The Arent Fox Diversity Scholarship Application 2011

THE ARENT FOX DIVERSITY SCHOLARSHIP PROGRAM


Arent Fox will provide a scholarship award in the amount of $15,000 to three first-year law students, defined as 2013 law school graduates. Applications will be accepted from December 1, 2010, until January 15, 2011. Please note that interviews will not be scheduled until after the application deadline. Students will interview for the scholarship opportunity in January and February, and winners will be announced in March 2011. The scholarship award includes a position in Arent Foxs 2011 summer associate program. A scholarship will be awarded to one first-year law student for each of Arent Foxs offices: Washington, New York and Los Angeles. Washington and New York will host a ten week program, and Los Angeles will host a scholar for four weeks this summer. Candidates may only apply to one office. The scholarship money will be paid in addition to the summer associate salary of $2,700 per week. Please note that it is not necessary to apply to the summer program separately; this completed application denotes consideration for the entire summer program/scholarship package.

Eligibility
Scholarship applicants must meet the following criteria: U.S. citizen or otherwise authorized to work in the United States Currently attending an ABA accredited law school in the United States scheduled to graduate in 2013 Excellent academic performance during college and law school Excellent verbal and written communication skills Leadership qualities and community involvement Prior work experience preferred Member of a diverse population that historically has been underrepresented in the legal profession Must join the 2011 Arent Fox summer program after the first year of law school and have strong interest in joining the firm as an associate after law school graduation

Legal Writing Analysis


Please include a typed analysis of the following issue. Your response should be no more than five (5) pages in length, single spaced. Katz as Katz Can Company has a contract to supply canned food products to the United States Army. E. Gil Eig was the Companys chief financial officer. In that capacity, he oversaw, the Companys accounts receivable operation. And, he was considered the heir apparent for the soon-to-be vacant Chief Operating Officer position. Unfortunately, his fortunes took a bad turn. After reviewing the prior years invoices, Eig began to suspect that some were inflated. He alerted the CEO, Maurice Moe Mony. But, Mony quickly assured him that everything was fine. Still concerned, Eig reported his suspicion to the Armys contracting officer for the project, Gen. Mortars. And, after conducting a preliminary review, he ordered Katz to show cause why the government should not revoke the contract for cause. Enraged, Mony stopped speaking with Eig, transferred his chief responsibilities to another manager, and told other Company officers that Grieved could Kiss the COO job goodbye. Recognizing that his future with the Company was bleak, Eig quit. Later, he sued the Company in the U.S. District Court for the Eastern District of Virginia. His Complaint contains two counts. In one he contends that the Company constructively discharged him in violation of the False Claims Acts anti-retaliation provision, 31 U.S.C. 3130(h). And, in the other he contends that his constructive discharge violates Virginias public policy. You are the presiding judges law clerk. And, she has asked you to prepare a memorandum analyzing whether those claims are viable. Your memorandum should be no more than 5 pages long, single spaced. You should assume that Eig engaged in activity that the False Claims Act protects. And, you should confine yourself to the following legal authorities: 31 U.S.C. 3730(h); Neal v.
