JUDICIAL AFFIDAVIT
(of Gloria Vanzuela Garlet)

I, Gloria Vanzuela Garlet, of legal age, married, Filipino,

residing at Barangay Mahayag, Mahaplag Leyte, after having sworn to
in accordance with law hereby state in judicial affidavit format:
With the permission of the Honorable Court.
1. I am a witness of the instant case.
2. My testimony is obtained by Atty. Lucille M. Teves at
TEVES Law Office , San Antonio St. Inopacan, Leyte.
3. I am fully conscious that I answer the questions under oath
and that I may face criminal liability for false testimony or
perjury. My testimony is in question-and-answer.

The testimony of the witness Gloria Vanzuela Garlet is being offered:

1. To Prove that the Saint Michael Multipurpose Cooperative
(SMMPC) is the rightful owner of an agricultural land located at
Barangay Mahayag, Mahaplag Leyte, a portion of which is
occupied by the respondent Susan Ceballos without permission
from SMMPC .

2. To Prove that Rogelio “Tangkeg” Bergado, with the order of

Susan Ceballos, unlawfully took coconuts from the coconut
plantation of Saint Michael Multipurpose Cooperative
(SMMPC).

3. To prove other relevant matters.

Answer I’ am Gloria Vanzuela Garlet , of legal age,

(A) married , a resident of Baranagy Mahayag,
Leyte and Manager of Saint Michael
Multipurpose Cooperative (SMMPC ).
2 Q Can you understand and speak English?

A Yes, I can understand and speak English a bit,

but I want my affidavit to be taken in
Cebuano.
3 Q Why are you here ?

( Translation) Nganong ani - a man ka karon ?

A Aron pag himo ug sinumpaang pamahayag ,

bahin sa pagpanguha ug lubi didto sa yuta na
gipanagiya sa Saint Michael Multipurpose
Cooperative, (SMMPC ) diin usa ako ka
myembro ug Manager sa mao na kooperatiba.
Ug aron pag pa matuod nga ang nagkuha sa
mga lubi gikan sa maong kalubian mao si
Rogelio “Tangkeg” Bergado, ug nga siya
gisugo ni Susan Ceballos.

(Translation) To give a sworn statement about the unlawful

taking of coconuts from the coconut plantation
owned by the Saint Michael Multipurpose
Cooperative , (SMMPC ) where I am a member
and its Manager , and It was Rogelio “Tangkeg”
Bergado, who harvested the coconuts with the
direct instruction of Susan Ceballos.

4 Q Nag-ingon ka nga may mga lubi nga gikuha

gikan sa kalubian nga gipanag-iya sa Saint
Michael Multipurpose Cooperative (SMMPC).
Aduna ka bay ebidensiya pagpa matuod nga
ang SMMPC mao ang matuod ug legal nga
tag-iya sa maong luna?

(T) You said that the coconut plantation where the

coconuts were unlawfully taken is owned by Saint
Michael Multipurpose Cooperative (SMMPC). Do
you have an evidence or proof that SMMPC is the
rightful and legal owner of the same land?
 A Oo naa koy kopya sa Certificate of Title

(T) Yes. I have here copy of the Certificate of Title

(pointing document evidencing ownership and the
purpose for which it is presented)

5 Q Miingon ka nga si Rogelio “Tangkeg” Bergado

ang nanguha sa mga lubi didto sa kalubian
nga gipanag-iya sa SMMPC. Nakakita ba ka
niya ?

(T) You said that Rogelio “Tangkeg” Bergado

unlawfully took the coconuts from the coconut
farmland of SMMPC. Did you see him?
A Oo, tinuod ni. Si Rogelio “Tangkeg” Bergado
ang nanguha nga walay pagpananghid
kanamo sa mga lubi didto sa kalubian nga
gipanag-iya sa SMMPC. Nakita siya nako nga
didto sa kalubian dihang nahitabo ang
pagpanguha nga walay pananghid ug lubi ug
nakaila ko niya kay nagpuyo man kami sa
samang lungsod.

(T) Yes, it is true. Rogelio “Tangkeg” Bergado

unlawfully took coconuts from the coconut
plantation owned by SMMPC. I saw him in the
area when the incident happened and I can identify
him because we are living in the same
municipality.

6 Q Kanus- a man nahitabo ang mao nga

pagpanguha sa mga lubi na walay pananghid?

(T) When did the unlawful taking of the coconuts took

place?
A Nahitabo ni niadtong Obtubre 25, 2023 sa
hapon.
(T) It happened in the afternoon of October 25, 2023.
7 Q Diin man nahitabo ang pagpangawat sa mga
lubi?

(T) Where did the unlawful taking of the coconuts

happened?

A Nahitabo ang mao nga pagpangawat sa mga

lubi didto sa kalubian nga gipanag-iya sa
SMMPC ug naa sa Barangay Mahayag,
Mahaplag, Leyte.

(T) The unlawful taking of the coconuts happened in

the coconut plantation owned by the SMMPC that
is located in Barangay Mahayag, Mahaplag Leyte.

8 Q Unsa man ang imong nakita niadtong

Oktobre 25, 2023 sa mga alas dos sa hapon ?

(T) What did you see on October 25, 2023 at around

2:00 P.M.

A Mga alas dos kadto sa hapon niadtong

Oktobre 25, 2023 samtang didto ko sa yuta nga
gipanag-iya sa SMMPC uban sa akong bana
nga si Macke Garlet. Nag-estoryahay mi
dihang miingon siya, “Oy, paminawa ra gud,
mura man ug naay nagsaka sa lubi”.
Naminaw ko pag-ayo ug akong nabati ang
tingog sa mga nangatagak nga lubi. Mitubag
pud ko sa ako bana, “Oo, naa bitaw”.

Ako gisugo ang ako bana nga i report ang

insidente sa Barangay Hall ug magpadala ug
mga tanod sa lugar didto sa kalubihan.
Miadto sa Brgy Hall ako bana nag request ug
tanod samtang ako miadto usab sa opisina sa
SMMPC nga naa sa Pob. Mahaplag, Leyte.

(T) At around 2:00 pm on October 25,2023, I was in

the farm owned by the SMMPC together with my
husband, Macke Garlet. While I was talking to my
husband he said, “Listen, I think somebody is
climbing the coconut trees.” So I listened intently
and heard coconuts falling down the ground. I
 replied to my husband, “ Yes, there is”.

I instructed my husband to report the incident to

the Barangay Hall and to send Barangay Tanods
in the coconut plantation. My husband went to the
Barangay Hall, while I went to our office located in
Barangay Poblacion to report the incident.

9 Q Unsa may imo gibuhat pag-abot nimo sa

opisina sa SMMPC?

A Ako gisultian ako mga kaopisina sa nahitabo.

Ako gihangyo si Rhena Pantuliaga Pardo nga
ubanan ko sa Mahaplag Police Station para
amo I report ang mao nga insidente. Akong gi
report sa pulis nga nakadungog mi ug mga
lubi nga nangatagak sa yuta na gipanag iya sa
SMMPC ug mora ug may nag kopras sa mga
lubi. Nangayo mi ug tabang sa mga pulis kay
mahadlok man mi muadto sa kalubian.
Miingon ang in-charge anang adlawa nga
magpadala sila ug mga pulis nga mag patrol
duol sa mao nga lugar.

(T) I told my officemates about the incident. Then I

asked Rena Pantuliaga Pardo to accompany me to
the Mahaplag Police Station to report the incident.
We reported to the police that we heard coconuts
falling from the ground and it seems that
somebody is harvesting the coconuts from the
coconut plantation. We asked assistance because
we are afraid to go to the area. The police-in-charge
told us that they will be sending policemen to
monitor the area.
10 Q After reporting to the police, what did you do?

(A) Mibalik ko sa umahan sa SMMPC uban ni

Rena Pardo. Pag-abot namo, didto na ako
bana nga si Macke uban ang duha ka
 barangay tanods nga naglantaw didto sa
kalubian ug nagbantay pag-ayo sa mga
panghitabo. Ingon ako bana nga samtang
wala pa kami, iya gi video ang mga
panghitabo.

(T) I went back to the SMMPC farm in Mahayag with

Rena Pardo. When we arrived, my husband
Macke was already there with two barangay
tanods, who were looking at the coconut plantation
and closely monitoring what was happening.
According to my husband, he took a video of the
incident.
11 Q Pagkahuman nimo ug estorya, unsa man ang

(T) After talking to your husband, what happened
next?
A Miadto si Rena Pardo ug ang barangay tanods
sa kalubihan nagpaduol sa nagsaka sa lubi
para sutaon kung unsa gayud ang nahitabo.
Pag-abot nila didto, ilang nakita ang mga lubi
nga diha na sa yuta ug Nakita nila si Rogelio
Bergado nga nagtapok niini.

(T) Rena Pardo and the barangay tanods went to the

coconut plantation, they went closer to the one
harvesting the coconuts , to check what is truly
happening. When they arrived there, they saw the
harvested coconuts on the ground and they saw
Rogelio Bergado gathering them. Rena took
pictures and video of the incident.

12 Q Giunsa man nimo pagkahibalo nga wala man

ka mouban nila pagduol didto sa kalubihan?

(T) How did you know about it when you were not
with them when they went to the coconut
plantation?
 A Didto man ko sa amo garden nagtan-aw nila.
Gikan sa ako gibarugan, nakita man nako ang
mga panghitabo.
(T) I was watching them from our garden. I can clearly
see what was happening from where I was
standing.

13 Q Unya, unsa na man nahitabo pagkahuman

adto?

(T) Then, what happened after that?

A Gipangutana ni Rena si Rogelio Bergado

kung kinsay nagsugo niya. Ang iyang tubag si
Susan Ceballos. “Diri man gani to sila (Susan
and Dodong Valenzona). Kay ila man kuno ni.
Diri gali to si Dodong (Valenzona).

(T) Rhena asked Rogelio Bergado who directed him to

harvest the coconuts. He answered that it was
Susan Ceballos. He even said that, “They were
here (Susan Ceballos and Dodong Valenzona).
They said that they are the owners of this land.
Dodong(Valenzona) was even here”.

(T) After the confrontation between Rena and
Reynaldo, what happened?

A Nibiya si Rena ug ang mga Barangay Tanod

ug nagpadulong ngadto sa garden kung diin
ako naghuwat nila.

(T) Rena Pardo and the Barangay Tanods left the area
and went to the garden where I was waiting for
them.

15 Q Unsa man ang nahitabo pag-abot ni Rena

Pardo ug mga Baranagy Tanods sa garden nga
imo silang gihuwatan?

(T) What happened when Rena Pardo and the

Barangay Tanods arrived at the garden where you
 were waiting?

A Nag istambay sa mi didto kadali ug samtang

nagpaabot mi nga makauli, niabot ang mga
pulis nga sila James Alvarado ug policeman
Bug-atan. Nangumusta sila ug unsa na ang
nahitabo. Miingon si Police Officer James
Alvarado nga iyang nakita ug na interview si
Rogelio Bergado. Iya gipangutana ug kinsa
ang nagsaka sa mga lubi. Miangkon si Rogelio
Bergado nga siya ang misaka sa mga lubi.
Gipangutana siya kung pila ka punuan iya
gisaka ug pila ka lubi iya nakuha. Mitubag
siya nga 20 ka punuan, ug 100 kabuok nga
lubi.

(T) We stayed at the area for a while and before going

home, police officers James Alvarado and Bug-atan
arrived. They asked what had happened. Police
Officer James Alvarado said that they saw and
interviewed Rogelio Bergado. He asked who
harvested the coconuts and Rogelio admitted that it
was him. Further, Police Officer Alvarado said he
asked how many coconut trees did Rogelio climbed
and how many coconuts he harvested. Rogelio
answered that he climbed twenty (20) coconut
trees and was able to gather one hundred pieces of
coconut.

(T) After your conversation, what happened next?

A Gi tambagan mi nila Sir James Alvarado nga

mag pa blotter sa panghitabo mao nga miadto
mi dayon sa police station ug nagpa blotter.

(T) Sir James Alvarado advised us to report the

incident so we immediately went to the police
station and had it in the police blotter.

17 Q Human atong adlawa sa October 25,2023 unsa

may nahitabo ?
 (T) What happened after October 25,2023?

A Niadtong October 28,2023 among nakit an ang

mga lubi na gitapok dapit sa yuta ni Belen
Enehente ug sa Simbahan sa Iglesia ni Cristo .

(T) On October 28 ,2023 we saw the harvested

coconuts gathered along Belen Enehentes’s land
and the Iglesia ni Cristo Church.

18 Q Mao ba kini nga mga lubi nga gikuha sa

kalubihan sa SMMPC?

(T) You are saying that these coconuts are the same
coconuts harvested from SMMPC’s coconut
plantation?

A Oo kay Nakita man namo na si Rogelio

Bergado kadtong iya ning gitapok.

(T) Yes, because we saw Rogelio Bergado gathered it.

19 Q Naa pa ba kay gusto idugang?

(T) Is there anything you want to add?

A Wala na sa pagka karon ,

(T) None as of now .
