Trust Deed

Shri Mamakarishi Agasthyar Charitable Trust

This deed of Trust is executed on this 06.01.2023 On the sixth day of


January two thousand and twenty-three between 1.Thiru.M.Somasundaram
(Adhaar Card No.5976 7672 6856) (Cell No.7598004561), aged about 42 years
son of Thiru.Manika Asari residing at No.7/21-2, Nesavalar Colony,
Thirupathisaram Post, Thirupathisaram Village, Thovalai Taluk, Kaniyakumari
District, 2.Thiru.R.Ganesan (Adhaar Card No.2170 2477 9538) (Cell
No.8870611899), aged about 79 years son of Thiru.Ramasamy residing at
No.7/21-2, Nesavalar Colony, Thirupathisaram Post, Thirupathisaram Village,
Thovalai Taluk, Kaniyakumari District and 3.Thiru.G.Mala (Adhaar Card
No.5453 6651 0126) (Cell No.9789511864), aged about 40 years wife of
Thiru.M.Somasundaram residing at No.7/21-2, Nesavalar Colony,
Thirupathisaram Post, Thirupathisaram Village, Thovalai Taluk, Kaniyakumari
District,

Introduction:

1 and 3 of us are husband and wife. We have been serving through spiritual
organizations for the past 22 years. For a long time we considered it as our
purpose of life to add material in the way of grace in our life to help the poor
and needy for service. A system should be created to emphasize virtues such
as service to humanity, wisdom, devotion, charity and yoga. That organization
must also be a divine act. It is in the memory of Sri Mahakarishi Agasthya, the
epitome of love and mercy, that we have established this Charitable Trust in
his name to dedicate ourselves to the service of humanity.

(It is a leased building)

Whenever it is necessary to change address the trust can change the


address through resolution.

OBJECTIVES OF THE TRUST:-

1. Implementation of methods guided by Mamakarishi Agasthya


2. Bhakti, Dhyana, which has been lost by time in the tradition of the
Siddhas. Learning the methods of God Realization. Teaching and learning.
3. Training Siddha in traditional food systems, Jivakarunya, discipline etc.,
4. Teaching Yoga, meditation, etc., also creates awareness of the same.
5. Conducting Guru Puja regularly every year.
6. Access to medical facilities for old age, disabled and differently-abled
persons and people who are not able to get medical facilities in the
surrounding Village.
7. Conduct counseling to develop higher qualities like Physical welfare, mental
strength, living in harmony, helping etc., and helping for that cause.
8. Devoted to spiritually minded people, instilling a sense of service.
9. Providing protection to the destitute.
This foundation is a foundation not having commercial or profit motive,
political motive. It is a social/community spiritual organization. And this
foundation is caste, creed and race neutral. The Foundation currently has
the following persons as trustees and members.

Current Trustees of the Foundation:

The following 3 persons are currently the administrators of this trust.


1. M.Somasundaram - Managing Trustee
2. R.Ganesan - Secretary
3. G.Mala - Treasurer

The trust currently has a savings fund of Rs.1,000/- (one thousand only)
and the said fund is the amount donated to the trust by the members of the
trust. Apart from this the trust currently has no movable or immovable
assets.

To carry out the objectives of the said Trust, the Trust shall receive
donations from the members of the charitable trust or the general public to
carry out the above activities.

In order to carry out the above objectives of the trust, if any movable and
immovable property is required to be purchased in the name of the trust,
the general body of the trust shall pass a resolution and the executive
trustee shall have the power to purchase the property in the name of the
trust. If there is a need to give away the immovable assets of the Trust,
should pass a resolution in the general board meeting of the Trust and the
Managing Trustee, Secretary and Treasurer should jointly sign to execute.
An account has to be opened in a nationalized bank, Schedule bank or
Co-Operative in the name of the Trust for receipt of funds under the
co-signature of the Managing Director and Treasurer and use it.
Tenure of Current Directors of this Trust is the duration of their lives.

Membership Eligibility:

1) Socially minded persons above 18 years of age, both men and women
willing to follow sidhar way can become members of this foundation.
2) Admission of new members shall be at the discretion of the Trustees.

DUTIES AND RIGHTS OF TRUST MEMBERS:

a) The members of the Trust have the right to bring resolutions in the
General Committee and to have a debate on that and to participate in the
vote.

b) All members have the right to advise and participate in the management
for the benefit and development of the Trust. New members are not
entitled to participate in the management for the first 5 years. Those
who are once disqualified from membership of the Trust may be
re-admitted by resolution of the General body and those who are
admitted like that cannot be placed in management for 3 years from date
of admission.

c) All the Members of the Trust should cooperate wholeheartedly to


implement the objectives of the Trust.

d) The Members of the Trust shall be bound by the by-laws of the Trust,
decisions of General committee and working committee.

e) All members are entitled to all the discounts and benefits available
through the Trust
f) The Trust will strive to implement the above objectives through the
income collected from members and non-members through donations,
development funds etc.,

g) The court proceedings with regard to this Trust will be conducted by the
Chairman of the Trust as the plaintiff or the defendant.

h) The Trust Secretary is empowered to conduct all matters relating to the


Trust's affairs.

Disqualification of members

a. When goes against the statutory schemes and laws of the trust.
b. In case of damage to trust property.
c. When the members of the trust file a case against the trust in police
station or court.

Administrators:

a. Administrators are a committee of 3 persons in total namely Managing


Trustee, Secretary, and Treasurer.

b. In the present administrators the Managing Trustee and Treasurer


have taken sannyasam in the names of Yugathanandagiri, Gayathri
Anandagiri and the next administrators must have taken sannyasam in
guidance of Chief Sannyasi in the Sri Mamakarishi Agasthyar Charitable
Trust.

c. In case of vacancies during the term of office of the administrators, the


other administrators can appoint new members of the trust and give them
administrative posts according to their qualification.
d. There is no remuneration for administrators. If they go out of town for office
work of the trust, they will be given transport and food expenses as per the
recommendation of the administrators.

Duties of Administrators:

a) Managing Trustee

1. The Executive Trustee presides over all meetings of the Trust. If he is


not comfortable then he should ask the Secretary to preside.

2. With the support of other administrators, all affairs of the trust


should be conducted in accordance with the legal rules and
regulations of the trust.

3. The chairman should conduct the meeting


of the Trust with the help of Secretary.

4. Should work tirelessly for the welfare of the Trust without self-
interest.

a) Secretary

1. All actions should be taken to convene all the meetings of the Trust.
2. Conduct all correspondence of the Trust with the approval of the
Chairman and look after the day-to-day Trust operations.
3. To take necessary action to carry out the objectives and process
plans of the Trust on the advice of the General Committee.
4. Should work tirelessly for the welfare of the Trust without self-
interest.
5. Collection of donation and development funds along with treasurer.
6. The results of the Trust meetings shall be recorded in the minute
book and signatures of all those present shall be obtained. The Trust
Register must be kept safe.
7. Actions should be taken to obtain the approval of the administrators
for the audited report after the end of the financial year of the Trust.
8. The Secretary shall keep and safeguard all documents relating to the
Trust.

e) Treasurer

1. It is the duty of the treasurer to collect donations, development funds,


issue receipt for the same and maintain the accounts of daily income
and expenditure.
2. The Payment for the vouchers signed by Chairman or Secretary
should be given.
3. He should keep only Rs.1000/- in his hand for the emergency
expenses of the trust and deposit the remaining amount in the bank
in the name of the trust.
4. The accounts of the trust should be audited after completion of the
financial year of the trust and obtain certification from the auditor
and should take action to get approval at the general body meeting.

Fund

a) The financial year of the Trust shall be from April to March one year
period.
b) The funds of the Trust include the funds received from donations and
charitable institutions, grants from the government and development
funds.
c) Funds of the Trust to be used only for execution of
Objectives of trust.
d) No remuneration for the administrators of the Trust.
e) This foundation is an organization that works for the human society
across India irrespective of caste, religion, ethnicity and language
without any expectation of return.

Registers

The Trust shall maintain the following records:

1. Foundation Minute Book


2. Member Registry
3. Income and expenditure Accounts Register

The income and expenditure of the trust should be audited once in


a year. The total funds of the trust should be audited by two Ordinary
Members who have completed SSLC if the income and expenditure is up
to Rs.2500/- and if the fund is between Rs.2501 to Rs.10,000/- by two
Graduated Ordinary Members, if it is above 10,000 then should be
audited by a Chartered Accountant and if it is less then Rs.10,000 can
be audited by a qualified auditor.

If the Ordinary members are auditing then they should have been
appointed by the general committee.

The trust funds are to be spent under section 13(1) (D) read with
1(5) of the Income-tax Act, 1961. The Trust General Committee has the
power to amend, add and delete by-laws to carry out the purposes of the
Trust.

This document is a non-recoverable document. If we want to end


up this trust we can link it to another trust having the same intention.
If any particulars are omitted in this document, the members of
the Trust shall act in accordance with the provisions of the Indian Trusts
Act, 1882.
