ اﻻ بعد مواﻓقﺔ الﺒاﺋع ﻛتابﺔ عﻰﻠ‬
Agreement to a third party, unless after obtaining ‫ وﻰﻓ ﺣاﻟ التﻨازل عن الوﺣدة ﺤﻣﻞ هذا التعاقد او أى جزء مﻬﻨا للﻐﺮﯿ أو‬.‫ذﻚﻟ‬
the written consent of the Seller. In case of the
assignment or transfer of the Unit, the subject of
‫نقﻞ ملكيهتا بعد ﻤﺗام ﺎﻛمﻞ اﻟﻤﺜن وقﺒﻞ ﺗﺴﺠﯿﻞ الوﺣدة دلى الﺸﻬر العقارى‬
this Agreement or any part thereof to a third ‫ من اجﺎﻤىل مثن الوﺣدة اﻤﻟﺒاعﺔ ﻤﻛﺮﺼوﻓات‬%5 ‫يﺴ تﺤق الﺒاﺋع مﺒلﻎ وقدره‬
party after the payment of the full price and .‫ادارﯾﺔ‬
before the registration of the Unit with the Real
Estate Department; the Seller shall be entitled to
(5%) of the total price of the sold Unit, in terms of
administrative expenses.
Article (8) Modifications in the Construction of ‫( اﻟﺘﻌﺪﯾﻼت ﻓﻲ أﻋﻤﺎل ﺑﻨﺎء اﻟﻮﺣﺪة‬8) ‫اﻟﻤﺎدة‬
the Unit and Changes in the Unit ‫واﻟﺘعﺪﯾﻼت ﺑﺎﻟﻮﺣﺪة‬
8.1 The Purchaser may, within 60 (sixty) days ‫ ﺠﯾوز للﻤﺸرتي اﺧطار الﺒاﺋع ﻛتابﺔ بﺄى تعدﯾالت ﯾرﻏب يف ادخالﻬا‬.1.8
from the date of the execution of this Agreement, ‫ وعﻰﻠ‬.‫عﻰﻠ الوﺣدة يف خالل ﺳ تون ﯾوماً من اترخي توقيع هذا العقد‬
notify the Seller in writing of any modifications he
wishes to make to the Unit. The Seller shall ‫الﺒاﺋع أن ﯾقوم يف خالل أﺳ ﺒوعي من اترخي اﻹﺧطار بﺈعداد مقايﺴﺔ‬
prepare an estimate for the cost of such ‫ وﻰﻓ ﺣاﻟ‬.‫بتﻠﻜفﺔ هذه التعدﯾالت ومﻨﺢ اﻤﻟﺸرتي أﺳ ﺒوع ﻬﻣﺔﻠ للرد‬
modification within two weeks following the ‫مواﻓقﺔ الﺒاﺋع عﻰﻠ التعدﯾالت ﻰﻓ خالل أﺳ ﺒوع من اترخي اﺳ تالم رد‬
Purchaser’s notification and shall then grant the
Purchaser a period of one week to respond to the
‫ ﯾلﺰﺘم الﺒاﺋع بﺈجراء هذه التعدﯾالت عﻰﻠ نفقﺔ‬،‫اﻤﻟﺸرتى عﻰﻠ اﻤﻟقايﺴﺔ‬
same. If the Seller approves such modifications ‫ ويف ﺣاﻟ عدم قيام اﻤﻟﺸرتي‬،‫اﻤﻟﺸرتي ﻃﺒقا للﻤواصفات اليت ﺤﯾددها‬
within one week of receipt of the Purchaser’s ‫ ﯾﻢﺘ ﺗﺸطﯿب الوﺣدة ﺣﺴب‬،‫ابلرد عﻰﻠ العرض يف خالل أﺳ ﺒوع‬
response to the estimate, the Seller shall carry out
the modifications at the Purchaser’s cost and in
‫اﻻتفاق اﻷوﻟ دون أن ﯾكون للﻤﺸرتي اﺤﻟق يف ﻃلب أﯾﺔ تعدﯾالت‬
accordance with his specifications. In case the .‫أﺧرى يف أعﺎﻤل الﺒﻨاء اخلاصﺔ ابلوﺣدة من الﺒاﺋع‬
Purchaser does not respond to the offer within
one week, the Unit shall be completed as initially
agreed and the Purchaser shall have no right to
claim any further modifications in the
construction of the Unit from the Seller.

8.2. After expiry of the period set out in Article
8.1, in particular after delivery of the Unit, the

or other construction work on the Unit, except .‫أﺧري ابلوﺣدة اﻻ مبوجب اتفاق ﻛتاﻲﺑ مﺴ ﺒق مع الﺒاﺋع‬
with prior written agreement with the Seller.

Article (9) Defects Warranty ‫( ﺿﻤﺎﻧﺎت اﻟﻌﯿﻮب‬9) ‫اﻟﻤﺎدة‬


9.1. The Seller hereby undertakes to execute the ‫ تعﻬد الﺒاﺋع بﺘﻨفيذ الوﺣدة ﺤﻣﻞ التعاقد ﺣﺴب اﻷصول الفﻨﯿﺔ‬.1.9
Unit, the subject of the Agreement, as per the .‫والﻬﻨدﺳ ﯿﺔ اﻤﻟتعارف علهيا ووﻓقا للتصﻤﺎﻤﯿت والرﺳومات اﻤﻟرﻓقﺔ‬
recognized technical and engineering principles
and in accordance with the annexed designs and
drawings. ‫ ﯾضﻤن الﺒاﺋع خلو الوﺣدة اﻤﻟﺒﯿعﺔ من العﯿوب اليت هتدد مﺘانﺔ و‬.2.9
‫ و ﯾضﻤن اﺗﺴاق الﺒﻨاء مع اﻤﻟعاﯾﺮﯿ الفﻨﯿﺔ و اﻤﻟعﺎﻤرﯾﺔ‬،‫ﺳالمﺔ الﺒﻨاء‬
9.2. The Seller hereby warrants that the sold
Unit, the subject of the Agreement, is free from
‫اﻤﻟتفق علهيا وذﻚﻟ خالل اﻤﻟدة اﺤﻤﻟددة ﻰﻓ القانون اﻤﻟدىن اﻤﻟﺮﺼى‬
all the technical defects that threaten the ، 651 ‫رمق‬
durability of construction or fortify the security ‫وبﻨاء علﯿه ﯾعد هذا الﺒﻨد مبثابﺔ ضﺎﻤن ﻤﻟدة عﺮﺸة أعوام ميﻨﺤه الﺒاﺋع‬
and safety conditions within the Periods
specified in the Article No. 651 of the Egyptian
‫للﻤﺸرتي عن اخلرﺳاﻧت و أﺳاﺳات‬
Civil Law. Consequently this article is deemed as .‫الﺒﻨاء‬
a warranty for ten (10) years, granted by the
Seller to the Purchaser on concrete works and
foundations.

Article (10) Maintenance & Use of the ‫( اﻹدارة واﻻﻧﺘﻔﺎع ﺑﺎﻟقﺮﯾﺔ‬10) ‫اﻟﻤﺎدة‬
Resort
10.1. The Purchaser undertakes to comply with ‫ ﯾقر اﻤﻟﺸرتى ابﻻلﺰﺘام بتعلﺎﻤﯿت الﺮﺸﻛﺔ) الﺒاﺋع( ابعتﺒارها‬.1.10
and abide by all regulations and instructions set ‫اﻤﻟاﻚﻟ ﻤﺠﻟﯿع اخلدمات واﻤﻟﻨاﻃق الرتﻓهيﯿﺔ واﻤﻟراﻓق العامﺔ وبصفهتا‬
by The Seller or by the Management Company
appointed thereof. The Purchaser or whoever
‫ وﯾكون لﻬا ﻤﺟﯿع الﺴلطات‬، ‫اﻤﻟﺴ ﺌوﻟ عن ادارة القرﯾﺔ‬
may represent him/her in the enjoyment of the ‫ابﻹضاﻓﺔ ﺤﻟق اﺨﺗاذ أﯾﺔ قرارات لصاﺢﻟ اﻤﻟﺮﺸوع من‬،‫والصالﺣيات‬
housing unit shall indemnify the Seller for any ‫ مﺒارشة أو‬،(‫ وعلﯿه تلﺰﺘم الﺮﺸﻛﺔ)الﺒاﺋع‬،‫الﻨاﺣيﺔ التﻨﻈﻤﯿﯿﺔ أو اﻤﺠﻟالﯿﺔ‬
harms or losses to such services. The Seller,
being the sole owner of the entire set of services,
‫من خالل رشﻛﺔ مﺘعاقد معﻬا أو عن ﻃرﯾق اﺳ ﻨاد أعﺎﻤل اﻹدارة أو‬

is solely responsible for managing the Resort, ‫ وﯾقر اﻤﻟﺸرتي بعلﻤه من أﻻن مبلكيﺔ الﺒاﺋع ﺤﻟق‬،2008 ‫ لﺴ ﻨﺔ‬119
utilizing all possible authorities, and it thereby .‫اﻹدارة ﺎﻛمال دون مﻨازع ﻷي من اﻤﻟﺸرتﯾن ﻪﻟ يف ذﻚﻟ‬
preserves the right to take any decisions in favor
of the Resort regarding its organizational or
architectural structures. Subsequently the Seller
is responsible for the aforementioned either
directly, or indirectly via another management
company which may be in charge entirely or
partly for the management operations,

In accordance with the stipulations of law number 119
of 2008. The Purchaser hereby acknowledges the Seller
being the sole holder of the right to administer the
Resort undisputedly. ‫ عﻰﻠ اﻤﻟﺸرتى أن ﯾتﺤﻤﻞ ﻤﺟﯿع اﻤﻟصارﯾﻒ اﻤﻟتعلقﺔ ابﺳ هتالك‬2.10.
10.2. The Purchaser shall bear all costs for electricity ‫ وتنﺸﺄ هذه اﻤﻟصارﯾﻒ من‬.‫الكﻬرابء واﻤﻟﯿاه اخلاصﺔ ابلوﺣدة‬
And water consumption relating to the Unit. The costs ‫الاﺳ تﺨدام الﺸﺨﺼ اﺬﻟي ﺤﯾﺴ ﺒه العداد اخلاص ابلوﺣدة و ﯾتعﻬد‬
shall be based on the individual consumption, which ‫ من‬،‫اﻤﻟﺸرتى برتكﯿب عّدادات اﻤﻟﯿاه و الكﻬرابء عﻰﻠ نفقﺘه اخلاصﺔ‬
Shall be measured by meters attributable to the Unit.
The Purchasers hereby pledges to install Water and ‫ و‬،‫خالل الﺒاﺋع وﻓقا لﺴعر اﻤﻟقايﺴه الت ﺳوف ﯾﻢﺘ اجراهئا للﻤﺮﺸوع‬
electricity meters at its own expense via the Seller. ‫يف ﺣاﻟ امﺘﻨاع اﻤﻟﺸرتي عن ﺗركﯿب ال ّعدادات ﯾلﺰﺘم ابﻻنصﯿاع للتقدﯾر‬
In the event the Purchaser refrains from installing the ‫ الﺒاﺋع ﯾكون مﺴﺆوﻻ‬. ‫اجلزايف للقمي الاﺳ هتالكﯿﺔ اﺬﻟي ﯾتقدم به الﺒاﺋع‬
foregoing meters, then it is legally obliged to adhere to
The approximate estimation of consumptions run by the
.‫عن ﺗﻜلﯿﻒ توصﯿالت اﻤﻟﯿاة والكﻬرابء الرﺋﯿﺴ ﯿﺔ للﻤﻨتﺠع‬
Seller.
The seller is responsible for the costs of connecting the
resort to the main water and electricity connections
‫ ﻻ ﺠﯾوز للﻤﺸرتي القيام بﺄﯾﺔ تعدﯾالت خارجيﺔ‬.3.10
‫للوﺣدة ﺤﻣﻞ التعاقد بدون اﺤﻟصول عﻰﻠ مواﻓقﺔ ﻛتابﯿﺔ‬
10.3. The Purchaser may not, without obtaining the .‫مﺴ ﺒقﺔ بذﻚﻟ من الﺒاﺋع‬
Seller's consent thereto in writing, introduce any
external alterations to or changes in the housing unit.
- ‫ ﺣت بعد ﺗﺴلمي وانتقال ملكيﺔ الوﺣدة‬- ‫ ﯾلﺰﺘم اﻤﻟﺸرتي‬.4.10
10.4. The Purchaser shall, even after delivery of the ‫بﺈتﺒاع اللواﺢﺋ والتعلﺎﻤﯿت اﻤﻟتعلقﺔ ابﺳ تﺨدام مراﻓق القرﯾﺔ واليت ﯾضعﻬا‬
Unit, comply with all regulations and instructions ‫ وﯾكون للﻤﺸرتي اﺤﻟق يف‬.‫الﺒاﺋع أو الﺮﺸﻛﺔ القاﻤﺋﺔ عﻰﻠ اﻹدارة‬
related to the use of the
Resort’s facilities laid down by the Seller or the ‫ وعﻰﻠ‬،‫اﻻنتفاع ابلوﺣدة بطرﯾقﺔ ﻻ ﺗزﺞﻋ أو تﺮﻀ ابلﻐﺮﯿ‬
management company; he shall utilize the Unit in a :‫اﻷﺧﺺ‬
manner which does not disturb or harm third parties ‫ عدم قطع أو اتالف اﻷﺠﺷار بﻐﺾ الﻨﻈر عن ﺠﺣﻤﻬا أو نوعﻬا ﻷى‬.1
and, in particular:
1.The Purchaser shall not cut or damage trees,
‫ﺳبب ﺎﻛن مت ﺎﻛنت قد ﻢﺗ ﻏرﺳﻬا عﻰﻠ ﺟانﻰﺒ الطرقات أو اﻤﻟﻤرات‬

2.The Purchaser of a unit located in the upper floor ‫ﺨﺑالف اﻤﻟوﺤﺿﺔ ابلرﺳومات الﻬﻨدﺳ ﯿﺔ اخلاصﺔ ﻬﺑا ﻛﺎﻤ ﻻ ﺠﯾوز ﻤﻟﺸرتى‬

equipment or vehicles causing noise or nuisance ‫أو ﺗﺴبب ازعاﺟا ﻤﻟالك الوﺣدات الﺴكﻨﯿﺔ اﺠﻤﻟاورة أو تعرض‬

fixed or movable installations, or generally ‫بعد اﺤﻟصول عﻰﻠ مواﻓقﺔ ﻛتابﯿﺔ مﺴ ﺒقﺔ من الﺒاﺋع أو خلفﺔ اخلاص‬
carrying out any constructions outside the Unit, .‫أو العام‬
unless after obtaining the prior written consent
of the Seller or its designated/non-designated

10. The Purchaser shall not install an individual ,‫ﺣفاﻇا عﻰﻠ اﻤﻟﻈﻬر اﻤﺠﻟاىل‬
satellite dish at the roof of the Resort.

any of the obligations mentioned above in this ‫اﻟهيا عالﯿه ﻰﻓ هذه اﻤﻟادة ﺤﯾق للﺒاﺋع عدم امداد الوﺣدة اﻤﻟﺒاعﺔ‬
article; the Seller shall be entitled not to supply
the sold Unit with utility services (in accordance ‫ﺨﺑدمات اﻤﻟراﻓق) ﻃﺒقا للقواني الﺴارﯾﺔ( اىل أن ﯾﻢﺘ ازاﻟ اﺨﻤﻟالفﺔ‬
with applicable laws) until the removal of the ‫أصال ﻓضال عن اعادة اﺤﻟال اىل مﺎﺎﻛن علﯿﺔ وذﻚﻟ عﻰﻠ نفقﺔ‬
violation and reinstatement at the expense of the .‫اﻤﻟﺸرتي اخلاصﺔ‬

Article (11) Right of Preemption ‫( ﺣﻖ اﻟﺸﻔعﺔ‬11) ‫اﻟﻤﺎدة‬

the other units of the Resort, and such waiver

Article (12) Addresses ‫( اﻟﻤﻮﻃﻦ اﻟﻤﺨﺘﺎر‬12) ‫اﻟﻤﺎدة‬


12.1. Each Party to this Agreement hereby ‫ ﯾقر ك من ﻃرﻰﻓ هذا العقد بصﺤﺔ العﻨاوﯾن الواردة بصدر‬.1.12

that such address is its domicile of choice.

12.2. The Party who changes its address shall ‫ ﯾلﺰﺘم الطرف اﺬﻟى ﯾقوم بتﻐﯿﺮﯿ عﻨوانه بﺈﺧطار الطرف‬.2.12
notify the other party with such change by a
letter with acknowledgment of receipt;

13.2. Any dispute that arises between the Parties

invalid, illegal or unenforceable, the validity, ‫شﻞﻜ من اﻷشﻜل ﺤﺻﺔ أو قانونﯿﺔ أو قابلﯿﺔ الﺒﻨود اﻤﻟتﺒقيﺔ من هذا‬
legality and enforceability of the remaining

sufficient notice of the disruption shall be issued to

The following regulations are established to ensure ،‫هتدف التعلﺎﻤﯿت التالﯿﺔ للﺤفاظ عﻰﻠ اﻷمن و مﺴ توى الراﺣﺔ ابﻤﻟﻨتﺠع‬
comfort and safety. The Purchaser shall not violate :‫و علﯿه ﯾلﺰﺘم الﺴادة ﺳﻜن اﻤﻟﻨتﺠع ابلتعلﺎﻤﯿت اﻵتﯿﺔ‬

1. I n case of utilizing the service of an independent


‫ ﯾنﺒﻐي ابالغ‬،‫ يف ﺣاﻟ اﺳ تﺨدام مقاول خارﻲﺟ لتﻨفيذ أي ﻤﻋﻞ ابﻤﻟﻨتﺠع‬.1

documents and verify their legality.

3. Swimsuits are the only accepted form of clothes to ‫ و‬،‫ ﻻ ﺠﯾوز نزول ﺣﺎﻤمات الﺴ ﺒاﺣﺔ بﻐﺮﯿ لﺒاس اﻻﺳ تﺤﺎﻤم اﻤﻟعد ﺬﻟﻚﻟ‬.3
use the swimming pools. It is prohibited to swim in ‫ ﻛﺎﻤ‬،‫علﯿه ﻻ ﺠﯾوز نزول ﺣﺎﻤمات الﺴ ﺒاﺣﺔ بﺄﯾﺔ مالﺑس أﺧرى ﻏﺮﯿ اﻤﻟاﯾوه‬
any other clothes, and for the ladies it is prohibited
to swim or sunbathe with the upper part of the body
‫ميتﻨع اﻃالقا عﻰﻠ الﺴ ﯿدات نزول ﺣﺎﻤمات الﺴ ﺒاﺣﺔ أو أخذ ﺣﺎﻤمات ﻤﺷس‬
uncovered. Permitted swimsuits are bikinis, one ،‫ﺠﺑانﻬﺒا بدون اجلزء العلوي من لﺒاس اﻻﺳ تﺤﺎﻤم اﺬﻟي ﯾﻐطي مﻨطقﺔ الصدر‬
piece swimsuits, or anything similar that would ‫ و أي لﺒاس ﺤﺑر ﯾﻐطي‬،‫و يﺴﻤﺢ ابلﺒﯿكيﻲﻨ و اﻤﻟاﯾوه القطعﺔ الواﺣدة‬
cover private parts.

4. Children younger than 12 years of age are not

5. Dogs & snakes and wild animals are not allowed ‫ الﻜب والثعابي واﺤﻟﯿواﻧت اﻤﻟفرتﺳﺔ ﻏﺮﯿ مﺴﻤوح‬.5
inside the resort ‫بدﺧولﻬا ﻰﻓ اﻤﻟﻨتﺠع‬

6. Property owners shall provide the administration ‫ ﯾلﺰﺘم الﺴادة مالكو الﺸقق بتقدﻢﯾ صورة ضوﺋﯿﺔ من هوﯾت‬.6
with photocopies of their tenants’ IDs, a passport ‫ و صورة جواز ﺳفر ﻟﻞﻜ مﺴ تﺄجر بﻐرض اصدار ﺎﻛرنﯿه ﻟﻞﻜ‬،‫اﻤﻟﺴ تﺄجرﯾن‬
sized photograph for each tenant, in order to issue a
pass card for each. It is mandatory to notify the
‫ ﻛﺎﻤ ﯾلﺰﺘم الﺴادة اﻤﻟالك و‬،‫ و اﺧطار اﻹدارة مﺴ ﺒقا مبدة اﻹﺠﯾار‬،‫مﻬﻨﻢ‬
administration with the period of lease. Owners and ‫ و ﯾقوم‬،‫الﺴادة اﻤﻟﺴ تﺄجرون عﻰﻠ ﺣد ﺳواء بﺈﺧطار ادارة اﻷمن بﺄي زوار‬
Tenants shall notify the security department with ‫الزوار بتوقيع اقرار الزﯾرة دلى بوابﺔ الامن اخلارجيﺔ‬
any visitors, and visitors shall sign the visiting form
by the external security gate.
‫ ﻻ ﺠﯾوز وضع أﻃﺒاق اﺳ تقﺒال قﻨوات ﻓضاﺋﯿﺔ مبﺒاﻲﻧ‬.7
7. It is completely prohibited to install satellite ‫ و ذﻚﻟ ﺣفاﻇا عﻰﻠ اﻤﻟﻈﻬر العام‬،‫اﻤﻟﻨتﺠع عﻰﻠ اﻹﻃالق‬
dishes in / on any of the complex’s premises, in .‫للﻤﺮﺸوع‬
order to maintain the general appearance of the
resort.
‫ ﯾلﺰﺘم الﺴادة الﺴﻜن ابﺤﻤﻟاﻓﻈﺔ عﻰﻠ اﻤﻟﻤتﻠﻜت العامﺔ للﻤﻨتﺠع و‬.8
8. Residents are responsible to preserve the .‫اﺳ تﻐاللﻬا عﻰﻠ الﻨﺤو اﺬﻟي أعدت ﻪﻟ‬
communal belongings of the resort, and to use it
only for the purpose it was made for.
‫ عﻰﻠ الﺴادة الﺴﻜن عدم اﺳ تﺨدام وﺳاﺋﻞ مسعﯿﺔ عالﯿﺔ الصوت من‬.9
9. Residents are not allowed to use audio devices .‫ ﯾرﻰﺟ اﺤﻤﻟاﻓﻈﺔ عﻰﻠ الﻬدوء ابﻤﻟﻨتﺠع‬،‫شﺄﻬﻧا تعكﺮﯿ صفو الﺴﻜن اﻵﺧرﯾن‬
in a manner / volume that would disturb other
residents. General quietness in the resort is much
appreciated.
‫ ﯾلﺰﺘم الﺴادة الﺴﻜن‬،‫ ﺣيﺚ أن اﻤﻟوقع ﻻﯾزال به أعﺎﻤل اﻧﺸاﺋﯿﺔ‬.10
10. Whereas construction operations still take ‫ و ﯾتﺤﻤلون اﻤﻟﺴ ﺌولﯿﺔ‬،‫ابﺤﻤﻟاﻓﻈﺔ عﻰﻠ ﺳالمﺔ أﻃفاﻬﻟﻢ من اﻷعﺎﻤل اﻹﻧﺸاﺋﯿﺔ‬
place in the resort, parents are obliged to keep
their children safe from building operations, and
.‫ﺎﻛمﺔﻠ عن ذﻚﻟ‬
are solely responsible for their children’s safety.

11. In the event a resident, on the background of ‫ مبﻨاﺳ ﺒﺔ ﻤﻣارﺳ ته لﺸ ﺌونه داخﻞ‬،‫ اذا ﺗﺴبب أﺣد الﺴادة الﺴﻜن‬.11
practicing daily life issues, has caused damage to a ‫ عﻰﻠ‬،‫ ﯾكون مﺴ ﺌوﻻ عن ذﻚﻟ‬،‫ يف اﺣداث أﺮﺿار لﺴاكن أﺧر‬،‫الﺸقﺔ‬
neighbor’s building safety, the said resident will be
held responsible for tort and compensation. ‫ ﺗرك اﻤﻟﯿاه مفﺘوﺣﺔ ﻤﻣا ﯾﺆدي لﺘﺮﺴﯾب يف ﺳقﻒ اجلار‬:‫ﺳبيﻞ اﻤﻟثال‬
Example: Forgetting the water open, then it leaks .‫اﻷﺳفﻞ‬
through the ground penetrating it damaging the
ceiling of the neighbor below.

12. Taxi drivers are not allowed inside apartments ‫ ميتﻨع عﻰﻠ ﺳاﺋقي ﺳ ﯿارات اﻷجرة دﺧول أي شقﺔ ابﻤﻟﻨتﺠع اﻻ مبراﻓقﺔ‬.12
without companionship of security personnel. .‫أﺣد موﻇفي اﻷمن‬

13. Residents are not allowed to plant any species ‫ ميتﻨع عﻰﻠ الﺴادة الﺴﻜن زراعﺔ أي نﺒااتت ضارة ﺳواء ابلصﺤﺔ و‬.13
of plants that can be harmful either for health and ‫ ﻛﺎﻤ ميتﻨع علهيﻢ ﺑﺸﻞﻜ عام زراعﺔ نﺒااتت‬،‫الﺴالمﺔ أو ابﻤﻟﻈﻬر العام للﻤﻨتﺠع‬
safety, or for the general appearance. Residents, as ‫ﻏﺮﯿ ﻤﻣاثﺔﻠ لﻸنواع اﺨﻤﻟصصﺔ للﻤﻨتﺠع بدون اﺤﻟصول عﻰﻠ مواﻓقﺔ ﻛتابﯿﺔ‬
a general rule, are not allowed to grow any species
of plants different than these approved by the .‫مﺴ ﺒقﺔ من اﻹدارة‬
Resort without having obtained a written approval
from the management beforehand.

14. It is not permissible to practice in the Unit any ‫ ﻻ يﺴﻤﺢ داخﻞ الوﺣدة بﺄﯾﺔ أﻧﺸطﺔ ميكن أن ﺗﺴبب ﺧطرا عﻰﻠ‬.14
activities which may endanger lives or .‫اﻷرواح أو اﻤﻟنﺸﺂت ابﻤﻟﻨتﺠع‬
constructions in The Resort.

15. It is not permissible to get communal sun beds ‫ ﻻ يﺴﻤﺢ بﺈدخال أﺳ ّرة ﺣﺎﻤمات الﺸﻤس أو اﻤﻟفروشات العامﺔ‬.15
or any communal furniture inside the Unit. .‫ابﻤﻟﻨتﺠع داخﻞ الوﺣدة‬

16. Purchaser is obliged to settle the values of ‫ ﯾلﺰﺘم الﺴادة اﻤﻟ ًّالك ﺑﺴداد القمي اﻻﺳ هتالكﯿﺔ للﻤﯿاه و الكﻬرابء‬.16
water and electricity consumptions within 15 days
of settlement due dates, according to the meters' ‫ و ﯾتعﻬد‬،‫ ﯾوما من مواعﯿد اﺳ تﺤقاقﻬا ﻃﺒقا لقراءات الع ًّدادات‬15 ‫خالل‬
readings. ‫ من خالل‬،‫اﻤﻟﺸرتى برتكﯿب ع ًّدادات اﻤﻟﯿاه و الكﻬرابء عﻰﻠ نفقﺘه اخلاصﺔ‬
‫ و يف ﺣاﻟ امﺘﻨاع اﻤﻟﺸرتي عن ﺗركﯿب الع ًّدادات ﯾلﺰﺘم‬،"‫"الﺒاﺋع‬

17. Purchaser is obliged to ensure safety of water ‫ ﯾلﺰﺘم اﻤﻟﺸرتى ابﺤﻟفاظ عﻰﻠ أمن ﺤﻣاﺑس اﻤﻟﯿاه و الكﻬرابء الرﺋﯿﺴ ﯿﺔ‬.17
and electricity main sources in the Unit. Thus the
Purchaser must ensure switching them off upon ‫ و علﯿه ﯾلﺰﺘم اﻤﻟﺸرتى بﺈﻏالق اﺤﻤﻟاﺑس ﺳالفﺔ اﺬﻟكر ﺣال مﻐادرة‬،‫ابلوﺣدة‬
leaving the Unit for long periods. .‫الوﺣدة لفرتة ﻃوﯾﺔﻠ‬

18. Residents shall not put clothes, rugs, or any ‫عﻰﻠ الﺴادة الﺴﻜن عدم القيام بنﺮﺸ مالﺑس أو ﺠﺳاجيد أو أﯾﺔ‬.18
other belongings on the balconies' fences, and it is ‫ و ﻛذﻚﻟ عدم ﺗركﯿب مﻨارش ﺎﺛبتﺔ‬،‫مﺘعلقات أﺧرى عﻰﻠ أﺳوار الﺒلكوﻧت‬
strictly prohibited to install fixed dryers in the
balconies' fences. It is permitted to only have .‫ و يﺴﻤﺢ ﻓقﻂ ابﻤﻟﻨارش اﻤﻟتﺤرﻛﺔ داخﻞ الﺒلكوﻧت‬،‫خارج الﺒلكوﻧت‬
mobile dryers inside balconies.

19. For the purposes of safety and security of The


‫ يﺸرتط تواﺟد أﺣد أﻓراد اﻷمن‬،‫ ﻷمن و ﺳالمﺔ ﺳﻜن اﻤﻟﻨتﺠع‬.19
Resort's residents, it is mandatory that a security ‫ ﺳواء للوﺣدات‬،‫ابﻤﻟﻨتﺠع مع مﻨدوﻲﺑ توصﯿﻞ الطلﺒات أثﻨاء ﻤﻋلﯿﺔ التوصﯿﻞ‬
employee shall accompany delivery personnel to ‫ و يﺮﺴي اﻷمر ذاته عﻰﻠ‬،‫الﺴكﻨﯿﺔ أو ﻷي مﻜن أﺧر بداخﻞ اﻤﻟﻨتﺠع‬
residential units or any other location within The .‫ﺳاﺋقي ﺳ ﯿارات اﻷجرة‬
Resort during the delivery process. Same condition
applies to cab drivers.

20. It is not permissible to leave The Unit's key ‫ ﻻ يﺴﻤﺢ برتك مفﺘاح الوﺣدة مع أي من موﻇفي اﻷمن أو موﻇفي‬.20
with any of the security staff, or any of The
Resort's employees generally. It is permissible ‫ و يﺴﻤﺢ ﻓقﻂ يف ﺣاﻟ الﺮﻀورة برتك مفاتﯿﺢ الوﺣدات دلى‬،‫القرﯾﺔ عامﺔ‬
though in emergency cases to leave units' keys ‫ وذﻚﻟ عﻰﻠ مﺴ ﺌولﯿﺔ ماﻚﻟ‬، (‫رشﻛﺔ اﻹدارة أو ﻤﻣثﻞ الﺮﺸﻛﺔ اﻤﻟالكﺔ) الﺒاﺋع‬
with the administration company or with the .‫ بدون أﯾﺔ مﺴ ﺌولﯿﺔ عﻰﻠ الﺮﺸﻛﺔ اﻤﻟالكﺔ‬،‫الوﺣدة الﺸﺨصﯿﺔ‬
owner's (Seller’s) representative, on the unit's
owner's responsibility, and without any form of
liability on The Company.

21. In the event the Unit let via a representative, a
written authorization signed by the Purchaser
