Paradoxical That Right To Vote Isn't A Fundamental
Right Though Democracy Is An Essential Feature Of
Constitution

Bhim Rao Baswanth Rao Patil V.

K. Madan Mohan Rao & Ors

DECISION: The Supreme Court held that right to vote

is not a fundamental right, though democracy has
been held to be one of the basic features of
Constitution. The Court noted that right to vote has
been termed as a "mere" statutory right. The court
made this observation while hearing an appeal
challenging the refusal of the Telangana High Court to
reject an election petition at the threshold.

Don't grant bail in private cheating cases merely because

accused undertook to deposit money: Supreme Court
reminds courts.

Ramesh Kumar v. State NCT of Delhi

FACTS: The complainant paid an amount of money but the builder
failed to deliver possession leading to a complaint under Section
420 of the Indian Penal Code. To avoid arrest, the appellant sought
bail under Section 438 of the Criminal Procedure Code (Cr.PC).

ISSUE: The High Court granted bail to the appellant and the builder
with certain conditions, one of which required them to deposit
specified amounts of money as a fixed deposit with the trial court,
initially for one year with an automatic renewal clause.

DECISION: The Supreme Court has disapproved of the practice

followed by the Courts to direct deposit of amount as a condition for
granting anticipatory bail for the offence of cheating under Section
420 of IPC.The willingness of the accused to deposit money as bail
condition must be considered only in cases involving public money;
not in private cases.
Persons With Disability Act 1995 Mandated
Reservation in Promotions Too: Supreme Court
Grants Relief to RBI Employee.

Reserve Bank of India v. A.K. Nair and Ors.

FACTS: In 2003, the employee had appeared in the

All-India Merit Test to secure promotion to a Class-l
post. But he fell short of the qualifying marks by 3
marks. He requested relaxation similar to SC/ST
candidates who were eligible for a five-mark
condonation. The RBI stated that there was no
provision for granting grace marks to persons with
disabilities.

ISSUE: The challenge in the petition filed in SC

pertained to securing promotion to the post of
Assistant Manager in the RBI under Persons with
Disabilities (Equal Opportunity, Protection of Rights
and Full Participation) Act, 1995. The 1995 Act did
not contain a provision for reservations in
'promotions' for persons with disabilities appointees,
unlike its successor enactment, the Rights of Persons
with Disabilities Act, 2016 ("2016 Act"), which
enabled the State to do the same.

DECISION: The Supreme Court invoked Article 142 of

the Constitution of India to direct RBI to extend the
benefit of reservation in promotion to an employee
with disability, who was denied the same for a long
time. Justice Dipankar Datta said that it was rather
harsh on the part of the RBI to apply the same
standards for general candidates and those with
disabilities. RBI, as a model employer, ought to have
taken an informed decision in this regard
commensurate with the aspirations of persons with
disabilities.
Rajasthan Premises (Control of Rent and Eviction) Act
1950 Though Eviction Suit Can't Be Filed Before 5 Years
Of Tenancy, Supreme Court Affirms Decree As It Was
Passed After 38 Years

Ravi Khandelwal vs. M/s Taluka Stores

FACTS: The respondent was the tenant of a shop with

appellant as landlord. Later the appellant purchased
that property in 1985. The appellant filed a suit for
eviction in 1985 which was dismissed in 2002 since
section 14(3) of the Act barred suits filed within 5
years of tenancy. The trial court noted that the
premises were leased in 1982.In an appeal in 2004,
the appellant succeeded based on the respondent's
admission that the shop was initially leased in
1958.Therefore, the suit was filed after 5 years of
tenancy which is legally permissible. Thereafter a
second appeal was preferred by respondent before a
single judge of the HC which framed a preliminary
question of maintainability in 2018.

ISSUE: What if an eviction suit is filed within 5 years

of tenancy? Is that barred absolutely? Would a fresh
suit need to be filed after expiry of the period?

DECISION: The Supreme court held that the

objective of section 14(3) of Rajasthan Rent
Control Act, 1950 was to safeguard the interest of
tenants. As per the provision, Eviction suit cannot
be filed by landlord within 5 years of tenancy.
However, the court opined that even though in
this case, the eviction suit was filed within 5
years, 38 years have gone by since then. This
itself would cure the defect in the eviction suit.
In Cheque Dishonour Case, Interim Compensation
Can BE Ordered to Be Paid Only After Accused
Pleads Not Guilty: Supreme Court

Pawan Bhasin v State of UP

FACTS: There was a financial relationship

between the petitioner and the complainant
for which cheques were issued. The complaint
was that in order to satisfy the loan as well as
the benefit, the cheque was given which was
dishonoured. The trial court directed the
petitioner to deposit 10% of the amount of a
dishonored cheque under Section 143A of the
Negotiable Instruments Act, 1881.

ISSUE: Whether in a cheque dishonour case,

Interim compensation can be granted even
before the accused pleads not guilty under
section 143A(1) of NI Act, 1881?

DECISION: The Supreme Court after analyzing

section 143A(1) of the Negotiable Instruments
Act, 1881, held that direction for payment of
interim compensation can only be made after
the accused has pleaded not guilty. The court
held that such orders being passed before the
plea was taken into account is unsustainable
in law.

Guilty Intention' vs 'Guilty Knowledge' : Supreme
Court Explains Fine Distinction Between Two Parts
Of Section 304 IPC

Anbazhagan vs State

FACTS: In this case, the Trial Court had

convicted the accused for the offence of
culpablehomicide not amounting to murder
punishable under Section 304 Part I of the
IPC.The High Court affi rmed the conviction by
dismissing his appeal.

Before the ApexCourt, the appellant-accused

contended that the conviction deserves to be
alteredfrom Section 304 Part I of the IPC to
one under Section 304 Part II of the IPC.

DECISION: While explaining the fine difference

between the two parts of Section 304 of IPC
the bench of Justices B R Gavai and J B
Pardiwala observed that, under the first part,
the crime of murder is first established and
the accused is then given the benefit of one of
the exceptions to Section 300 of the IPC,
while under the second part, the crime of
murder is never established at all.

undertrialprisoners were identifi ed as persons
who were granted bail but were not
releasedfor several reasons. He submitted that
