1. Arrastre, stevedoring and wharfage dues all for the account of the shippers/charterers and
consignee at both ends.
2. Shipper/Charterer shall get insurance for the cargo.
3. Vessel and/or owner shall be free from any subrogatory claim made whatsoever. Shipper/Charterer
absolves carrier from such claim.
4. Cost of loading and unloading shall be on free in and out basis.
5. Vessel and/or its owner shall not be responsible for any cargo damage/loss due to poor packing

and improper handling by the shipper’s/charterer’s/consignee’s hired stevedoring/arrastre workers


during loading/unloading and perils due to force majeure and/or perils of the sea.

6. Freight on cargo is deemed fully earned, discountless and unreturnable as cargo loaded on board
vessel, whether cargo or vessel is lost or not lost.
7. During unloading from vessel to truck and during double handling movement all damage bag are to
be considered at the account of charterer or consignee for the rebagging.
8. 50% of the freight payable within one banking day after the contract has been signed. Balance of
50% should be paid prior to vessel loading at load port/anchorage.

9. This contract shall be performed subject to the Title Condition in the Gencon 94 as applicable
except those otherwise amended by the conditions contained in box no. 21 of this contract.
10. Any case arising out of this contract shall be filed at the Regional Trial Courts of Makati City.
