QUESTION ONE (GROUP FIVE)


The period of 1962-1966 was regarded as stagnant years. Per Viela LLB1.
I. Critically analyze the above statement

II. Critically discuss the following cases and show their contribution to the
constitutional history of Uganda;
a) Joseph Kazaraine Vs the Lukiko [1963] EA 472
b) Kabaka’s Government and Another v Attorney General of Uganda and
Another, Privy Council Appeal No. 56 of 1964
c) Attorney General of Uganda v Kabaka’s Government (1965) EA 393
d) Joweth Lyagoba vs Bakasonga and Ors [1963] E.A 57

QUESTION TWO (GROUP SIX)


After the onset of independence, Uganda as a newly independent state witnesses a time
of tension and pressure arising not only from a failed constitutional process but also
from a clash of Egos of the leaders at the moment and this amounted to a ticking bomb
that would explode anytime into a fatal crisis.
Examine the causes and the implications of the 1966 Kabaka crisis on the political
and constitutional history of Uganda.
QUESTION THREE (GROUP SEVEN)
Critically discuss the cases of Ibingira & ors Vs A.G (1966) EA 305(No.1) and (No. 2)
and show its relevance to the constitutional history of Uganda.

QUESTION FOUR (GROUP EIGHT)


Finally the ruling in the case of Uganda Vs Commissioner of Prisons exparte Matovu
(1966) EA 514 has been expunged by the 1955 Constitution. Discuss.
QUESTION FIVE (GROUP NINE)
The law was him and he was the law. Constitutionalism was nonexistent. His vice-
president even admits to not being aware that Uganda had a constitution until after
his reign! Per Jeremy Kabanda, UHRC witness.
Examine the above statement in light of constitutional developments during the period
of 1971-1979.
QUESTION SIX( GROUP TEN)
The period from 1979 can be described as one of a search for constitutional
reconstruction. The search was a result of a government formed in exile during the
Moshi conference whose main participants were drawn from approx. 22 exile political
groups. The overall body that was ushered in after the fall of Amin’s regime was the
UNLF which was the umbrella organization of the various political groups associated
with the Moshi conference.
In light of the above statement, critically discuss the events that happened between
the period of 1979-1980.
The case of Andrew Lutakome Kayira and others v. Edward Rugumayo and Others
Cconstitutional Case No. 1 of 1979 was significant in the constitutional history and
developments in Uganda, Discuss.
