Performance Standard C. — Reimbursables ‘The Client shall pay the Consultant for reimbursable expenses, which shall consist of and be limited to: @ —notmal and customary expenditures for official travel, accommodation, printing, and telephone charges; official travel will be reimbursed at the cost of less than first class travel and will need to be authorized by the Client's ‘coordinator; Gi) such other expenses as approved in advance by the Client's coordinator. Payment Conditions Payment shall be made on a monthly basis of ARN 171,100.00 not later than 14 days following submission of invoices and a timesheet in duplicate to the Coordinator designated in Paragraph 4. The local taxes will be paid by the client directly to the tax authorities. Payments shall be made to Consultant's bank account. A. Coordinator ‘The Client designates Head of Administration and Finance of AGO as the Client’s Coordinator; the Coordinator shall be responsible forthe coordination of activities under the Contract, for receiving and approving invoices for payment, and for acceptance of the deliverables by the Client. B. —Timesheets During the course of his/her work under this Contract, including field work, the Consultant providing services under this Contract is required to complete timesheets or any other document used to Identify time spent, as well as expenses incurred, as instructed by the Project Coordinator. C. Records and Accounts ‘The Consultant shall keep accurate and systematic records and ‘account in respect of the Services, which will clearly identi all ‘charges and expenses, The Client reserves the right to audit, or 0 ‘nominate a reputable accounting firm to audit, the Consultant's records relating to amounts claimed under this Contract during lis term and any extension, and for a period of three months thereafter ‘The Consultant undsitakes to perform the Services with the highest standards of professional and ethical competence and integrity 6. Assignment 12, Law Governing Contract and Language ‘The Consultant shall permit, and shall cause its Sub-Consultants to Permit the Bank and/or persons or auditors appointed by the Bank to spect and/or audit its accounts and records and other documents relating to the submission of the Proposal to provide the Services and Performance of the Contract. Any failure to comply with this obligation may constitute a prohibited practice subject to contract termination and/or the imposition of sanctions by the Bank (including without limitation a determination of ineligibility) in accordance with prevailing Bank's sanctions procedures, ‘The Consultants shall not, during the term of this Contract and within ‘vo years after its expiration, disclose any proprietary or confidential information relating to the Services, this Contract or the Client's ‘business or operations without the prior writien consent of the Client. Ability to foresee the needs of the Projet and respond in a proactive manner; Familiarity with legal and financial systems of the Government of Afghanistan as ‘well as with the Procurement and Financial Management Guidelines of the World Bank. Reporting 8._ The Project Unit Director will report to the [POSITION TITLE OF THE OFFICIAL, ASSIGNED IN EACH JI] and to the Bank (in accordance with the Grant Agreement). Duration of Appointment 9. The Project Unit Director will be employed on a five-year contract with a three-month probationary period. The AISDP is 8 5-year, ARTF funded operation, The estimated cost of the project is USS 85.5 million. The project will support the Afighan Government's National Priority Program (NPP) namely: (a) Access to Justice: to expand the quality and the quantity of judicial service delivery to Afghans; (b) Improved Services: 10 | raise the quantitative and qualitative technical capacities of the institutional service providers; (c) Improved Technical Capacity: to raise the quantitative and qualitative technical capacities of the institutional service providers; and (d) a Institutional Strengthening: to build the capacity of the JI through a ‘comprehensive, management-oriented organizational development. ‘More specifically, the AJSDP is designed to enhance the capacity of the Afghan Justice institutions to deliver legal services. The project will finance investment and technical assistance as a means to strengthen human capital and physical ‘nfinstructure management, augment the skills of justice sector professionals, and enhance the physical infrastructure used to deliver legal services. The project is also intended to empower the Afghan people through provision of legal aid and ‘education on legal rights and obligations, 3._ The project will also align with two other ARTF funded projects: the A fhanistan Capacity Building for Results Facility (CBR) Project and with the Support for Programmatic Resource Growth Corridor Development project (SPRGRD). The CBR project is imended to increase the capacity of government to deliver ‘essential services and implement national priority programs, while addressing the overeliance on external technical assistance. Implementation Arrangement 4. The project will be implemented by the JIs, namely the SC, the Mod, and the AGO and will follow the World Bank policies and guidelines. The Bank will be responsible for the supervision of the project. The project implementation structure builds on and expands the structure established under the Phase 1 AJSRP.
