A RESOLUTION ADOPTING THE INTERNAL RULES OF PROCEDURES


OF THE SANGGUNIANG BARANGAY OF _______________________, VIRAC, CATANDUANES

WHEREAS, the Sangguniang Barangay of ______________________ of the Municipality of Virac, Catanduanes, is a legislative body duly
organized pursuant to law for the enactment of ordinances and the passage of resolutions for its governance;

WHEREAS, pursuant to the provisions of Republic Act No. 7160, known as “The Local Government Code of 1991” Sec.50, local
Sangguniang bodies have the inherent right and obligation of adopting its own rules of procedure for the proper discharge of
legislative functions;

WHEREAS, in the maintenance of good order in the Sanggunian deliberations, it is necessary that specific rules be adopted and
enforced in the interest of effective legislation;

WHEREAS, in order to regulate and at the same time adapt with the changes in the local governance, the Sangguniang Barangay
recognizes the need for the updating and adoption of its “Internal Rules of Procedures”;

NOW THEREFORE, BE IT RESOLVED as it is hereby resolved by the Sangguniang Barangay of ___________________. Virac, Catanduanes to
adopt the following Internal rules of Procedures to govern its conduct and deliberations:

RULE I – MEMBERSHIP OF THE SANGGUNIANG BARANGAY

Section 1. Composition - The Sangguniang Barangay of ________________________ shall be composed of the Punong Barangay as
Presiding Officer, seven (7) Sangguniang Barangay Members (Councilmen) & the SK Chairperson as ex-officio member elected at
large, as members. The following are the duly elected and qualified members of the Sangguniang Barangay of San Andres.

Section 2. Term of Office - The term of office by the members of the Sangguniang Barangay of ___________________________ shall be two
(2) years, which shall commence at noon of November 15, 2023

Section 3. Oath or Affirmation - All the members of the Sangguniang Barangay shall take an oath or affirmation in the prescribed
form, duly subscribed before a person authorized to administer oath before assumption to office.

Copies of the oath or affirmation shall be filed and preserved in the DILG Municipal Office, Office of Municipal Mayor and the files of
the Barangay Secretary.

Section 4. Honoraria - All the members of the Sangguniang Barangay shall have the privilege and entitled to receive honoraria for
each session attended, the amount of which shall be determined from time to time by the Punong Barangay with the concurrence of
the majority members of the Sanggunian during the preparation of Barangay Annual Budget Allocation for each calendar year.

Section 5. Powers, Duties and Functions - The powers, duties and functions of the Sangguniang Barangay are as prescribed under
Section 391 of the Local Government Code, as follows:

a. Enact ordinances as may be necessary to discharge the responsibilities conferred upon it by law or ordinance and to
promote the general welfare of the inhabitants therein;
b. Enact tax and revenue ordinances, subject to the limitations imposed in this Code;
c. Enact annual and supplemental budgets in accordance with the provisions of this Code;
d. Provide for the construction and maintenance of barangay facilities and other public works projects chargeable to the
general fund of the barangay or such other funds actually available for the purpose;
e. Submit to Sangguniang Bayan such suggestions or recommendations as it may see fit for the improvement of the barangay
or for the welfare of the inhabitants thereof;
f. Assist in the establishment, organization, and promotion of cooperative enterprises that will improve the economic
condition and well-being of the residents;
g. Regulate the use of multi-purpose halls, multi-purpose pavements, grain or copra dryers, patios and other post-harvest
facilities, barangay waterworks, barangay markets, parking areas or other similar facilities constructed with government
funds within the jurisdiction of the barangay and charge reasonable fees for the use thereof;
h. Solicit or accept monies, materials and voluntary labor for specific public works and cooperative enterprises of the
barangay from residents, land owners, producers and merchants in the barangay; monies from grants-in-aid, subsidies,
contributions, and revenues made available to the barangay from national, provincial, city or municipal funds; and monies
from other private agencies and individuals: Provided, however, that monies or properties donated by private agencies and
individuals for specific purposes shall accrue to the barangay as trust fund;
i. Solicit or accept, in any or all the foregoing public works and cooperative enterprises, such cooperation as is made
available by national, provincial, city, or municipal agencies established by law to render financial, technical, and advisory
assistance to barangay and to barangay residents: Provided, however, That in soliciting or accepting such cooperation, the
Sangguniang Barangay need not pledge any sum of money for expenditure in excess of amounts currently in the barangay
treasury or encumbered for other purposes;
j. Provide compensation, reasonable allowances or per diems as well as travel expenses for Sangguniang Barangay members
and other barangay officials, subject to the budgetary limitations prescribed under Title Five, Book II of this Code:
Provided, however, that no increase in the compensation or honoraria of the Sangguniang barangay members shall take
effect until after the expiration of the full term of all members of the Sangguniang Barangay approving such increase;
k. Hold fund-raising activities for barangay projects without the need of securing permits from any national or local office or
agency. The proceeds from such activities shall be tax-exempt and shall accrue to the general fund of the barangay.
Provided, that in the appropriation thereof, the specific purpose for which such fund-raising activity has been held shall be
first satisfied. Provided, further, that no fund-raising activities shall be held within a period of sixty (60) days immediately
preceding and after a national or local election, recall, referendum, or plebiscite: Provided, finally, That said fund-raising
activities shall comply with national policy standards and regulations on morals, health, and safety of the persons
participating therein. The Sangguniang Barangay, through the Punong Barangay, shall render a public accounting of the
funds raised at the completion of the project for which the fund-raising activity was under-taken;
l. Authorize the Punong Barangay to enter into contracts in behalf of the barangay, subject to the provisions of this Code;
m. Authorize the Barangay Treasurer to make direct purchases in an amount not exceeding One thousand pesos (P1,000.00)
at any one time for the ordinary and essential administrative needs of the barangay;
n. Provide for the administrative needs of the Lupong Tagapamayapa and the Pangkat ng Tagapagkasundo;
o. Provide for the organization of community brigades, barangay tanod, or community service units as may be necessary;
p. Organize regular lectures, programs, or fora on community problems such as sanitation, nutrition, literacy, and drug abuse,
and convene assemblies to encourage citizen participation in government;
q. Adopt measures to prevent and control the proliferation of squatters and mendicants in the barangay;
r. Provide for the proper development and welfare of children in the barangay by promoting and supporting activities for the
protection and total development of children, particularly those below seven (7) years of age;
s. Adopt measures towards the prevention and eradication of drug abuse, child abuse, and juvenile delinquency;
t. Initiate the establishment of a barangay high school, whenever feasible, in accordance with law;
u. Provide for the establishment of a non-formal education center in the barangay whenever feasible, in coordination with the
Department of Education, Culture and Sports;
v. Provide for the delivery of basic services; and
w. Exercise such other powers and perform such other duties and functions as may be prescribed by law or ordinance.

Section 6. The Sangguniang Barangay Members.- Every member of the Sangguniang Barangay shall:

a) Assist the Punong Barangay in the discharge of his duties and functions;
b) Act as peace officers in the maintenance of public order and safety; and
c) Attend all the sessions of the sanggunian unless he is prevented from doing so by reason of sickness and other unavoidable
circumstances provided that, as a general rule, previous notice thereto shall be sent to the Sanggunian thru the Presiding
Officer or the secretary;
d) Participate in meetings of his committees;
e) Participate in the discussion of any business during sangguniang barangay session;
f) Propose measures for deliberation and adoption of the sangguniang barangay;
g) As a general rule, vote on every question or proposed measures being voted upon by the sanggunian. Abstentions may
only be allowed if it can be shown that the member concerned has a pecuniary interest, either directly or indirectly, on the
matter being acted upon by the body.
h) Observe proper deportment and decorum during sessions.
i) Perform such other duties and functions as the Punong Barangay may delegate.

RULE II – THE PRESIDING OFFICER

Section 7 -The Presiding Officer. - The Punong Barangay shall be the Presiding Officer of the Sanggunian Barangay. He shall:
a) Preside over the sessions of the Sanggunian;
b) Preserve order and decorum during sessions and exact from all present due respect and proper deportment,
prevent disturbances and disorders, and to order the session hall cleared of any or all persons with improper
behavior.
c) Decide all questions of order, subject to appeal by any member in accordance with these rules;
d) Sign all acts, ordinances, resolutions, memorials, writs, warrants and subpoena issued by, or upon order of the
Sanggunian;
e) Declare the session adjourned to some other time or place in case of serious disorders and of great emergency.
Section 8. Right to Vote – The Presiding Officer shall not be entitled to vote, except to break a tie.

Section 9. Acting Temporary Presiding Officer – (a) In the event of inability of the Punong Barangay to preside over a regular or
special session, an election from among the members constituting a quorum shall be made to elect an Acting Temporary Presiding
Officer. Should there be a designation made by the Punong Barangay, the designation should prevail. (b)The Temporary Presiding
Officer shall not vote even in case of a tie but shall certify within ten (10) days from their passage all ordinances adopted and
resolutions enacted by the Sanggunian in a session over which he temporarily presided.

RULE III – THE SECRETARIAT

Section 10. The Secretariat - There shall be a Secretary to the Sanggunian, the Barangay Secretary, who shall be appointed by the
Punong Barangay, with the concurrence of the majority of all the members of the Sangguniang Barangay. In addition to his powers
and duties as prescribed in the Local Government Code of 1991, the Barangay Secretary shall:

a) Attend sessions of the Sangguniang Barangay, committee hearings and keep a journal and minutes of all its proceedings;
b) Keep the seal of the Barangay and affix the same with his/her signature in all ordinances, resolutions, and other official acts
of the Sanggunian and present the same to the Presiding Officer for his signature and approval;
c) Forward to the Sanggunian Bayan for review copies of ordinances and resolutions enacted by the Sanggunian Barangay
and duly certified by the Presiding Officer within ten (10) days after its enactment;
d) Record in a book kept for the purpose, all ordinances and resolutions enacted or adopted by the Sanggunian, with the
dates of passage and posting thereof;
e) Upon request, furnish certified true copies of all records and documents in his charge not otherwise classified as
confidential, upon payment to the Barangay Treasurer of the fees prescribed by law, ordinance or by the Punong Barangay.
f) Transmit to the committees all matters referred to them by the Sanggunian;
g) Prepare and certify the minutes of the session of the Sangguniang Barangay; and
h) Translate into the dialect used by the majority of the people of the barangay, the gist of all ordinances immediately after their
approval, and have the translation posted, together with the original at the main entrance of the Barangay Hall and three
(3) other conspicuous public places in the barangay;

RULE IV – SESSIONS and QUORUM

Section 11. Regular Sessions – The Sangguniang Barangay shall hold its regular session twice a month. The regular sessions shall
be held on the ___________________ and ______________________ of each month at the Barangay Hall and shall start at exactly 8 AM;

Section 12. Special Sessions - As often and necessary, when public interest so demands, special sessions may be called by the
Presiding Officer or a majority of the members of the Sangguniang Barangay, subject to the limitations on compensation and other
emoluments as maybe provided by law.
 In “Special Sessions”, a written notice to the Sanggunian members, stating the date, time and purpose of the session, shall
be served personally or left with a member of his household at the place of residence at twenty-four (24) hours before the
special session is held. Unless otherwise agreed upon by two-thirds (2/3) votes of the members of the Sanggunian
members present, there being a quorum, no other matters may be considered at a special session except that stated in the
notice.

Section 13. Session Open to Public. – (a)All Sanggunian sessions or meetings of any committee thereof shall be open to the public
unless a closed or executive session is decided or ordered by affirmative votes of the majority Sanggunian members present, there
being a quorum, in the public interest or for reasons affecting the dignity of the Sangguniang Barangay or any of its member, or
when confidential matters are being considered.

Section 14. Executive Session - On a motion to hold a closed session duly approved, the Presiding Officer shall direct the session
hall cleared and doors closed. Only persons specifically authorized by the Sangguniang Barangay shall be admitted to the closed or
executive session. They shall preserve the secrecy of whatever may be read or said at the closed session.

Section 15. Quorum. – (a) A majority of all the members of the Sangguniang Barangay shall constitute a quorum to transact official
business. Should a question of quorum be raised during a session, the Presiding Officer shall immediately direct the Barangay
Secretary to call the roll of the members and thereafter announce the result forthwith.

Section 16. Absence of Quorum. – (a) Where there is no quorum in a given session, the Presiding Officer may declare a recess until
such time a quorum is constituted, or a majority of the members present may adjourn from day to day and may compel the
immediate attendance of any member absent without justifiable cause by designating a member of a sanggunian, to be assisted by a
member of the police force assigned in the area, to arrest the absent member and present him/her at the session.

(b) If there is still no quorum, despite the foregoing, no business shall be transacted. The Presiding Officer, upon proper motion duly
approved by the members present, shall then declare the session adjourned for lack of quorum.

Section 17. Call To Order. - The Presiding Officer shall open the session by calling the Sanggunian to order.
On each session day, the Sanggunian shall conduct a one-minute prayer or meditation, or at the discretion of the Presiding Officer, an
invocation by a Sanggunian member designated by him/her.

Section 18. Adjournment of Session – No session shall be suspended or adjourned except when so directed by the Sanggunian by a
majority vote;
Section 19. Suspension - The Presiding Officer may, in his discretion, declare a recess in short intervals or suspend or adjourn the
meeting in case of emergency, or other valid reasons.

Section 20. Restrictions. – No two sessions, whether regular or special, may be held in a single day.

RULE V – THE STANDING COMMITTEES

Section 21. Standing Committees. – the Sanggunian shall have the following standing committees.

a) Committees on Appropriation to which shall be referred all matters or questions pertaining to or connected with the following:

1. local taxes, fess and charges


2. Loans and other sources of local revenues
3. Annual and supplemental budgets
4. Appropriations ordinances
5. All other matters related to local taxation and fiscal administration

Section 22. Membership and Officers. - Each Standing Committee shall be composed of a Chairman and at least two (2) members.
The Chairman shall either be elected by the members of the Sanggunian or be appointed by the Punong Barangay with the
authority of the council. The Chairman shall select the two (2) members of his committee.

Section 23. Limitations. – (a) No Sanggunian member shall be Chairman of more three (3) Standing Committees.
(b) The Presiding officer shall not be a member of any standing committee but may be designated by the body as Chairman of a
Special Committee created for a particular purpose not involving policy making. No member of a committee shall vote in any matter
which he has a substantial pecuniary interest, whether direct or indirect.

Section 24. Special Committees. – The Sangguniang Barangay may organize special committees as it may deem necessary. The
officers and members of special committees shall likewise be elected by the majority of all the Sanggunian members. It shall cease as
soon as the purpose has been obtained. It is subject to the same rules governing standing committees.

Section 25. Vacancy. - Whenever a vacancy occurs or is declared to exist in any of the committees, the same shall be filled-in by a
majority vote of all the members of the Sanggunian or by appointment of the Punong Barangay with the authority of the council.

Section 26. Committee Meeting or Hearing. – (a) Committee meetings, conferences, or hearing shall be held at the session hall of
the Sanggunian or, whenever necessary and if the interest of the public demands, in any other place as may be designated by the
majority of its members.

(b) The Committee shall determine the frequency of their regular meetings. Special Meetings may be called by their Chairman or
majority of the members upon due notice, including the agenda of the meeting served in advance upon each member. Majority of all
the Committee may authorize a small number to conduct a public hearing on draft ordinances or resolutions pending consideration
before it.

S e c t i o n 2 7 . C o m m i t t e e R e p o r t s a n d O r d e r s . – (a)Committee reports or orders on any measure shall be reported to the


Sanggunian including every matter referred to the Committee by the Presiding Officer. When reporting out a draft ordinance or
resolution, copies thereof shall be furnished the Sanggunian Members, preparatory to its consideration on the floor.

(b)When a committee submits a report, all its members are presumed to have concurred in the report and shall be precluded from
opposing the same, unless his objection thereat has been entered or made on record during the Committee deliberation or unless
satisfactory explanation is made by the member concerned.

(c) A committee which failed to submit a report on a particular matter assigned to it may be discharged by the Presiding Officer
from further consideration of said matter and may assign it to the body for immediate disposition.

(d) The reports together with any concurring and/or dissenting opinions, shall be filed with the Secretary to the Sanggunian who
shall include the same in the next order of business.

SECTION 28. Action on Report – The report upon inclusion in the Order of Business, shall be submitted for approval by the
Sanggunian.

RULE VI - ORDER AND CALENDER OF BUSINESS

Section 29. Order of Business. - The Order of Business of the Sangguniang Barangay for every session shall as follows:

a) Call to Order
b) One Minute Prayer/Meditation
c) Roll Call and Certification of a Quorum
d) Reading and Approval of the Minutes of the Previous Session
e) First Reading / Referral to Committee of Proposed Ordinances, Resolutions, petitions and other measures
Committee Reports for appropriate actions/recommendation
f) Calendar of Business:
1. Unfinished Business
2. Business for the Day
3. Unassigned Business

h) Proposed Ordinances/Resolutions for Third Reading


i) Committee Reports
j) Other matters/Announcements
k) Adjournment

Section 30. Approval of Minutes. - The Minutes of each session shall be submitted to the Sanggunian for approval. The Secretary
will read the minutes of the previous meeting for approval of the Sanggunian.

Section 31. Calendar of Business. - The Calendar of Business consists of:

a) Unfinished Business. - Business being considered at the time of adjournment of previous session; its consideration shall
resume until such unfinished business is disposed of. Thereafter the Presiding Officer shall call for business of the day.

b) Business for the Day. - Proposed ordinances, resolutions and other measures set on the calendar for consideration on
that day, to be considered in the order in which they are listed in the calendar.

c) Unassigned Business – All other business/proposals/measures not falling to any of the foregoing classification but also
pending consideration of the body. Any matter not included in the calendar of business may be set for consideration on
motion of the Floor Leader duly seconded by any member of the Sanggunian. The calendared item of business shall
contain a brief description of each item of business to be taken up during the session, indicating the source in the
communications, endorsements, position, memorials, and memoranda, the name of author or authors, in the case of
motions, resolutions and ordinances, and the committee to which they have been referred.

SECTION 32. Committee Reports – Committee Reports shall be considered in the order they are listed in the Rules of the
Sanggunian and by special committees, in the order of their creation unless otherwise directed by the Presiding Officer. The report,
consisting of the findings and recommendations of the committee, shall be made by its Chairman or, if he dissents, with the majority
opinion, by a committee member duly designated for the purpose.

SECTION 33. Third and Final Reading – Draft ordinances, resolutions and other legislative matters scheduled for the third and
final reading shall be called in the order set forth in the calendar of Business and shall be considered in the manner prescribed
hereafter.

Section 34. Appearance before the Sangguniang Barangay – Only persons with prior permission from the Barangay Secretary
shall be allowed to appear and speak before the Sanggunian

Section 35. Urgent matters – urgent matters which may be brought to the attention of Sangguniang Barangay, the delay in the
consideration of which shall prejudice activities of the government, may be discussed in the session without being listed in the
agenda.

SECTION 36. Privilege Hour – On regular meetings and after determination of a quorum, there shall be a privilege hour. Any
member may speak on any matter of general or collective interest and/or personal privileges. If more than one member desires to
make use of his privilege, the first to apply, either in writing in the office of the Secretary, or verbally in open session, shall be given
precedence. The privilege shall not be more than one hour. If after a member has finished, sufficient time is left of the hour, the
second member who asked to speak may do so, and so on successively, until the hour is consumed.

RULE VII- LEGISLATIVE PROCESS

Section 37. Ordinances and Resolution. Distinguished legislative actions of a general and permanent character shall be enacted in
the form of ordinances, while those which are of temporary in character, ministerial or administrative in nature, as well as, those
which are expression of sentiments of the Sanggunian shall be passed in the form of resolutions. Matters relating to proprietary
functions and to private concerns shall be acted upon by resolution.

SECTION 38. Draft Ordinances/Resolutions – Every ordinance and resolution presented for consideration shall be respectively
nominated as “Draft Resolution” and upon approval, each shall be called “Provincial/Municipal Ordinance” or “Provincial/Municipal
Resolution”, as the case maybe.

SECTION 39. Essential Parts of ordinances and Resolutions – Draft ordinances and resolutions shall be proposed in writing and
shall contain an assigned number, a title or caption, an enacting or ordaining clause and the date of its effectivity. They shall be
accompanied by a brief explanatory note containing the justification for its approval, signed by the author and submitted to the
Secretary who, with prior approval of the Presiding Officer, shall report them to the Sanggunian for prior disposition.

SECTION 40. Procedure in Enacting Ordinances/Resolutions – Before a draft ordinance or resolution be finally enacted it shall
undergo three (3) readings as follows:

a) First Reading – Which shall consist of the reading by the Secretary of the title of the draft ordinances or resolutions and
name of its author or authors, after which it shall be referred by the Presiding Officer to the appropriate Committee or
Committees without debate.

Whenever a measure covers subject matters falling within the jurisdiction of more than one committee, the same shall be
referred to the committee within whose jurisdiction the principal subject matters falls; provided, however, that measures
entailing appropriations of funds embodying tax revenue proposals shall be referred, respectively, to the Committees on
Budget and Appropriation and on Ways and Means, provided further, that the Committee which requires original
jurisdiction on any measure shall be mainly responsible for submitting and incorporating therein the appropriate
recommendation of the Committee on Budget and Appropriation or the Committee on Ways and Means, as the case may be.

b) Second Reading – At which the draft ordinances or resolutions after having been sponsored on the floor by the committee
Chairman or by any committee member designated for the purpose shall be read in full and in the manner recommended by
the committee. Debates and/or amendments are hereby allowed.

c) Third and Final Reading – At which no debate or amendments shall be allowed, but the title of the draft ordinance or
resolutions shall be read and the question upon its passages shall be immediately taken. Unless the resolution partakes of
the nature of an ordinance or decided otherwise by a majority of all the members present, it need not go through and third
reading for its final consideration.

SECTION 41. Erroneous Referral – (a) An erroneous referral of a proposed ordinance or resolution maybe corrected any day after
the approval of the minutes. (b) Only the Chairman of the Committee claiming jurisdiction over the proposed ordinance or
resolution, may move that the referral be declared erroneous, and ask for its correction; however, the Presiding Officer may motu-
propio rectify an erroneous referral.
SECTION 42. Consolidation or Substitution of Draft Ordinances/Resolutions – Draft ordinance or resolution may be considered
or substituted by the committee concerned and all its members approving the same shall be considered co-authors thereof, in the
order of the names shown therein.

Section 43. Period To Report. - The Committee shall submit a report on the proposed ordinance or resolution within thirty (30)
days after it has been referred to it.
If the committee report on a proposed ordinance or resolution is favorable it shall be included in the Calendar of Business.

If the Committee action on a proposed ordinance or resolution is unfavorable, it shall be laid on the table and, within ten (10)
calendar days, notice of the action taken will be furnished to the author/s concerned stating the reasons for such action. Provided,
that within five (5) calendar days after receipt of the notice, the Sanggunian may consider the Committee recommendation.

Section 44. Urgent Measures. - – Any legislative matter which is certified by the Punong Barangay as urgent in writing, whether or
not it is included in the Calendar of Business may, with the concurrence of a majority vote of the Sanggunian, be presented and
considered by the Sanggunian in the same session without need of suspending the rules.

The Sanggunian likewise, may on motion made by the Committee Chairman or Vice-Chairman, may certify as urgent in any
resolution or ordinance upon concurrence by the majority of all the members present, immediate action thereof, shall be in order.

If said motion is approved, the Sanggunian shall forthwith prepare a detailed timetable fixing the date on or before which the
proposed ordinance or resolution must be reported by the Committee concerned, the number of days or hours to be allotted to the
consideration of the measure, and the date or hour at which proceedings must be concluded and final vote on said measure taken.

SECTION 45. Distribution of Copies after Second Reading – The Secretary shall prepare copies of the draft ordinance or
resolution in the form it was passed on second reading and shall distribute to each member of the Sanggunian a copy thereof at least
two (2) days before it is voted upon for final approval except if the measure has been certified by the Punong Barangay, or decided
by the Sanggunian, as urgent, in which case it may be voted for final voting immediately after second reading.

SECTION 46. Substantive Motions – Motions may be presented orally or in writing provided however, that any motion which, in
the opinion of the body, may be acted upon without reference to any committee may be considered immediately for final action. An
urgent motion, substantive in character and presented orally shall, if approved, be reduced into writing by the Secretary in
resolution and ordinance form, as the case maybe.

Section 47. Approval of Ordinances. – Every ordinance enacted by the Sanggunian shall be approved by the majority of all its
members.

Section 48. Attestation by the Punong Barangay. - Every ordinance enacted or resolution passed by the Sangguniang Barangay
shall be forwarded to the Punong Barangay for attestation. The Punong Barangay shall affix his/her initials on each and every page
of the ordinance or resolution and the word “ATTESTED” shall appear with his/her signature on the last page thereof.

Section 49. Review of Barangay Ordinances by the Sangguniang Bayan. - Within ten (10) calendar days after its approval, the
Sangguniang Barangay shall furnish copies of the Barangay Ordinance to the Sanggunian Bayan for review, as to whether the
Ordinance is consistent with law and with Municipal Ordinances.

Failure on the part of the Sangguniang Bayan to take action on any Barangay Ordinance within thirty (30) calendar days from receipt
thereof, except in the caase of appropriation ordinances where the review period is 60 days, said ordinance shall be presumed
consistent with law and with municipal ordinances and, therefore, valid.

If within the review period, the Sangguniang Bayan finds a certain Barangay Ordinance inconsistent with law or municipal
ordinances, the Sangguniang Bayan shall return the said ordinance with its comments and recommendations to the Sangguniang
Barangay for adjustment, amendment or modification, in which case, the effectivity of the ordinance shall be deemed suspended.

Section 50. Enforcement of Disapproved Ordinances/Resolutions. - Any attempt to enforce, promulgate or execute any
ordinance, resolution or executive order after the disapproval thereof shall be a sufficient ground for the suspension or dismissal of
the official making such attempt.

Section 51. Effectivity of Ordinances or Resolutions. - Unless otherwise stated in the ordinance or resolution, the same shall take
effect after the lapse of ten (10) calendar days from the date a copy thereof is posted in a Bulletin Board at the entrance of the
Barangay Hall and in at least two (2) other conspicuous places in the barangay, such as the public market, church or chapel.

Section 52. Posting. Not later than five (5) calendar days after the enactment of the ordinance or passage of the resolution, the
Sangguniang Barangay Secretary shall cause the posting thereof with a copy translated in the dialect used by the majority of the
people in the area, and shall record such fact in the book kept for the purpose, stating the dates of approval and posting thereof.

Section 53. Approval of Resolution. - A resolution shall be pass in the same manner prescribed for ordinances, except that it need
not go through several readings for its final consideration unless decided otherwise by a majority of all the Sanggunian members.

Section 54. Majority Requirement. - No ordinance or resolution enacted/passed by the Sangguniang Barangay shall be valid unless
approved by a majority of all the members of the Sanggunian.

Section 55. Special Provisions on the Budget Ordinance. - The Sangguniang Barangay shall in no case, increase the appropriation
of any project o program of the barangay over the amount submitted by the Punong Barangay in his/her budget proposal.
RULE VIII – THE MINUTES

SECTION 56. The Sanggunian shall keep the minutes of its proceedings which shall comprise a succinct and exact account of the
business transacted and the action taken thereon. The minutes must clearly show the following:
- Nature of the meeting, whether regular or special;
- Date, time and place of the meeting;
- Members present and absent;
- Whether minutes of previous meetings were approved;
- Every resolution and ordinance, in full;
- Nominal voting;
- All main motions, points of order and appeals, whether sustained or lost;
- Note/message of the Punong Barangay, in full; and Time of adjournment

SECTION 57. Original and Subsequent Copies – The original copy of the minutes shall be signed by the members of the
Sanggunian present at the meeting, showing those who voted for or against its approval. Each copy of the minutes must be signed by
the Presiding Officer and the Secretary.

SECTION 58. Reading and Approval – The minutes of every meeting shall be read and approved by a majority of the Members
present at the meeting at which they are read and, if necessary, corrected by the same vote or by general consent. The reading of the
minutes shall not be interrupted or suspended except by unanimous consent of the body.

RULE IX - DECORUM AND DEBATE

Section 59. Manner of Addressing the Chair. - When a Sanggunian member desires to speak, he/she shall rise and respectfully
address the Chair, “Mister/Madam Chairman” or “Mister/Madam Presiding Officer”.

Section 60. Recognition of Member to Speak. - When two or more members rise at the same time, the Presiding Officer shall
determine and recognize the member who is to speak first.

Section 61. Time Limit for Speeches. - No Sanggunian member shall occupy more than fifteen (15) minutes in debate on any
question or speak more than once on any question without leave of the Sangguniang Barangay, except as hereinafter provided. The
period of interpellation shall not be counted against the time of the member speaking.

Section 62 . Decorum to Open and Close Debate. - In all cases, the member who has obtained the floor shall confine himself to the
question under debate, avoiding personalities. He/She shall refrain from uttering words or performing acts which are inconsistent
with decorum.

If it is requested that a member be called to order for words spoken in debate, the member making such request shall indicate the
words excepted to, and they shall be taken down in writing by the Sangguniang Barangay Secretary and read aloud. The member
who uttered such words shall not be held to answer, nor be subject to censure by the Sangguniang Barangay if further debate or
other business has intervened.

Section 63. Conduct During Sessions. - During any session, the Sanggunian members shall be in proper attire and observe proper
decorum. While the Presiding Officer is addressing the Sangguniang Barangay or putting a question, no member shall walk out or
cross the session hall. All cell phones shall be on a silent mode.

Section 64 – SMOKING IN THE SESSION HALL IS STRICTLY PROHIBITED – Smoking inside the session hall shall not be permitted
while in session.

Section 65 – DRINKING IN SESSION SHALL NOT BE PERMITTED – Drinking any intoxicating substances during session is
prohibited. Sanggunian member who is under the influence of liquor shall not be admitted in any regular or special session of the
Sanggunian.

Members found to be heavily, that is a member who consumed alcohol at least six hours before the meeting. Hang-over is considered
intoxicated but not drunk, intoxicated before the session shall not be allowed to speak during the deliberation and his/her right to
vote be suspended for the duration of the meeting.

RULE X – PARLIAMENTARY PROCEDURE

Section 66. Motions and their precedence

a) Privilege and Subsidiary Motions – When the questions is under debate, no motion shall be entertained except the following
and in the order in which they appear below.

1. Motion to adjourn
2. Motion to declare a recess
3. Motion to postpone temporarily
4. Motion to postpone on a certain day
5. Motion to refer to the corresponding committee
6. Motion to amend the main motion
7. Motion to postpone indefinitely the consideration of any business

b) Question of privilege – Questions relating to the rights and privileges of the Sangguniang Barangay or to any to its members,
shall take precedence over all motions except motions relating to adjournment and recess. This may involve the following:

1. Those relating to the organization of the Sangguniang Barangay


2. Those relating to the comfort of the members of the sanggunian, like seating, lighting, ventilation and other inconveniences
of the session hall
3. Those relating to the freedom from noise and conduct of other persons inside the session hall
4. Those relating to the punishment of a member for disorderly conduct or other offense.

c) Incidental motions – The following motions shall take precedence of any motion, to which they are incidental and must be
decided before any other business is taken up.

1. Point of Order – Any Sanggunian Barangay member may interrupt a speaker to bring to the attention of the
presiding officer any matter involving an error in procedure or violation of the rules
2. Parliamentary Inquiry – Any request for information as in order if they are pertinent to a pending question
3. Withdraw a motion – A motion by the sponsor requesting of the removal of his main motion from the
consideration of the sanggunian shall be in order before its amendment and before the decision is made thereon
4. Suspend the rules – the rules shall be suspended when a motion presented to that effect is approved by two-
thirds of the members present

All foregoing motions are not debatable.

Section 67. Voting – No motion except in the presence of a quorum shall be entertained during the voting. Any member may explain
his vote when voting for the debatable motion. When the motion is not debatable, no other remarks will be entertained by the chair
when a member cast his vote.

On a vote where affirmative and negative are equal in number, the motion shall be declared lost. If a tie has taken place, the Punong
Barangay may, at his discretion, cast the deciding vote.

A two-thirds (2/3) vote is required to pass any of the following motions:

(a) to limit, extend or close a debate


(b) To amend any part of the adopted rules
(c) To suspend the rules
(d) To suspend or recommend the expulsion of any member for cause.

No member could be compelled to vote, he may no to sustain. The motion to reconsider can be made only the member who voted on
the prevailing side. Any member who abstained from voting shall no right to ask the reconsideration

No member can vote on a question in which he has direct or personal pecuniary interest

Section 68 – A Tie On An Appeal – a tie vote on appeal from the ruling of the chair sustains the decision of the chair.

Section 69– Who May Vote – When a motion, report or proposed measure is adopted or lost, it shall be in order for a member who
votes with the majority to move for the reconsideration thereof on the same or succeeding session day. Such motion shall take
precedence over all other questions, except a motion to adjourn, to raise a question or privilege and call to order.

Section 70 – Recording The Motion – Every motion shall be entered in the minutes with the name of the member making it, unless
it is withdrawn on the same day.

Section 71 – Reading And Withdrawal Of Motions – When a motion is made, the presiding officer shall state it before being
debated. Except as herein otherwise provided, a motion may be withdrawn anytime before its approval or amendment.

Section 72 – Precedence Of Motion – When a question is under debate, no motion shall be entertained except to adjourn, raise a
question of privilege, declare a recess, lay on the table, or postpone to a certain day (which motions shall be decided without a
debate), refer, amend or postpone indefinitely (which motions shall be decided subject to five minute rule). Said motions shall have
precedence in the foregoing order. No motion to postpone to any certain day, or refer or postpone indefinitely, having failed passage,
shall again be allowed on the same day.

Section 73 – Amendments – When a motion or proposition is under consideration, a motion to amend and a motion to amend the
amendment shall be in order. It shall be in order to offer further amendment by substitution, but it shall not be voted upon until the
original motion or proposition is perfected. Any of said amendment may be withdrawn before a decision is made thereon.

Section 74– Rider Prohibited – No motion or proposition on a subject different from that under consideration shall be allowed
under the color of amendment.
Section 75– Motion to Cover One Subject Matter – No motion shall cover more than one subject matter.

Section 76– Amendment Of Title – Amendments to the title of a proposed ordinance or resolution shall not be in order until after
the text thereof has been perfected. Amendments to the title shall be decided without debate.

Section 77 – Call To Order – A motion to read and part of the rules is equivalent to a call to order and take precedence over any
motion other than to adjourn.

a.) Those affecting the rights of the Sanggunian: its safety, dignity and, the integrity of the members.

b.) Those affecting the rights, reputation and conduct of the members’ individuality, in their capacity as such members subject to
five minute rule, questions of privilege shall have precedence over all questions, except a motion to adjourn.

Section 78 – Privilege Question – Privilege questions are those motions or subject matters, which, under the rules, take
precedence over other motions and subject matters.

Section 79. Suspension of Rules - Only the Chairman of the Committee on Rules can move for the Members, a quorum being
present.

Section 80. Interruption of Motion. - When a motion to suspend the Rules is pending, one motion to adjourn may be entertained. If
it is lost, no similar motion shall be entertained until the vote is taken on the motion to suspend.

Section 81. Effect of Suspension. - If the Sanggunian members vote to suspend the Rules, it shall forthwith proceed to consider the
measure. A two-thirds (2/3) vote of the members present shall be necessary for the passage of said measure, a quorum being
present.

RULE XI – DISCIPLINE OF MEMBERS

Section 82. Absences and Disorderly Behavior

a) Any member of the Sanggunian who incurred absences during the sessions of the Sangguniang Barangay, may be deprived of the
honorarium there being no services actually rendered. If he/she will be absent for one session in one month, he/she is not entitled
to receive the proportionate amount of honorarium for services actually rendered. If he/she will be absent in both sessions for one
month, he /she will be deprived of his/her total honorarium for that month.

b) Any Sangguniang Barangay member who fails to attend any of following compulsory activities of the barangay, either with or
without excuse and without justifiable reason, shall pay a fine in the amount of PhP________________, viz:

(1) Officer of the Day / Office Duty


(2) Barangay Assemblies
(3) Other mandated barangay and municipal activities /celebration

c) Any Sanggunian member who incurred unauthorized absences for four (4) consecutive sessions of the Sanggunian may be
subjected to disciplinary action, in which case, a verified complaint may be filed before the Sangguniang Bayan of the municipality of
Bagamanoc, Catanduanes pursuant to Section 61 9a) of the Local government Code.

d) The Sangguniang Barangay, upon the recommendation of its Committee on Rules and Ethics and with the concurrence of two-
thirds (2/3) of all Sanggunian Members, may punish any Sanggunian member for disorderly behavior and suspend or exclude
him/her from the session.

RULE XII- AMENDMENTS

Section 83. Amendments. - Any portion of these Rules may be amended by a two-thirds (2/3) vote of the Sanggunian members.

RULE XIII - REPEALING CLAUSE

Section 84. Repealing Clause. - All Barangay Ordinances, Resolutions, Rules and Regulations or parts thereof in conflict with the
provisions of this Ordinance are hereby expressly repealed.

RULE XIV - EFFECTIVITY

Section 85. These rules shall take effect on the date of its adoption.
