This letter serves as formal notification of the completion of the 75ft deep well installation at
Northwest Samar State University Students’ Dormitory, as per the terms and conditions
stipulated in our subcontract agreement.

We are pleased to confirm that the well meets all specified performance criteria and function as
intended. Effective immediately, full responsibility for the well's ongoing operation and
maintenance now transfers to you as the contractor. This includes, but is not limited to:

 Routine maintenance: Regularly checking and monitoring water levels, pump


functionality, and overall well performance.
 Minor repairs: Addressing small issues like leaks, clogs, or pressure fluctuations.
 Major repairs: Coordinating and overseeing any necessary major repairs or
replacements in the event of equipment failure or unforeseen issues.
 Water quality testing: Conducting periodic water quality tests to ensure compliance
with health and safety regulations.

Please note that your responsibility for the well ends with its successful installation and testing.
Any future concerns or defects falling outside the scope of your work as outlined in the contract
will be handled by our team, unless deemed to be caused by factors outside our control.

We recommend retaining records of your work on the project, including materials used,
installation procedures, and test results, for future reference. Should any issues arise related to
your workmanship or materials, we may need to consult these documents to determine
responsibility.

We appreciate your diligent work on this project and look forward to a successful handover of
responsibilities. If you have any questions or require further clarification on this matter, please

Project: Installation of 75ft Deep Well at NwSSU Students’ Dormitory

This letter serves as a formal agreement regarding the transfer of responsibility for maintenance
and repairs of the newly installed deep well at Northwest Samar State University Students’
Dormitory (hereinafter referred to as "the Deep Well"). This agreement comes into effect upon
successful completion of the well installation and handover witnessed by the NWSSU
representative, Engr. Darwin Z. Tan, on December 27, 2023.

1. Transfer of Responsibility:

Effective December 27, 2023, full responsibility for the ongoing maintenance, service, and
repair of the Well, including its associated equipment and components, will transfer from IGD
Construction and Development by MR. IGNACIO G. DATU to Water Well Driller – MR.
SEBASTIAN B. TIMAN. This includes, but is not limited to:

 Routine maintenance tasks such as pump cleaning, filter changes, water quality testing,
and system checks.
 Addressing operational issues or performance deficiencies.
 Conducting repairs for any material defects or workmanship flaws not demonstrably
caused by the NWSSU or factors beyond your control.
 Providing prompt and responsive service to the NWSSU for any well-related concerns.

2. Subcontractor's Scope of Work and Obligations:

As the responsible party for post-handover maintenance, MR. SEBASTIAN B. TIMAN agrees
to:

 Maintain a readily available team of qualified and experienced personnel with expertise
in deep well maintenance and repair, certified by the Department of Health (DOH) or
relevant authority.
 Respond promptly to all service requests from the NwSSU within the timeframe
designated in the original subcontract agreement or as stipulated by NWSSU
regulations.
 Conduct all maintenance and repair work using high-quality materials and industry-
standard practices, adhering to NwSSU guidelines and DOH water quality standards.
 Maintain comprehensive documentation of all service calls, maintenance activities, and
repair work performed, including water quality test results.
 Provide detailed invoices to the NwSSU for any chargeable services rendered beyond
the scope of the original subcontract agreement.

3. Main Contractor's Responsibilities:

IGD Construction and Development by MR. IGNACIO G. DATU will:

 Facilitate the handover process, ensuring the NWSSU representative receives proper
training and operational instructions for the Well.
 Provide Mr. Timan with access to all relevant technical specifications, as-built drawings,
warranty information, and DOH/NWSSU regulatory documents for the Well and its
components.
 Assist in coordinating access to the Deep Well site for maintenance and repair purposes,
upon reasonable notice from Mr. Timan.

4. Dispute Resolution:

Any disputes arising from this agreement will be resolved through amicable negotiation, failing
which, they will be settled through arbitration in accordance with the prevailing rules of
[Applicable Arbitration Institution].

5. Entire Agreement:

This agreement constitutes the entire understanding between the parties regarding the transfer
of responsibility for the Deep Well's maintenance. Any prior agreements or understandings are
superseded by this document.

6. Termination:

This agreement may be terminated by either party upon 10 days' written notice to the other
party, with due consideration for NwSSU operational needs and water supply continuity.

7. Signatures:

In witness whereof, the parties hereto have executed this Agreement as of the date first written
above.
