AN ORDINANCE ENACTING THE SOLID WASTE MANAGEMENT SEGREGATION AT

SOURCE OF BARANGAY PAITAN STA. MARIA, PANGASINAN

WHEREAS, the Barangay Paitan is committed to the protection, preservation, and conservation
of the ecosystem;

WHEREAS, it is the responsibility of the barangay to effectively and efficiently implement the
Solid Waste Management System under Republic Act No. 9003 in its territorial jurisdiction;

WHEREAS; the unsystematic waste disposal by households, store owners, vendors and
commercial establishments cause unsightly surroundings and spread of communicable disease;

WHEREAS; the practice of waste segregation to facilitate to reuse and recycling does not only
reduce the cost of collection and disposal of garbage but conserve the natural resources of
materials and avoid wasteful consumption of goods;

NOW THEREFORE; On motion of Barangay Kagawad , Solid Waste

Management Committee Chairman, duly seconded by Barangay Kagawad
and Sangguniang Barangay Members;

RESOLVED, as it hereby resolves, to enact, as it hereby enacts;

BE IT ORDAINED BY THE SANGGUNIANG BARANGAY OF PAITAN, SANTA MARIA,

PANGASINAN IN SESSION THAT;

ARTICLE 1. TITLE

SECTION 1. TITLE. This Ordinance shall be known and referred to as “Barangay Ordinance on
the Solid Waste Management Segregation at Source of Barangay Paitan Sta. Maria,
Pangasinan”.

ARTICLE II. COVERAGE

SECTION 2. COVERAGE. This Ordinance shall apply to all households, commercial

establishments such as sari- sari store, schools, public and private places.

ARTICLE III. LEGAL BASIS, PURPOSE, GOAL, AND OBJECTIVES

SECTION 3. LEGAL BASIS. This Ordinance is enacted to implement the provision of Republic
Act 9003 which mandates the proper segregation of household waste.

SECTION 4. PURPOSE. This Ordinance is enacted for the following purposes;

a. To guide, control and regulate the generation of solid waste within the barangay and
promote orderly sanitary system for the same;
b. To promote and protect the health, safety, and convenience of the general welfare of
the inhabitants of the Barangay;
c. To enhance the total environment of the locality through the necessary control and
mitigation od negative environmental impacts of solid waste;
d. Encouraging the recycling and resource recovery of waste in own backyards through
composting, and,
e. Encouraging the salvaging of possible “recoverables” from solid waste for re-use and
recycling to production process.

SECTION 5. GOALS. The primary goal of this Ordinance is to enhance ecological balance of
the community through sustainable and integrated waste management.

SECTION 6. OBJECTIVES. The objectives of this Ordinance are the following;

a. To eradicate unsightly uncovered and overflowing waste containers in streets, public
places and open spaces;
b. To ensure round the clock cleanliness through the orderly management of waste;
c. To maximize and optimize sanitary resource recovery.

ARTICLE IV. SEGRAGATION OF WASTE

SECTION 7. MANDATORY SEGREGATION OF WASTES. The segregation of waste shall

primarily be conducted at the source, to include household, and commercial sources. Provided
that wastes shall be segregated into the categories.

SECTION 8. REQUIRMENTS FOR THE SEGREGATION AND STORAGE OF SOLID WASTE.

The followings hall be the minimum standards and requirements for segregation and storage of
solid waste;
a. There shall be a suitable container or bins in front of every household, sari-sari store,
public and private places and other commercial establishments.
b. There shall be a separate container or garbage bins for each type of waste from all
sources;
c. The solid waste container or garbage bins depending on its use shall be properly
marked or identified for on-site collection as follows;

c-1. Biodegradable/Compostable or Nabubulok

c-2. Recyclables or “Di- Nabubulok na maari pang pakinabangan”, and
c-3. Residuals and Special Wastes or “Di-nabubulok na di na mapakinabangan”

ARTICLE V. PENAL PROVISIONS

SECTION 9. FINES AND PENALTIES. The following fines and penalties shall be imposed to
any person who violates specific provisions of this ordinance. He/She shall be issued with a
VIOLATION TICKET by an enforcer duly assigned by the Punong Barangay.

a.1. For not segregating of wastes:

1st Offense- a fine of 300 pesos shall be imposed on unsegregated waste disposal by
households, or business owners and other commercial establishments.

2nd Offense- a fine of 500 pesos but not more than 1000 shall be imposed plus a
community service for 3 consecutive days.

3rd Offense- no collection of garbage unless segregated plus a fine of 1, 500 plus
community service for 5 consecutive days.

a.2. For households, sari-sari store and other commercial establishments that do not
provide receptacles/containers or garbage bins for their refuse/solid waste.

1st Offense- Warning/reprimanded

2nd Offense- a fine of Php100 pesos
3rd Offense- a fine of Php150 pesos
Subsequent- a fine of Php 250 pesos

SECTION 10. SEPARABILITY CLAUSE. If any provisions of this Ordinance or the application
of such provisions to any person or circumstances is declared unconstitutional, the remainder of
this Ordinance or the application of such provisions to other persons or circumstances shall not
be affected by such declaration.

SECTION 11. REPEALING CLAUSE. All existing ordinances or resolutions of this barangay
found to be inconsistent herewith are hereby repealed to modified accordingly.

SECTION 12. EFFECTIVITY. This Ordinance shall take effect in accordance with the provisions
of the Local Government Code of 1991.
