Required retainer of $ 50% of session fee

1. A Retainer Fee of 50% of session fee is due within 14 days from the day of the Photo Shoot to secure the date and
photographer discussed. This contract must be signed, dated and returned the retainer fee paid via paypal emailed invoice
from Lysaker Photography. ALL RETAINER FEES are NONREFUNDABLE in the event the client breaches this
agreement.

2. Balance is due the day of the Photo Shoot payable to Lysaker Photography.

3. All delays to the Photo Session due to Client being late will result in possible cancellation of the Photo Session by
Lysaker Photography without refund of the deposit.

4. Lysaker Photography agrees to provide photographic services for Client as described in the “Services Provided”
listed above in exchange for the agreed upon fee.

5. Client is liable for any damage to any equipment used at the Photo Shoot resulting from vandalizing or negligence
action by the Client and/or any of the persons attending or participating in the Photo Shoot.

6. Lysaker Photography will make an effort to accommodate Client’s requests before and/or during the
Photo Shoot, but shall not be held responsible for poor image quality due to portrait subject’s behavior,
lack of available light, weather conditions, or other conditions beyond the photographer’s control.
Lysaker Photography is not responsible for the client’s choice in lab for printing images and is not
responsible for image quality produced by said lab.

7. client grants Lysaker Photography the right to take photographs of client and his/her
family (children,...). client authorizes Lysaker Photography to edit, copy, exhibit, publish and distribute photos for
any lawful purpose. client grants Lysaker Photography permission to use photos in any publication, including
websites without payment or other consideration.
All photos are property of Lysaker Photography.

8. If cancellation is initiated by Lysaker Photography and Lysaker Photography cannot provide a replacement
acceptable to client in accordance with paragraph 10 of this agreement, Lysaker Photography shall refund all fees
and retainer paid.

9. cancellation Policy: If contract is terminated by the client before date of event, client must provide in writing the
reason for cancellation. If Lysaker Photography is canceled within 5 days of event date, client agrees to pay 50% of
the total contracted rate. If the client terminates Lysaker Photography's services the day of the Photo Shoot, the
client agrees to pay Lysaker Photography the total contracted amount.

10. This agreement of Lysaker Photography to perform shall be excused by detention of her by sickness, personal
tragedy, accidents, riots, strikes, epidemics, acts of God, or any other legitimate condition beyond Lysaker
Photography control. If such circumstances arise, all reasonable efforts will be made by Lysaker Photography to
find a comparable replacement photographer acceptable to client with a 3rd party affiliate at the agreed upon fees.
Should Lysaker Photography be unable to procure a replacement acceptable to the client, client shall receive a full
refund of all fees and retainer paid to Lysaker Photography. Purchaser agrees that in all circumstances, Lysaker
Photography liability shall be exclusively limited to refunding all the fees and retainer paid and that Lysaker
Photography shall not be liable for indirect or consequential damages arising from any breach of contract.

Note:
Family members and guests not participating in the photo shoot are generally not recommended to attend the session
as they are a distraction to everyone, especially children. Of course you are welcome to bring a “helper”
if you find it necessary.
