AFFIDAVIT

I, BUENA TAGAYON IBANEZ SR., of legal age, Filipino, and a

resident of Barangay 39, Sector III, Calvary Hill, Tacloban City, Leyte, after
having been duly sworn to in accordance with law, depose and state that:

1. Our house is located about 15 to 20 meters away from the LMWD

pumping station located at Utap Hill, Brgy. 39, Tacloban City;

2. Sometime in September 2022, at around 3 p.m., I woke up from my

nap due to a loud banging noise. Immediately after, I peeked through
the broken window of the LMWD pumping station located at Utap Hill,
Brgy. 39, Tacloban City. Thereafter, I saw people from our area, Alex
Abad, Romeo Abogado Jr., and Daniel Cuesta breaking the pipeline
located at the said LMWD pumping station, by hammering it using a
sledgehammer. After a while, Laurence Dagami and Daniel Cuesta
arrived. The five of them took turns in hammering the said pipeline. I
personally know these people because we live in the same barangay;

nga lima pagmaso han pipeline. Personal ako nga nakilala hini nga
mga tawo tungod nga mag usa man la kami hin barangay.)

3. Each time a chunk or portion of the said pipeline came off, they put
the same inside a sack;

(Kada mayda natatanggal nga parte han ira guinmamaso, ira liwat
guinsusulod ha sako.)
 4. The following day, at around 8 a.m due to the consistent loud noise, I
again went out of my house to check and saw the same group of
people, taking turns in hammering the said pipeline and putting
chunks of them inside a sack. After which, I fell asleep and woke up
at 1 p.m. There was no longer any noise, so I did not bother to check
again.

5. At around 3 p.m. of the same day, I saw them pass by the front of my
house carrying the bronze as well as the interior of the pump.
