AN ORDINANCE ESTABLISHING THE HALINA’T MAGTANIM NG PRUTAS AT GULAY (HAPAG)


SA BARANGAY, PROVIDING FOR ITS SUSTAINED OPERATIONS AND FOR OTHER PURPOSES

BE IT ENACTED by the Sangguniang Barangay of Balogo, Bacon District, Sorsogon City, in session
assembled, that:
Section 1. Title. This ordinance shall be known as the Halina’t Magtanim ng Prutas at Gulay
(HAPAG) sa Barangay Ordinance of Barangay Balogo, Bacon District, Sorsogon City.
Section 2. Declaration of Policies. Consistent with Section 17(b)(1)(i) of Republic Act 7160
otherwise known as the Local Government Code, Executive Order No. 138, Series of 2021, and
Ambisyon Natin 2040, it is hereby the declared policy of the Local Government Unit of Barangay Balogo
to promote food sufficiency through agricultural support services and establishment of community
vegetable garden.
Section 3. Definition of Terms. As used in this ordinance, the following terms shall mean, to wit:
a) Aeroponics – a plant-cultivation technique in which the roots hang suspended in the air
while nutrient solution is delivered to them in the form of a fine mist.
b) Aquaponics – a system of aquaculture in which the waste produced by cultured/farmed fish supplies
nutrients for plants grown hydroponically, which in turn purify the water for fish habitat thereby
creating a bio-system of symbiotic relationship between the fish and the plant being farmed.
 c) Container Gardening – a micro model farming where a family unit or household is producing fruits
and vegetables in special containers for personal consumption.
d) Fruit-bearing Tree Planting – planting of fruit-bearing trees for food production purposes such as
papaya, banana, jackfruit, etc.
e) HAPAG Garden – refers to the Barangay Community Garden, a piece of land operated and cultivated
by the barangay for the purpose of planting and growing vegetables and fruit-bearing trees.
f) Hydroponics – a method of growing plants using mineral nutrient solutions in water without soil.
g) Square Foot Gardening – a simple method of creating small, orderly, and highly productive kitchen
gardens.
h) vertical Gardening – a special kind of urban gardening suitable for small spaces, particularly for
decorating the walls and roofs in various styles.

Section 4. HAPAG Garden. a) The community garden at the lot owned by the barangay shall be
rehabilitated and upgraded, to be known as HAPAG Garden.
b) Available private vacant lots may also be utilized for the purpose, subject to negotiation and
execution of Memorandum of Agreement (MOA) between the owner and the BLGU, for which the
Punong Barangay is hereby authorized by the Sangguniang Barangay to negotiate, enter into and
sign the MOA therefor.
Section 5. Task Force HAPAG. Task Force HAPAG is hereby created, to be composed of the
following:
Section 6. Duties and Responsibilities. The Task Force shall have the following duties and
responsibilities:
a) Identify suitable space/lot/patch(es) of land that may be utilized as HAPAG garden;
b) Establish, cultivate and maintain the HAPAG garden;
c) Identify and determine suitable crops/fruit trees to be planted;
d) Coordinate with higher LGU and the City Agriculture Services Office for seedlings, technical and other
forms of assistance;
e) Conduct information and education campaigns to encourage residents to put up family vegetable
garden and/or fruit-bearing trees;
f) Implement alternative gardening such as container gardening, vertical gardening, square foot
gardening, hydroponics, aquaponics and aeroponics to serve as model for households without
adequate space, which alternative methods shall also be utilized by the Task Force to serve as
model to barangay residents;
g) Coordinate with the Committee on Budget, the sanggunian and barangay treasurer for funding;
h) Assist the barangay eco-aide in composting biodegradable waste materials for purposes of producing
organic fertilizer;
i) Keep records of the operations of the HAPAG garden such as, but not limited to, planted seedlings
and number thereof, harvested quantity, and other data;
j) Recommend to the Sangguniang Barangay through committees concerned such necessary measures
and policies for effective and efficient project implementation;
k) Regularly report to the punong barangay and the sanggunian on the status and progress of the
project at least twice a month and to government agencies which may impose reportorial
requirements; and
l) Such other related duties and functions which may be necessary.
Section 7. HAPAG Volunteers. A group of volunteers from all sectors and all puroks to be led by
purok leaders shall be organized by the Punong Barangay to cultivate and maintain HAPAG garden.
Section 8. Funding Sources. a) Funding for the project may be derived from Economic
Development and Environmental Management Sectors of the Barangay Development Fund, particularly
Capital expenditures related to the implementation of livelihood/entrepreneurship/local economic
development projects and Environmental management projects that promote air and water quality.
The Sangguniang Kabataan may augment funding needs from their Clean and Green appropriations.
b) Projects, programs and activities relative to HAPAG shall be incorporated in the Barangay
Development Plan and Annual Investment Plan to ensure adequate funding and implementation.
Section 9. HAPAG Operations. a) The HAPAG shall serve as a model that will showcase vegetable
and fruit production to encourage residents in putting up their backyard vegetable garden for domestic
consumption and for additional income as well.
b) Once the HAPAG garden is fully operational, he Task Force shall submit a recommendation to the
Sangguniang Barangay through the Committee on Agriculture on the funding, cost recovery, product
distribution and other related matters based on the records of operations to include but not limited
to crops planted, production cost, harvest and other related considerations.
c) Based on the recommendation of TF HAPAG, the Sangguniang Barangay shall further refine this
ordinance by way of amendment, to include HAPAG management, financial support, manpower,
expansion, income allocation, profit distribution and other related considerations.
Section 10. Separability Clause. If for any reason, any provision, section or part of this ordinance
is declared not valid by a court of competent jurisdiction or suspended or revoked by higher
sanggunian, such judgment shall not affect or impair the remaining provisions, sections or parts
thereof, which shall remain or continue to be in full force and effect. gay ng Piot ay
Section 11. Applicability Clause. All matters relating to the impositions on this ordinance shall be
governed by pertinent provisions of applicable existing laws and ordinances.
Section 12. Repealing Clause. All barangay ordinances, rules and regulations or parts thereof, in
conflict with, or consistent with any provisions of this ordinance, if any, are hereby repealed, amended
or modified accordingly.
Section 17. Effectivity. This Ordinance shall take effect upon approval.
