Dear Rifaa Nurelisa Binti Abdul Halim,

LETTER OF APPOINTMENT as CLINCAL TRAINEE NURSE


Refers to our recent discussion, we are pleased to offer the above position with the Company and subject to
the following terms and conditions: -

Commencement : The commencement date of your employment is 10 October 2023.

Salary : You shall be paid a basic salary of RM1,500.00 per month.

Job Assignment : You are assigned to perform your duties and functions to our associate or affiliate;
under Johor Division and it clinic operations location of C65-DWP-Kulai
Indahpura, and shall report direct to the nominated Division Head of Johor Division.
However, the Company at sole discretionary to reassignment and redeployment
your talent, job functions and location when it is deemed necessary.

Transfer : The Company at sole discretion to transfer you to any department, branch, location,
state to another within the Company as and when deemed necessary.

Statutory : You and the Company are required to contribute of 11% of your salary to Employee
Contribution & Provident Fund and the Company shall contribute the sum of 12% or 13%
Deduction respectively as allowable by Employee Provident Fund Act 1991 or whatsoever
percentage announce by Government from time to time.

You are required to participate in the SOCSO scheme and SOCSO-EIS (Employment
Insurance Scheme) in accordance with the prevailing statutory regulations and
requirements as established by Social Security Organization Act 1969 and Social
Security Organization, Employment Insurance System (Act 800) Act 2017.

You are required to adhere in IRB Monthly Tax Deduction (MTD) of respective Year
of Assessment that regulated by Inland Revenue Bureau (IRB) Act 1967.

Probation Period : You are required to undergo a probationary period of three to six (3-6) months and
confirmation of employment will subject to you complete the Nursing Certification
Programme and passing the examination passing score of 80% as and when
nominated by your reporting Dentist.

Only employee(s) with PASSED nursing examination shall be informed in writing


that they are confirmed, and unsatisfactory performance shall be at the discretion of
the company to ascertain the suitability for the position or extension of probationary
period. Until and unless an employee receives a Letter of Confirmation confirming
you on the job, the employees is always deemed to be on probation on the job even
after the initial or extended probationary period.

Working Hours : Effective 1 January 2023: You shall work 45 hours excluded 1-hour lunch break

Option A-Normal Work-Hours (Workgroup:A/4days & Workgroup:B/2days)


Total normal work-hours of Option A-Normal-Work-Hours (Workgroup A/4
days + Workgroup B/2days) is forty-six (46) hours per week which refers to [1]
Workgroup A (Mondays to Fridays) normal work-hour is thirty-two (32) hours
which is equivalent to four (4) work-days; and [2] Workgroup B (Saturdays to
Sundays) normal-work-hour is fourteen (14) hours which is equivalent to two (2)
work-days. For those who are required to work under Option A-Normal Work-
Hours (as per Work-Scheduler or Duty-Roaster) will-auto eligible to one (1) hour
compulsory Overtime per week which is equivalent to four (4) hours per month.
a) Workgroup A: Mondays to Fridays: 9:00am to 6:00pm
b) Workgroup B: Saturdays to Sundays: 9:00am to 5:00pm

Option B-Normal Work-Hours (Workgroup:A/5days & Workgroup:B/1day):


Total normal work-hours of Option B-Normal-Work-Hours (Workgroup A/5 days +
Workgroup B/1day) is forty-seven (47) hours per week which refers to [1]
Workgroup A (Mondays to Fridays) normal work-hour is forty (40) hours which is
equivalent to four (5) work-days; and [2] Workgroup B (Saturdays to Sundays)
normal-work-hour is seven (7) hours which is equivalent to one (1) work-day. For
those who are required to work under Option B: Normal Workday (as per monthly
Work-Scheduler or Duty-Roaster) will-auto eligible to two (2) hours compulsory
Overtime per week which is equivalent to eight (8) hours per month.
a) Workgroup A: Mondays to Fridays: 9:00am to 6:00pm
b) Workgroup B: Saturdays to Sundays: 9:00am to 5:00pm
The Company at the sole discretion to change the mentioned working hours as and
when deemed fit.

Overtime Claim : Effective 1 January 2023: For those who are earning RM4,000.00 and below per
month which refers to basic salary ONLY per month or below, the overtime Pay Rate
for Per Day (O.R.P) and Per Hour (H.R.P) for working extra-hours on [1] Normal Work-
Day, [2] Rest-Day, [3] Off-Day and [D] Public Holidays;

b) Rest-Day Normal-Work-Hours if ≤4 hrs 0.5 day x O.R.P

Public Holidays : As per state gazette public holidays regulated as per the provision of Employment Act,
1955; and the company will issue memorandum on yearly basis to notify you
pertaining to Company declaration of each year gazette Public Holidays.

Annual Leave : Upon confirmation of employment and after completion of each twelve (12) months of
employment service, you shall be entitled to the following paid annual leave for every
twelve (12) months of continuous service are as follows: -
• Less than 2 years - 14 days
• More than 2 years but less than 5 years - 16 days
• More than 5 years - 18 days
All leaves are NON-cumulative. Leave application must be submitted at least seven (7)
days in advance for proper approval. Taking leave without approval is equivalent to
absent without valid caused which may lead to disciplinary action.

Others Leave : Effective 1 January 2023, the company NO LONGER provides any unrecorded
leaves such as [1] compassionate leaves e.g., marriage or new born child and [2]
calamity e.g., act-of God, natural disastrous like floods, earth-quark, fire and others
and in the event if any you need to apply such leave, you may pursue with annual
or no-pay leave(s) application, if deemed necessary.

Medical Leave : You shall be entitled to sick (medical) leave in accordance to the provisions of
Employment Act 1955 for each calendar year. The sick/medical leave(s) must be
supported with medical certificates certified registered Medical Practitioner of the
Company Panel Doctor – Klinik Mediviron ONLY.

Termination of : During “Probation/Observation” period thereof, the service may be terminated by


Employment either party by giving to the other party fourteen (14) days’ notice or salary in-lieu of
notice thereof.
Upon confirmation, the service may be terminated by either party by giving to the
other party thirty (30) days’ notice; but those with more than two (2) years of
continuous service, the service may be terminated by either party by giving to the
other party sixty (60) days’ notice or salary in-lieu of notice.

General Conduct : Good conduct and discipline are necessary in ensuring proper efficient and effective
management of the Company’s operations. You are required to comply with an
acceptable standard of conduct and behavior. Failure to meet general standards may
result the Company to take the necessary disciplinary action.

Conflict of : Your employment is a full-time employment, and you are prohibited from participating
Interest in any businesses or vocations without the written approval from the Management.

Criminal Offence : Should you be convicted of any criminal offence by any court of law and irrespective of
the severity of punishment, the Company has the right to terminate your service with
immediate effect, if deemed necessary.

Intellectual : All works carried out by you in the course of your employment belongs to the company
Property absolutely and accordingly all intellectual property rights in such work shall belong to
the company absolutely free from all whatsoever claim from you.

Confidential : As part of your normal duties, you will obtain or have access to trade secrets and
Information confidential information concerning the Company, organization, operations, processes,
agreements or other dealings, transactions, or affairs of the Company and/or its
principles, associates, affiliates, subsidiaries and others (suppliers or business
Partners); e.g., Confidentiality Agreement

immediately or upon commencement of work.

(Hereinafter known as “The Employee”) of the other part

WHEREBY IT IS agreed as follows


The Company agrees to furnish the employee(s) access to certain confidential information relating to the affairs
of the company solely for purpose of carrying out his/her duty, whereas, the employee(s) agree to review,
examine, inspect or obtain such information only for the purpose described above, and to otherwise hold such
information confidential and secret pursuant to the terms and condition of this agreement.

BE IT KNOWN that the Company has or shall furnish to the employee(s) certain confidential information, and
may further allow suppliers, co-workers, patients or representatives of the Company, all on the following
conditions: -
1. The employee agrees to hold all confidential or proprietary information or trade secrets (“information”) in
trust and confidence and agree that it shall be used only for the contemplated purpose, and shall not be
used for any other purpose or disclosed to any third party under any circumstances whatsoever.
2. No copies may be made or retained of any written information supplied.
3. At the conclusion of our discussions, or upon demand by the Company, all information, including written
notes, photographs, or memoranda shall be promptly returned to the Company. The employee shall retain
no copies or written documentation relating thereto.
4. This information shall not be disclosed to any employee within the Smile-Link Group of the Companies
which includes Drs. Wong & Partners Dental Surgeons, Toohfairy Dental, Sia & Partners, Dentiste Dental
employees, suppliers, consultants or any third-party personnel/companies unless the said party agrees to
execute and be bound by the terms of this agreement, and disclosure by Company if advance approval in
writing has been granted by “Authorized Personnel”.
5. It is understood that the employee shall have no obligation with respect to any information known by the
Employee or as may be generally known within the industry prior to date of this agreement, or that shall
become common knowledge within the industry thereafter.
6. The employee acknowledges the information disclosed herein is proprietary or trade secrets and in the
event of any breach, the Company shall be entitled to injunctive relief as a cumulative and now necessarily
successive or exclusive remedy to a claim for monetary damages.
7. This agreement shall be binding upon and inure to the benefit of the parties, their successors and assigns.
8. The employee shall not disclose or divulge at any time either during the engagement with this Company
or afterwards any secrets, transactions or information in or relating to the Company or any of its Client(s)
which may come to the employee(s) knowledge or possession in the course of the engagement by us and
which should not be disclosed, divulged or made public save in the course of the employee’s duties.
9. The employee shall not disclose or divulge at any time either during the employment with this Company
or afterwards any secrets, transactions or information in or relating to the Company or any of others
employee(s) who still-under the engagement with the Company which may come to the employee(s)
knowledge or possession in the course of the engagement by us and which should not be disclosed,
divulged or made public save in the course of the employee(s) duties.
10. The employee is strictly prohibited to disclose any personal information, or any privacy information of
own-self or others which may or shall violate the ‘Personal Protection Act, 2012’.
11. This Agreement shall be governed by the construed in accordance with the laws of the State of Malaysia.
12. This constitutes the entire agreement.

This agreement has been mutually agreed by both parties and signed as state below.
