AFFIDAVIT OF CORRECTED TIE LINES

I, MARVIN MANALANGSANG, of legal age, Filipino, with office address at Filinvest


Building, 79 EDSA, Mandaluyong City, Metro Manila, under oath, hereby depose and state
THAT:

1. I am the Assistant Survey Manager of Filinvest Land, Inc. (the Corporation), with office
address at Filinvest Building, 79 EDSA, Mandaluyong City, Metro Manila for purposes of
processing the approval of several consolidation plans of the lots owned by the Corporation
and Rodel Land, Inc. under a Development Agreement dated January 22, 1997;

2. As a result of the consolidation of titles, the following consolidated titles were issued:

3. The corporation has caused the consolidation of the said titles to correct the tie lines on the
technical descriptions, which should be based on the findings of Department of
Environment and Natural Resources – South Cotabato PENR Office dated 23 March 2010,
to wit:
FINDINGS AND OBSERVATION

1. That using the Triangulation Station “SHACK” as Tie Line, the ground position of all lots will shift or
move by approximately 954.67 meters Southeast direction from its actual and exact position.

2. That using the Triangulation Station “WEST” as Tie Line, all the properties within the vicinity will be
positioned at its actual and exact location.

3. That there are existing “barbed wire fence” and “gemelina” trees along the boundary lines of corners 1 ro
2, 2 to 4, and 4 to 5, of Lot C, Psd-71204 covered by TCT No. T-91660, registered in the name of Bangko
Sentral ng Pilipinas (BSP) and the adjoining property of Nazario Guinto.

4. That the ground position on the land shall be determined not only in the description of Tie Line but on the
physical natural boundaries/marker. In the case of Loyola v. Bartolome, et al. 39 Phil 554, the Supreme
Court ruled in this wise-

“That which really defines a piece of ground is not the area calculated with more or less certainty
mentioned in its direction, but the boundaries herein laid down, as enclosing the land and
indicating its limit.”
It therefore follows that the location of the land is not dictated by the descriptions of its Tile Line but by
the description of its boundaries.

RECOMMENDATION

1. That the Triangulation Station “SHACK” be junked or cancelled permanently to avoid


overlapping of survey.

2. That “CTS No. 18”, Fishport Complex, Tambler, General Santos City being the correct TIE
LINE will be used to maintain the actual, correct and exact position of the lots.

3. That herein-below is the computation of Tie Line that shall be used to maintain its position to
corner “1” of the lots using “CTS No. 18” Fishport Complex, Tambler, General Santos City, to
wit:

Certified true copy of the Department of Environment and Natural Resources – South Cotabato PENR
Office dated 23 March 2010 is attached herewith as “Annex A” and is made an integral part hereto.
4. Using CTS No. 18, Fishport Complex, Brgy. Tambler as tie line to maintain its position to
corner “1” of the lots as above listed, the resulting plotting of the Subject Properties
conforms to their actual location on the ground.

5. Hence, the corporation requests that this finding of the Department of Environment and
Natural Resources – South Cotabato PENR Office be annotated on the present titles for the
information of the public and proper reference to tie lines;

6. Certified copy of the aforesaid Tie-Line Correction from the Bureau of Lands is hereto
attached.

7. I hereby request the Register of Deeds of General Santos City to annotate this Affidavit on
the titles enumerated above as well as the findings on the correct tie line reference, which
should be as above stated.
