Safe Operating Procedure


On Legal Requirements & Legal Register

1. Purpose:
This document describes procedure to identify OH&S legal requirement and maintain
register at site level and periodical evaluate and raise non-conformity in case of non-
compliance.

2. Scope :
The scope of this work instruction is to describe required framework to identify OH&S legal
requirement and maintaining of up to date legal register at site, which will be evaluated
quarterly. The evaluation team will be responsible to address each and every section and
sub-section of applicable act and rule relevant to state and center government, its current
status and measurable improvements at ground level. The site audit team authorized by
PM-GPL will conduct audit quarterly based on the guidelines of this document.

3. Responsibility: -
GPL Site Head and Site Safety Engineer (GPL/PMC).

5. Procedure:
i. The Contractor at site shall be responsible to identify & comply with all legal & other
requirements pertaining to site conditions, as prescribed in legislations of state &
central Government authorities and maintain up to date register and valid
documentary proof.
ii. While preparing a project HSE plan, contractor shall prepare a legal register which
shall identify all applicable legal requirements specific to the project, identify the
frequency of compliances and person responsible for action to be taken and
document the same.
iii. The Contractor at site will be responsible to communicate all legal & other
requirements to the employees and subcontractors through internal communication/
training.
iv. Contractor shall have the whole and sole responsibility for the fulfilment and
compliance of applicable legal and related other requirements.
v. The Project Manager of GPL and PMC will be responsible to monitor legal
compliances periodically.
vi. PMC/ GPL Safety Officer on behalf of PM-GPL will be responsible to periodically
evaluate validity of legal requirements and will ensure adherence at site level.
vii. PMC/ GPL Safety Officer will maintain upto date legal register in the prescribed
attached format with valid proofs of all relevant licenses, test certificates, BOCW
forms etc in his custody..
viii. PMC/ GPL Safety Officer will be responsible to keep track of validity of these
compliances and will raise alert / reminder to contractors at least one month before
of expiry of validity.
ix. PMC/GPL Safety Officer will be responsible to maintain track list of all plant &
machineries, cranes, operating staff and its test & examination dues.
x. In case of non-compliance/ ignorance to validity dates etc by contractor, the
PMC/GPL Safety Officer will issue warning to contractor and will inform PM-GPL.
xi. In case contractor continues to ignore compliances beyond validity date, PM-GPL
may impose major NC & appropriate penalty and will issue stop work order for such
machine, equipment, scaffold, person etc.
5.1 Evaluation of Legal Compliance:

i. GPL/PMC safety engineer will conduct quarterly audit of legal register of contractor
to evaluate the evidences of conformity at site level and at the same time update

GPL legal register and submit status report to GPL project manager and HO -
Safety
ii. PMC/ GPL safety engineer on evolution communicate the non-conformities to the
project manager of contractor with appropriate targets.

6. Legal Register:

As per attached prescribed checklist and template.

7. Updates :
i. The Safety Officer of Contractor will be responsible to gets information on any
amendments of Acts / Rules by referring to any or all the following sources :
a. Notification from State / Central Government bodies,
b. Information in Newspapers / magazines,
c. Through various websites , and
d. Internal circulars
e. Govt. deptt. Websites
ii. The application for renewal of Licenses, Consents etc. under statutory requirements
are made in advance as specified in the respective Acts/ Rules.
8. Alert Protocol for Pending Compliances:
Safety Engineers (GPL/PMC) are authorized to raise urgent alerts against all pending
compliances as per the following protocol:

Status Protocol
TO: Status report to site head of Contractors & PMC for complied
items.
CC: To GPL Site Head & HO-Safety.

TO: Alert mail by safety engineer (GPL/PMC) to site head of


Contractors & PMC for in-progress activity. (Like challan received for
renewal of labour license, provisional certificate received for lifting
equipment’s, etc…)
CC: To GPL Site Head & CMC HO-Safety.

TO: Alert mail by PMC/GPL Project Manager to Contractor’s Site


Head for non-conformity.
CC: To Contractor Region Head (Operation & Safety) & CMC HO-
Safety.
