 What is Contract Farming?

Contract farming is one type of farming which can be described as a contract

or an agreement between a farmer and a buyer. Due to this agreement or
contract between two people, there would be terms and conditions involved
in production as well as marketing. In this type of farming, the farmer will come
to an agreement with the buyer that he would produce the quantities of
particular agricultural products which he has agreed. So, the farmer will need
to produce the promised quantity of the crop at the specified time, which
would be set by the buyer. At the same time, the buyer also needs to provide
the farmer with the necessary inputs required for the farm like preparation of
land, technical aspects etc. He should also make sure that he would be buying
the products.

Contract farming is looking towards the benefits both for the farm-producers as
well as to the agro-processing firms. Producer/farmer

 Makes small scale farming competitive - small farmers can access technology,
credit, marketing channels and information while lowering transaction costs
 Assured market for their produce at their doorsteps, reducing marketing and
transaction costs
 It reduces the risk of production, price and marketing costs.
 Contract farming can open up new markets which would otherwise be
unavailable to small farmers.
 It also ensures higher production of better quality, financial support in cash
and /or kind and technical guidance to the farmers.
 In case of agri-processing level, it ensures consistent supply of agricultural
produce with quality, at right time and lesser cost.
 There would be a continuous flow of the raw material and this happens
without any sort of interruption.
 There would be security in terms of fluctuations in the price of the market.
 The buyer can plan the produce very prior to the season.
 The contract can also be extended to other crops so that there would be a
long-term commitment with the farmer.
 This type of farming will get a good name for the firm as it helps the farmers in
many ways


include its successors, promoters, executors, administrators and assignees)

Second Party is the owner/s of …. Acres of Land

at …., village-……………. He is interested to cultivate (Crop name) commodity
for the Second party.
First party is interested in (Crop name) to be cultivated and produce (Seeds/plant) as
per the Schedule booklet. With the interested of the First party, the Second party has
agreed to cultivate the said commodity in his / their holding of the
Aforesaid land and produce (Production)…..
We, the First party and the Second party both as undersigned agree for the
cultivation of (Crop name) on the land having area …. Acers ,(Crop name) on the
land located in village falling under ……
We shall abide by the rules of this agreement as.

NOW THESE PRESENCES WITNESSETH AND IT IS HEREBY AGREED

BY AND BETWEEN THE PARTIES AS FOLLOWS:
1. Second Party agrees to adopt and abide by instructions / practices in respect of
land preparation, fertilization, pest management, irrigation, harvesting and any other
suggestion made by the First party from time to time and cultivate and produce the
items as per specifications Supplied to the second party .upon finalizing the contract
between both the parties.

2. The Second party agrees to cultivate, produce and deliver the produce to the First
party and the First party agrees to buy the produce from the Second party.

3. First party will provide you facility of supervision up to(Crop name ). Company
will be going to buy your(Production) then company appoint a supervisor for the
period of cutting to purchase
4.The contractual buy-back price of the (Crop name )..( Quantity ) plants / Seeds to be
bought back by the First party from the Second party is fixed at INR …../- R.S. PER
K.G (Production) to be bought back by the first party from the Second party is fixed
at INR …./- R.S. PER K.G. for the …. year. First party will be responsible for
weighing and Transportation of (Production) from Farm at ……..Within the …..year,
Second party have an offer of higher price in open market we are free to trade with
them (there is no compulsion that we have to trade only with First party as it was
earlier conveyed to us) the First party shall entirely educate / update the Second party
with all the technical know-how for cultivation.

5. It is agreed between the parties here to that this agreement is for agricultural
produce,for a period of ……years, beginning from the date of planting …..2021 and
continue up to ….. after the expiry of the said period, this agreement will
automatically come to an end.

6. It is further agreed that it will be the responsibility of the First party to accept the
delivery of freshly produced within 1 months days period at the agreed delivery point.

7. In the event the First party refuses / fails to take the delivery of the contracted
produce for his own reasons, the Second party will grant further 1 month of time to
the First party to try and arrange for sale of the produce in the open market and shall
pay to the Second party .
8. The production estimate given by the company project report is not an actual
quantity of production, it’s an average quantity. The actual quantity will depend upon
the fertility of land and amount of work & care done by the farmer. Second party will
ensure the best quality production to First party any lower grade or not mature
production will not be acceptable.

9. The First party shall make the payment to the Second party, at the rate mentioned
in the contract, within 10 days of receipt of the produce after deducting all the
outstanding advances given to the Second party by the First party for five year of
contract period.

10. The First party or its representatives agree to have regular interaction with the
Second party during the period of contract. Second party will ensure to send latest
video and images of crop on weekly / 15 days or monthly as instructed by First party
from Second party, in case Second party fail to do so First party will not be
responsible for any losses or compensation. The First party and any person with First
party or its representatives/technician at their costs shall have the right to enter the
premises / field of the Second party to monitor farming practices adopted and the
quality of the produce from time to time.

11. It is entirely the responsibility of the Second party to obtain insurance cover at
their own expense for the contracted produce against the risk of losses due to acts of
Gods, destruction of specified assets, loan default and production and income loss
and all other acts or events beyond the control of the parties, such as very low
production caused by the serious outbreak of a disease, epidemic or by abnormal
weather condition, floods,drought, hailstorm, cyclones, earthquakes, fire or other
catastrophes, war acts of Government action existing on or after the effective date of
this agreement which prevent totally or partially the fulfillment of the obligation of
the Second party.

12. The First party hereby agrees to provide advisory services to the Second party
during the period of cultivation and post harvest management as per the particulars
mentioned in the Schedule booklet.

13. Second party shall not knowingly or unknowingly, do or allow to be done, any
sort or type of unauthorized multiplication, for the purpose of selling or cultivating of
the saplings supplied by the First party.

14. The First party will have no rights whatsoever to the Title, Ownership, Possession
of the land/property of the Second party and shall not in any way alienate the Second
party from the land property by any means or either through mortgage, lease, sublease
or transfer the land property of the Second party in any way to any other person /
institution during the continuation of this agreement. however
First party is allowed to place hording &advertising on which Shown that –‘This sight
is under the supervision of AMRITANAAJALI AYURVED (OPC) PVT.LTD..’ at
their own cost.

15. Any Modification, Dissolution, Termination, Cancellation of the Contract shall be

with the consent of both the parties.
16. If party is taking a legal action against the company then informing to the
company is must otherwise the action will not be considered, in such case company’s
Legal Advisor Team will make necessary actions on behalf of company.

17. This Contract as constructed shall be in accordance with and controlled and
interpreted by the laws of the Rajasthan State. The parties here to consent to the
jurisdiction of the state and High court sitting at Udaipur (Raj.).
