CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE is made and executed at the


Municipality of Inopacan, Province of Leyte this 08 of July 2023 , by
and between:

ROGELIO DULFO of legal age , married , Filipino and a resident of


Brgy. Poblacion, Inopacan, Leyte herein referred as the LESSOR
-AND-

JAYSON DADULO POLISTICO ,of legal age, Filipino , married


and a resident of Brgy. Jubasan , Inopacan, Leyte hereinafter
referred to as the LESSEE.
WITNESSETH:
WHEREAS , the LESSOR is the owner of a parcel of lot located at Sta.
Barbara St. with floor area of 20 square meters.

WHEREAS the LESSOR hereby leases unto the LESSEE, and the
latter hereby accepts in lease from the former, the premise known as
RENTAL of parcel of land for COMMERCIAL SPACE located at
Tinago, . Inopacan, Leyte under the following terms and conditions:

NOW, THEREFORE, for and in consideration of the foregoing


premises, and of the herein mutual covenants, undertakings,
obligation, and terms and conditions, the parties have agreed, as they
hereby agree as follows:

1. TERM : The term of this lease is for a period of TWO (2)


YEARS commencing on JULY 8, 2023 and expiring on JULY 8,
2025 , renewable upon the option of the parties . In case one or
both of the parties is no longer interested to renew the contract ,
each party has the obligation to notify the other within the
period of 60 days prior to the expiration of the contract ;

2. RENTAL RATE: The monthly rental shall be PhP 2,000 (Two


Thousand Pesos) to be paid to Mr. Roger Dulfo or to his
authorized representative every 7th of the month.

3. ADVANCE DEPOSIT : The LESSEE shall pay to the LESSOR


two months advance equivalent to FOUR THOUSAND PESOS
( PhP 4,000) at the time of the execution of this CONTRACT.
The advance rental shall serve as advance rental for 2023 to
2025.
4. IMPROVEMENTS : LESSEE shall construct only temporary
structures that will serve or suit to the nature of their business
which is removable at the termination of the contract .

5. CANCELLATION : Failure to pay successive two months


rental shall make this contract deemed terminated and LESSEE
agrees to vacate the premises peacefully . However , the
LESSOR shall give the LESSEE notice to pay the monthly rental
before the contract is terminated .

6. USE OF THE LEASED PROPERTY : The property is for


COMMERCIAL USE ONLY , and shall not be devoted to any
other kind of activities without the consent in writing of the
LESSOR, it being understood that should the LESSEE make use
of the Leased Premises for purposes other than herein agreed
upon, the LESSOR has the option to rescind the lease
agreement or increase the rentals to be collected or this contract
be automatically terminated.

In no case shall the leased property be used for immoral or


illicit purpose and illegal acts or purpose

7. SUBLEASE : The LESSEE cannot lease the property to third


person without the consent of the LESSOR .

8. RETURN OF PREMISES : Upon the termination of this Lease


Agreement for any reason whatsoever, the Lessee shall
peacefully and immediately vacate the leased property and
return the possession thereof to the LESSOR in good and
tenable condition except personal belongings owned by the
LESSEE .

9. INSPECTION OF PREMISES : The LESSOR reserves the right


to enter and inspect the leased premises at reasonable times
during business hours and with prior notice . The LESSEE
agrees to cooperate with the LESSOR in keeping the leased
property in good condition.

10.GARBAGE RECEPTACLES : The LESSEE shall provide its


own garbage receptacles in accordance to Solid Waste
Management which the law requires . It is the LESSEE's
responsibility to oversee the proper disposal of its waste
matter/ garbage, failure to do so and in case of violation ,
LESSEE shall be solely liable civilly and/or criminally.
11.BILLS: The LESSEE shall shoulder the payment of the electric
and water bills of the leased premises.

12.PRE-TERMINATION OF CONTRACT : If this contract is pre


terminated by the parties , the LESSOR is amenable to the
decision of the LESSEE and the advance rental shall be forfeited
in favor of the LESSOR and the temporary improvements shall
be demolished at the expense of the LESSE.

13.EXPIRATION OF PERIOD/TERM : Upon expiration of the


period of lease, and without the parties mutually agreeing to
renew the lease contract within the period specified herein, the
lease contract is automatically terminated without prior written
notice to LESSEE. LESSEE shall peacefully vacate the premises
and surrender possession of leased premises to LESSOR;
otherwise, LESSEE binds itself to pay the monthly rental stated
herein, as reasonable compensation for the use of the premises,
without prejudice to any court action which the LESSOR may
take against LESSEE;

14.BINDING EFFECT OF CONTRACT: This lease contract shall


be binding upon all heirs, successors -in – interests and agents
by both parties . This Contract may not hereafter be modified or
altered except by another instrument in writing duly signed by
the parties hereto.

IN WITNESS WHEREOF, the parties have set their hands this


July 19, 2023 at Inopacan, Leyte Philippines.

ACKNOWLEDGEMENT
BEFORE ME, a Notary Public for and in the Municipality of
Inopacan under the jurisdiction of RTC Hilongos , Leyte the parties
personally appeared known to me and to me known to be the same
persons who executed the foregoing instrument and acknowledged
to me that the same is their free act and voluntary deed.
This instrument, consisting of (4) pages, including the page on
which this acknowledgment is written, has been signed on each and
every page thereof by the concerned parties and their witnesses, and
