CHAPTER V

SUMMARY, CONCLUSION AND RECOMMENDATIONS

This chapter presents the summary of findings, conclusions, recommendations

after identifying the problems and presenting the analysis of all relevant data gathered.

A. Summary of Findings

Based on the gathered data, the following are the findings obtained in this study:

1. In Philippines, right to retirement is upheld by the police power of the state

through enactment of the Retirement Pay Law.

2. The right to retirement grants retirement pay benefits to qualified private

sector employees. Under the current law and latest issuances by relevant

government agency, there are private sector employees who may have

favorable protections with regard to retirement pay. However, these do not

tantamount inequality, as there are reasonable circumstances justifying such

special protection.

3. The Retirement Pay Law provides for the cumulative requirements of age and

tenure requirements before a qualified employee maybe eligible for the grant

of retirement pay benefits.

4. Retirement pay benefits are intended to help the employee enjoy the

remaining years of his life, releasing him from the burden of worrying for his

financial support, and are a form of reward for his loyalty to the employer.
5. Retirement pay benefits under the law is imposed only upon the last employer

upon retirement, in the absence of any applicable agreement to other prior

employers .

6. Loyalty of employees to their employers are strictly based on the age and

tenure requirements.

B. Conclusion

In view of the foregoing findings, the following conclusions are formulated:

1. The right to retirement is a statutory right that promotes the general welfare of

retired employees .

2. The retirement laws provide for strict requirements of age and tenure before

granting the minimum retirement pay benefits, in which non-compliance of

either or both requirements will prohibit the grant of the same.

3. Employees who have served their employers for long time but who have not

reached at least the optional retirement age will not enjoy such retirement pay

benefits in the absence of any applicable agreement.

4. Existing general retirement law is not attuned to the prevailing life cycle of an

employee. The cost of such retirement pay is only covered by the last

employer.

5. The seemingly inequality for those long-serving employees who fail to meet

the minimum retirement age and those last employers burdened with the
obligations to pay for the minimum retirement benefits, presents a gap of the

existing retirement law that necessarily needs to be filled by amending the

said law.

6. In amending the existing Retirement Pay Law, the Congress may further refer

to and adopt the tenure required for those loyalty awardees in civil service of

the Philippine government.

C. Recommendation

In consideration of the findings and conclusions attained, the following is highly

recommended:

1. That Congress must amend the existing Retirement Pay Law by adding a

new provision therein allowing the qualified long-serving private sector

employees the option to retire and to receive the minimum retirement pay.

D. Proposed Legislation

Base on the foregoing findings, conclusions, and recommendations, below is the

proposed law related to retirement benefits of employees in the private sector.

AN ACT AMENDING ARTICLE 302 OF PRESIDENTIAL DECREE NO. 442, AS


AMENDED, OTHERWISE KNOWN AS THE LABOR CODE OF THE PHILIPPINES,
BY PROVIDING FOR RETIREMENT PAY TO QUALIFIED PRIVATE SECTOR
EMPLOYEES WHO HAVE SERVED AT LEAST TEN YEARS IN THE
ESTABLISMENT.

Section 1. Article 302 of Presidential Decree No. 442, as amended, otherwise known
as the Labor Code of the Philippines, is hereby amended to read as follows:
Art. 302. Retirement. – Any employee may be retired upon reaching the retirement age
established in the collective bargaining agreement or other applicable employment
contract.

In case of retirement, the employee shall be entitled to receive such retirement benefits
as he may have earned under existing laws and any collective bargaining agreement
and other agreements: Provided, however, That an employee's retirement benefits
under any collective bargaining and other agreements shall not be less than those
provided herein.

In the absence of a retirement plan or agreement providing for retirement benefits of


employees in the establishment, an employee upon reaching the age of sixty (60) years
or more, but not beyond sixty-five (65) years which is hereby declared the compulsory
retirement age, who has served at least five (5) years in the said establishment, may
retire and shall be entitled to retirement pay equivalent to at least one-half (1/2) month
salary for every year of service, a fraction of at least six (6) months being considered as
one whole year.

However, an employee who has not reached the age of the sixty (60) years but
has served at least ten (10) years in the establishment, may retire and shall be
entitled to retirement pay equivalent to at least one-half (1/2) month salary for
every year of service, a fraction of at least six (6) months being considered as one
whole year.

Unless the parties provide for broader inclusions, the term one-half (1/2) month salary
shall mean fifteen (15) days plus one-twelfth (1/12) of the 13th month pay and the cash
equivalent of not more than five (5) days of service incentive leaves.

Retail, service and agricultural establishments or operations employing not more than
(10) employees or workers are exempted from the coverage of this provision.

Violation of this provision is hereby declared unlawful and subject to the penal
provisions provided under Article 288 of this Code."

Section 2. Nothing in this Act shall deprive any employee of benefits to which he may be
entitled under existing laws or company policies or practices.

Section 3. Separability Clause. – If any provision of this Act is declared unconstitutional,


the same shall not affect the validity and effectivity of the other provisions hereof.
Section 4. Repealing Clause. – All laws, decrees, orders, and issuances or portions
thereof, which are inconsistent with the provisions of this Act, are hereby repealed,
amended, or modified accordingly.

Section 5. Effectivity. –This Act shall take effect fifteen (15) days following its publication
in at least two (2) national newspapers of general circulation.
