Statutory Variation Clause

1 The purchaser shall be entitled to vary the order quantity upto + 30% anytime within the delivery period (including
extended delivery period) on the same terms and conditions. The increase in quantity with respect to the tender
quantity can be done even at the time of ordering and the tenderer shall be bound to accept the quantity so
ordered on the basis of his original offer. The purchaser shall be entitled to exercise +30% option clause in one or
more than one instalment as long as the total variation in quantity does not exceed the limit of 30% of ordered
quantity.

sufficient local capacity and competition in supply of the tendered item of
required quality and therefore public procurement of the item is restricted to
Class-I local suppliers only and the vendors who do not qualify to be Class-
I local suppliers should not quote in the tender as their offers shall not be
considered for any ordering. In case any vendor who does not qualify to be
a Class I local supplier for the tendered item participates in the tender it
does so at its own risk and cost and Railways shall not be liable for any
loss or damage caused to the vendor. It is mandatory for the tenderer to
provide certification (along with offer) as per PPP-MII order 2017 as
amended, in addition to other qualifying criteria of the tender. As the
procurement is for a value in excess of Rs. 10 crores, the Class-I local
supplier shall be required to provide a certificate from the statutory auditor
or cost auditor of the company (in the case of companies) or from a
practicing Cost accountant or practicing chartered accountant (in respect
of suppliers other than companies) giving the percentage of local content.
The certificate should have valid UDIN mentioned in certificate.
