AN ORDINANCE PROHIBITING THE SELLING OF REGISTERED AND CERTIFIED


PALAY AND CORN SEEDS IN THE MUNICIPALITY OF IGUIG WITHOUT SEED
CERTIFICATION TAG CONFORMING WITH THE STANDARDS PRESCRIBED BY
THE BUREAU OF PLANT INDUSTRY AND PROVIDING PENALTIES FOR
VIOLATION THEREOF.

WHEREAS, it is essential to revitalize the image of farming as a vocation by increasing


public awareness on the value of farmers in Philippine society and national development;

WHEREAS, it was recognized that the use of high-quality seeds alone. such as
registered and certified seeds. Can contribute additional 5-10 canvas per hectare production;

WHEREAS, there is a need to generate widespread awareness and support for the
implementation of the Rules and Regulations of Rice and Corn Seed Certification Program:

WHEREAS, production of high-quality seeds is being undertaken by authorized seed


companies and individual accredited seed growers who are trained and willing to adhere the
provisions of the production standard set by the certifying agency, the Bureau of Plant Industry;

WHEREAS, seed samples submitted to the Bureau of Plant Industry - National Seed
Quality Control Services (BPI-NSQCS) that pass-through laboratory analysis shall be issued /
provided with corresponding Result of Analysis and Certification Tags as a tangible proof that
the seed stock passes seed certification;

WHEREAS, it has been observed, however, that there are seeds being sold in the
municipality without certification tags or seed label indicating that the product conforms to
standards or quality prescribed by the Bureau of Plant Industry;

WHEREAS, there are also reports that the untagged seeds bought by farmers do not
have the quality of registered or certified seeds conforming with BPI standards;

WHEREAS, pursuant to the enactment of the Seed Act of 1996, an Act providing for the
regulation of quality of certain seeds for sale, and in order to protect our farmers, there is a need
to make necessary promulgation supporting the said Act:

WHEREFORE, be it enacted by the Sangguniang Bayan of Iguig, assembled in session.


that:

SECTION 1. Prohibited Acts. It is expedient that all registered and certified rice
and corn seeds being sold and/or distributed within the municipality must have a seed
certification tag or seed label indicating that the product underwent proper analysis and conforms
to standards prescribed by the BPI. The display of untagged registered and certified rice and corn
seed stock for sale in different stores. agricultural supply or seed centers is hereby prohibited

SECTION 2. Administrative Provision. In order to assist the LGU in implementing


this Ordinance. an Inspection Team is hereby created composed of the following:

Municipal Mayor or her duly authorized representative:


Representative from the Bureau of Plant Industry;
Municipal Agriculturist
Committee Chairman on Agriculture: and
Municipal Agriculture &Fishery Council (MAFC)Chairman

SECTION 3. Penalty Provisions. Any person found violating Section 1 of this


Ordinance shall be penalized as follows:

First Offense -Php 1,000.00 fine


Second Offense -Php 2.000.00 fine
Third Offense -cancellation of business permit and closure of the
establishment and revocation of accreditation for accredited
seed growers

Accredited seed company and/or seed growers who are identified to be the source of untagged
seeds shall be blacklisted and their accreditation license shall be revoked.

SECTION 4. Repealing Clause. Any provision of an Ordinance inconsistent herewith is


hereby amended, repealed or modified accordingly.

SECTION 5. Effectivity. This Ordinance shall take effect upon approval.
