The High Court of Judicature at Bombay granted interim relief to petitioner Yogaji Ramchandra Mekale in his writ petition against the State of Maharashtra and others. As interim relief, the Court directed that Mekale shall continue in his current service with respondent No. 2 and receive his regular salary, treating him as an absorbed candidate from the date he resumed duties pursuant to a prior Court order. The Court noted that the question of Mekale receiving salary from the date of the earlier interim relief order until he actually resumed duties will be considered at the final hearing of the petition.

1. Rule.
2. By way of interim relief, it was directed that, the petitioner
shall be continued in the service where he is presently working i. e. with the respondent No. 2 and his regular salary be paid to him treating him as absorbed candidate with effect from the date on which he has been permitted to resume the duties in pursuance to the order passed by this Court dated 12th August, 2009.

3. It is needless to state that, the question regarding the payment
of salary to the petitioner from the date on which interim relief was passed by this Court i. e. 21st February, 2008 till the date on which he has been actually permitted to join in pursuance to the order dated 12th August, 2009 will be considered at the final hearing of the petition.
