JUDICIAL AFFIDAVIT
(of Rena Pantuliaga Prado)

I, Rena Pantuliaga Prado,of legal age, married, Filipino,

residing at Barangay Poblacion, Mahaplag Leyte, after having sworn
to in accordance with law hereby state in judicial affidavit format:
With the permission of the Honorable Court.
1. I am a witness of the instant case.
2. My testimony is obtained by:

3. I am fully conscious that I answer the questions under oath
and that I may face criminal liability for false testimony or
perjury. My testimony is in question-and-answer.

The testimony of the witness Rena Pantuliaga Prado is being offered:

1. To Prove that Rogelio “Tangkeg” Bergado, with the order of
Susan Ceballos, unlawfully took coconuts from the coconut
plantation of Saint Michael Multipurpose Cooperative
(SMMPC);

2. To identify the property owned by Saint Michael

Multipurpose Cooperative (SMMPC), now being the subject
property where in the unlawful taking of coconuts took
place ;

3. To corroborate the testimony of Gloria Vanzuela Garlet in

support of the complaint of the Chairman of SMMPC.
1 Question Please state your name, age, civil status,
(Q) residence, and occupation.

Answer I, Rena Pantuliaga Pardo, 47 years old,

(A) married, a resident of Barangay Mahayag,
Mahaplag, Leyte and a member of Saint
 Michael Multipurpose Cooperative
(SMMPC).

2 Question Can you understand and speak English?

Answer Yes, I can understand and speak English a

3 Question Why are you here?

Translation To give a sworn statement about the

unlawful taking of coconuts from the
coconut plantation owned by the Saint
Michael Multipurpose Cooperative
(SMMPC) where I am a member ,and to
prove that Rogelio “Tangkeg” Bergado
unlawfully harvested the coconuts from
the SMMPC coconut plantation under the
direction of Susan Ceballos.

Translation You said that Rogelio “Tangkeg” Bergado

unlawfully took the coconuts from the
coconut farmland of SMMPC. How did
you know it was him ?

Answer Oo, tinuod ni. Si Rogelio “Tangkeg”

(A) Bergado ang nanguha nga walay
 pagpananghid kanamo sa mga lubi didto
sa kalubian nga gipanag-iya sa SMMPC.
Nakita siya nako nga didto sa kalubian
dihang nahitabo ang pagpangawat ug
nakaila ko niya kay nagpuyo man kami sa
samang lungsod.

Translation Yes, it is true, I actually saw him- Rogelio

“Tangkeg” Bergado unlawfully took
coconuts from the coconut plantation
owned by SMMPC. I saw him in the area
when the incident happened and I know it
was him because we are living in the same
municipality.

Translation When did the unlawful taking of the

coconuts took place?

Answer Nahitabo ni niadtong Obtubre 25, 2023 sa

(A) hapon.

Translation It happened in the afternoon of October

25, 2023.

Translation Where did the unlawful taking of the

coconuts happened?

Answer Nahitabo ang mao nga pagpangawat sa

(A) mga lubi didto sa kalubian nga ginag-iya
sa SMMPC ug naa sa Barangay Mahayag,
Mahaplag, Leyte.

Translation The unlawful taking of the coconuts

happened in the coconut plantation owned
by the SMMPC that is located in Barangay
Mahayag, Mahaplag Leyte.

7 Question Ingon ka nga nangawat si Rogelio Bergado

(Q) ug mga lubi didto sa kalubian sa SMMPC ,
nakakita ka ba sa pagpanguha niya?
 Translation You said that Rogelio Bergado unlawfully
harvested and took coconuts from the
coconut plantation of SMMPC, did you
actually see him?

Answer Oo. Niadtong Oktobre 25, 2023 sa hapon,

(A) miabot sa amo opisina ang amo Manager
nga si Gloria Garlet. Misulti siya nga
nakadungog sila – siya ug ang iyang bana
ug mga lubi nga nangatagak gikan sa mga
punuan sa mga lubi didto sa kalubihan
nga gipanag-iya sa among kooperatiba. Iya
ko gihangyo nga ubanan siya sa
Mahaplag Police Station para amo i report
ang mao nga insidente. Miuban ko niya sa
estasyon sa mga pulis ug amo gi report ang
mao nga panghitabo. Nagpatabang mi sa
mga pulis kay mahadlok man mi muadto
sa kalubihan. Mao nga nagpadala sila ug
mga pulis nga nag patrol duol sa
kalubihan.
Translation
Last October 25, 2023 in the afternoon, our
Manager, Gloria Garlet arrived at the
office. She told us that she and her
husband Make Garlet heard the falling
coconuts from the coconut trees in the
coconut plantation owned by our
cooperative. Then she asked me to
accompany her to the Mahaplag Police
Station to report the incident. I
accompanied her to the police station and
we reported the incident. We asked
assistance from the police officer because
we were afraid to go to the coconut
plantation. That’s why policemen were
sent to patrol near the coconut plantation.

Translation After reporting to the police, what did you

do?

Answer Miadto mi ni Manager Gloria sa umahan

 (A) sa kooperatiba. Pag-abot namo didto
nakita nako iya bana nga si Macke Garlet
kauban ang duha ka barangay tanod nga
naglantaw didto sa kalubian ug nagbantay
pag-ayo sa mga panghitabo.

Translation I went with Manager Gloria to the farm

owned by our cooperative. When we
arrived, I saw her husband Macke Garlet
with two barangay tanods, who were
looking at the coconut plantation and
closely monitoring what was happening.

9 Question Pagkahuman adto, unsa man ang imo

Translation After that, what did you do?

Answer Miadto ko ug ang mga Barangay Tanod sa

(A) kalubihan para susihon kung unsa gayud
ang nahitabo. Pag-abot namo didto, amo
nakita ang mga lubi nga diha sa yuta ug
nakita namo si Rogelio Bergado nga
nagtapok sa mga lubi. Ako gikuhaan ug
hulagway ug gi video ang mao nga
insidente.

Translation I and the Barangay Tanods went to the

coconut plantation to check what is truly
happening. When we arrived there, we
saw the harvested coconuts scattered on
the ground and we saw Rogelio Bergado
gathering them. I took pictures and video
of the incident.

Translation
Yes, those are the pictures that I took when
the unlawful taking of the coconuts
happened.

12 Question Naa koy ipakita nimo nga USB. Mao ba

nga imo gikuha atol sa pagpangawat sa
mga lubi?

Translation Showing you a USB. Is this the same USB

that contained the copy of the video that
you took during the unlawful taking of the
coconuts?

Translation can be used as a piece of evidence against
those who unlawfully harvested coconuts
in the coop’s land.

Translation What else did you do while you were in

the coconut plantation?

Answer Ako gipangutana si Rogelio Bergado kung

(A) kinsay nagsugo niya ug mitubag siya nga
si Susan Ceballos. Ako siya gi pangutana
asa si Susan? Mitubag siya “Tua sa ila. Diri
man gani to sila (Susan and Dodong
Valenzona). Sila duha ni Dodong
Valenzona.
Translation
I asked Rogelio Bergado who directed him
to harvest the coconut and he answered
that it was Susan Ceballos. I asked where is
Susan, and he replied, “In their place.
They were here (Susan Ceballos and
Dodong Valenzona). The two of them,
Susan Ceballos and Dodong Valenzona.

Translation
We stayed at the area for a while and
before going home, police officers James
Alvarado and police officer Bug-atan
arrived. They asked what had happened.
Police Officer James Alvarado said that
they saw and interviewed Rogelio
Bergado. He asked who harvested the
coconuts and Rogelio admitted that it was
him. Further, Police Officer Alvarado said
he asked how many coconut trees did
Rogelio climbed and how many coconuts
he harvested. Rogelio answered that he
climbed twenty (20) coconut trees and was
able to gather one hundred pieces of
coconut.

police station and had it in the police

Answer Niadtong October 28, 2023 amo nakit-an

Translation Last October 28, 2023, we saw the

gathered coconuts along Belen Enehente’s

Translation Is this the same coconuts that were

harvested from SMMPC’s coconut
