JUDICIAL AFFIDAVIT – WITNESS

I, Pepito Hecto y Coral, 64 years old, married, farmer, a resident of

Brgy. Tagadtaran, Burauen, Leyte, after having been duly sworn to in accordance with
law, hereby depose:

That this judicial affidavit pertains to the investigation conducted by PO3 Samuel
Jade R. Alpino at Burauen Police Station, Burauen, Leyte under the supervision of
PSINSP RODOLFO C. RENOMERON JR, Acting Chief of Police relative to the
Qualified Theft of Coconut Incident at the land parcel owned by parents of
Mario Relador that transpired last June 13, 2018 at more or less 9:00 o’clock in the
morning at Brgy. Tagadtaran, Burauen, Leyte;

That I hereby state, that in answering the questions asked of me as appearing

below, I was fully conscious that I did so under oath and that I may face criminal liability
for false testimony or perjury;

Pakiana 3: Kay-ano nga aanhi ka ha opisina han Burauen Police Station?

(Why are you here at the office of Burauen Police Station?)

Baton: Anhi ako para hin pagsuporta hin pagtistigo bahin han igin pasaka
nga kiha kontra kanda Absalon Cajara alias Yeye, Arlene R. Tolibas, ngan duha
nga diri ko kilala ha ngaran nga mga umangkon eni ni Yeye Cajra.
(I am here to support as witness for the case being filed against Absalon
Cajara alias Yeye, Arlene Tolibas and two (2) John Does who are nephews of alias
Yeye Cajara)

(Do you know the private complainant of this case?)

Baton: OO sir, Mario Relador y Manasis, 60 years old, married, retired PNP
member, a resident of La Paz Street, District 6, Burauen, Leyte.

(The suspect of this crime, do you also know him?)

Baton: Oo sir, hi Absalon Cajara alias Yeye, Arlene Tolibas ngan duha nga
tawo nga diri ko kilala ha ngaran nga mga kaumangkunan eni ni alias Yeye
Cajara)

(When and where did this incident happened?)

Baton: Nahitabo eni hadto han June 13, 2018 mga banda alas 9:00 han aga
dito ha Brgy. Tagadtaran, Burauen, Leyte partikularyo ngadto han gintatag-iyahan
nga tuna han kag-anak ni Mario Relador.
(This incident happened last June 13, 2018 around 9:00 o’clock in the morning at
Barangay Tagadtaran, Burauen, Leyte particularly at the parcel of land owned by
parents of Mario Relador.)

Pakiana 7: Nakain ka man han mahitabo eni nga incidente?

(Where were you when this incident happened?)

Baton: Nakadto ako guihap hito nga tuna nga gintatag-iyahan han kag-
anak ni Mario Relador.)
(I was also there at the said parcel of land owned by parents of Mario Relador.)

Pakiana 8: Nag-aano kaman didto hito nga lugar?

(What are you doing on that said place?)

Baton: Usa ako han mga sinuhulan ni Mario Relador para magharas
ngadto hito nga gintatag-iyahan nga tuna han kag-anak ni Mario Relador.
(I am one of the hired workers of Mario Relador to clean the parcel of land owned
by the parents of Mario Relador.)

Pakiana 9: Pwede mo ba igsaysay an panhitabo?

(Will you please narrate the incident)

Baton: Oo, sir hadton mga banda alas 8:30 han aga sumubra magkulang
han Hunyo 13, 2018 ginsugo kami ni Mario Relador kaupod an akon ig kasi ko
magtratrabaho na hi Reynato Rota para magtaod han tarpaulin didto hito nga
tuna nga gintatag-iyahan han kag-anak ni Mario Relador. Pero waray kami tuguti
ni Arlene Tolibas ngan ginyakanan kami nga didto hit kan alias Yeye Cajara tuna
niyo igtaod ito nga tarpaulin.
(Yes sir, last June 13, 2018 at around 8:30 o’clock in the morning I was
instructed by Mario Relador to post his tarpaulin at the parcel of land owned by parents
of Mario Relador and Arlene Tolibas defended not to post that said tarpaulin and
instructed to put that tarpaulin at the parcel of land owned by alias Yeye Cajara in which
we obliged).

iyahan han kag-anak ni Mario Relador nga kahuman hito nagtikang kami
pagharas nga paglabay hin 30 minutos mga banda alas 9:00 han aga ha amo la
guihapon nga petsa umabot eni hira alias Yeye Cajara nga myda upod 2 ka tawo
nga ha nawong ko la kilala, samtang nakita eni hi Arlene Tolibas nga nasunod ha
ira pero dumistansiya la kanda alias Yeye Cajara. Kun diin nakita ko hi alias Yeye
Cajara ginhulbot an iya halaba nga sundang ngan nag hagyo pag handos han
barangay konsehal Arnel Raga nga kadagmitan na dumalagan tikadto ha luyo han
puno han lubi pero hi alyas Yeye Cajara gin saway ni Mario Relador kay sumala
ha iya nadire hiya hin samok. Salit nagtipakadi an iya atensyon ha akon ngan
nagyakan hiya ha akon na ako in traydor ngan kinahanglan ko na umukoy han
akon ginbuhat o kon dire mamatay ka, akon ini tuna. Samtang tipauruli kami, hi
alyas Yeye Cajara gin ruba an amon tarpaulin na may ada surat na “no
trespassing” gamit an iya halaba nga sundang samtang nagsiring hiya nga peke
ini nga desisyon.
(We posted the tarpaulin at the parcel of land owned by parents of Mario
Relador. We started to clean up the parcel of land and after 30 minutes have past at
around 9:00 o’clock in the morning of the same date alias Yeye Cajara together with two
(2) John Does as I saw Arlene Tolibas who was a few distance away from them.
Wherein I saw alias Yeye Cajara pulled his long bladed weapon and attempted to
hacked barangay councillor Arnel Raga who immediately run towards the back of a
coconut tree but alias Yeye Cajara was pacified by Mario Relador for according to him,
he doesn’t want trouble. As he turned his attention on me and told me that I was a
traitor and you should stop what you have been doing or else you will be dead, this is
my land. And we are about to go home alias Yeye Cajara destroyed the tarpaulin with
written no trespassing using his long bladed weapon while saying this is a fake
decision).
