() The Intern shall perform the clerical support specified in Annex A, “Terms of Reference ” which is made an integral part of this Contract. Gi) ‘The Intern shall start work from the effective date of February 3" March, 2021 (13 Hoote 1399) to August 30, 2021 (8 Sonbola, 1400). A. Ceiling ‘The Client shall pay the Inter an amount not to exceed a ceiling of (AFN 117,000). This amount has been established based on allotment that it includes all of the Internship costs (Transportation, Lunch and Communication Costs) as well as any tax obligation that may be imposed on the Inte. The payments made under the Contract consist of the Intem's compensation as defined in sub-paragraph B below. B. Compensation ‘The Client shall pay the Intern in accordance with the allotted amount specified in Annex B, “Cost Estimate of Services Schedule of Rates.” D. Payment Conditions Payment, shall be made on a monthly basis of (AFN 19,500) (Including Local Taxes) The local taxes will be paid by the client directly to the tax authorities. Coordinator The Client designates the relevant senior Specialists the Project as the Client's Coordinator; the Coordinator shall be responsible for the coordination of activities under the Contract, and for receiving and approving invoices for payment and deliverables. B. _ Timesheets During the course of his/her work under this Contract the Intern is required to complete timesheets or any other document used to identify time spent. ic The Intern undertakes to perform the Services with the highest standards of professional and ethical competence and integrity. ‘The Interns shall not, during the term of this Contract and within two 2 8. Any studies, reports or other material, graphic, software or otherwise, prepared by the Intern for the Client under the Contract shall belong to and remain the property of the Client. ‘The Intern may retain a copy of such documents and software. The Intern agrees that, during the term of this Contract and after its termination, the Interns and any entity affiliated with the Intern, shall be disqualified from providing goods, works or services (other than consulting services that would not give rise to a conflict of interest) resulting from or closely related to the Consulting Services for the preparation of the implementation of the Project. The Intern will be responsible for taking out any appropriate insurance coverage. The Intern shall not assign this Contract or Subcontract any portion of it without the Client's prior written consent. The Contract shall be governed by the laws of The Islamic Republic of Afghanistan, and the language of the Contract shall be English. Any dispute arising out of this Contract, which cannot be amicably settled between the parties, shall be referred to adjudication/arbitration in accordance with the laws of the Client’s country. The Client may terminate this contract with at least fifteen (15) working days prior written notice to the Intern after the occurrence of any of the events specified in paragraphs (a) through (d) of this Clause: (a) If the Intern does not remedy a failure in the performance of its obligations under the Contract within five (5) working days after being notified, or within any further period as the Client may have subsequently approved in wri ‘ ie ON (b) If the Intem becomes insolent of bankrupt; ©, \ (©) If the Intem, in the judgment of the Cliefit’or the Bank, has engaged in corrupt, fraudulent, collusive, coercive, or obstructive practices (as defined in the prevailing Bank’s sanctions procedures) in competing for or in performing the Contract. Reporting Supervisor _ | Executive Director NTA Grade NoNTA General Introduction: ‘The Eshtighal Zaiee — Karmondena (EZ-Kar) Program is currently under preparation and is expected to be officially launched by November 2018. ‘The EZ-Kar program is an inter-ministerial effort to improve economic opportunities in cities where there is a high influx of displaced people. Once the program is effective, investments will be made in interventions ranging from the provision of short-term daily wage work for vulnerable households to medium and longer-term support for refugee repatriation, support of regulatory reforms, and market rastructure that will improve the enabling environment for the private sector in cities. The project design as mentioned above will include multiple implementing agencies namely the Ministry of Foreign Affairs (MoFA), Kabul municipality, and Independent Directorate of Local Governance (IDLG). At the central level, the Ministry of Economy (MoEC) will serve as the lead line Ministry responsible for inter-ministerial coordination among stakeholders within the Government, with the World Bank and other donors, carry out overall management and project oversight across the Implementing Agencies (IAs) and other relevant agencies that are a part of the wider migration response strategy under Displacement and Returnee Executive Committee (DiREC). The EZ-Kar project will reach Afghan refugees living in Pakistan and citizens. within Afghanistan in an estimated 12 cities in Afghanistan namely: Jalalabad (Nangarhar Province), Kabul (Kabul Province), Kandahar (Kandahar Province), Herat city (Herat Province), Puli Khuniri (Baghlan), Maimana (Faryab), Firozkoh (Ghor), Khost (Khost province), Asadabad (Kunar), Kunduz (Kunduz. province), Mihtarlam (Laghman) and Talogan (Takhar Province). These cities have beciselected based on the influx of returnees and IDPs with data from GoIRA and UN OCHA sources. Scope of Work: The intern will work under the supervision of the assigned Manager and will be responsible to support E: Kar staff with their routine tasks and clerical activities, Duties and Responsibilities: Assist the executive officer with the following roles and responsibilities. Assist the executive officer, in preparing of the executive director meeting schedule. Support the executive officer in making the filing system. Confirm the meetings and venues related to executive office. Support the supervisor in managing meetings and workshops. Liaise with the other department on follow-up the management decision and action plans. Article VI. Working hours The working week is maximum forty (40) hours per week However, due to the nature of Solidarités International's activities, employees may be called upon to work on days of rest and public holidays, at the request of their line manager, In order to intervene in emergency humanitarian conditions. Employees will therefore be required to be flexible and available in accordance with their commitment Article VI, Annual leaves The employee will be entitled to annual leaves in accordance with terms and conditions mentioned in the Internal Employee Regulation. For apart time position, annual leave is calculated on the same basis, on a pro-rata ratio, The date of the leave shall be fixed by mutual agreement with the employer. Article Vil, Absence and unavailability In the event of absence, the employee must take the necessary steps to inform and provide supporting documents to his/her line manager and to the administration of Solidarités International as soon as possible. Any unjustified absence. is considered as unpaid leave. Article IX. Employer obligations In particular, the employer is obliged to: ~ _Topay the salary due to the employee at the end of each month of actual service; ~ To release the employee from any professional obligation once a year, during the period of his/her patd leave; = To subscribe to the social security mechanism, Solidarités international would participate to the medical expenses ~ To provide the employee with adequate working conditions so that he/she can properly perform his/her function; ~ To ensure the framework and the adequate material for the execution of the work of the employee to ensure safety and to protect the physical and mental health. Article X. Employee obligations The employee undertakes to respect the legal, regulatory, and conventional provisions relating to workin Afghanistan, The employee has in particular the obligation: ~ To perform the work to which he/she is assigned to the best of his/her knowledge and belief; = Not to delegate his/her duties, nor to be represented by a third party for the execution of the work entrusted to him/her without the prior and express agreement of the employer; + Torespect the employer's property; + Torespect the working hours; ~ Not to undertake any activity contrary to the philosophy of work and the mission of Solidarités International, to respect the Charter, the Code of Conduct and the Code of Ethics and Conduct, the internal Employee Regulations of Solidarités International ~ Respect all obligations stated in the Afghan labor law = Article XL. Exemption from lak ‘The employee expressly acknowledges that there are risks of terrorism, war, danger of injury, illness or even death due {0 epidemics, social or popular unrest which are beyond the control ofthe employer. The employer has not and will not assume any responsibility for these risks, which are force majeure. The employee shall therefore take all necessary steps to protect himself/herself from such risks. Article Xil, Renewal / Amendment of the contract Any modification of this contract shall be the subject of an amendment duly signed by the parties in accordance with the legislation in force in Afghanistan. Any modification from this provision shall render the amendment null and void, The present contract shall terminate at the end of its term. To this end, the employee shall cease all activities related to his or her employment contract, and shall receive a termination payment determined in accordance with the legal Provisions in force. The present contract may, however, be renewed by written agreement between the two parties in the form ofa rider ifthe employer deems it appropriate. Article XIV. Fitness for work The performance of the contract of employment shall be subject to the determination of the employee's fitness for work Article XV. Disputes Zhe parties undertake to submit any disputes that may arise in connection with the performance or interpretation of {his employment contract to amicable settlement. If necessary, the dispute shall be submitted to the appreciation of the competent labor court which may apply the laws and regulations in force. Article XVI. Final provision The present contract, which comes into force on 04/12/2021, is exempt from all stamp and registration duties, in ‘accordance with the legislation in force. Any modification from this provision shall render the amendment null and void. The present contract shall terminate at the end of its term. To this end, the employee shall cease all activities related to his or her employment contract, and shall receive a termination payment determined in accordance with the legal Provisions in force. The present contract may, however, be renewed by written agreement between the two parties in the form of a rider if the employer deems it appropriate. Article XI.
