DANCE TEAM
2024 SEASON CONTRACT

This agreement made this _________ day of ______________, 20____ between Windsor Express
Basketball ULC (the “Team”) and ___________________________________ (the “Dance Team Member”)

1. The Team hereby agrees to engage the services of the Dance Team Member, commencing on
January 12, 2024 and ending on the last home game of the playoff season on which the Team is
playing. The Dance Team Member shall perform such duties as may be assigned from time to time
to the Dance Team Member by the dance coach, game day ops director, and its management.

2. During the Dance Team Member’s term with the Team, the Dance Team Member shall in all
respects conform to and comply with the directions and policies of the Team, shall perform each
of the duties assigned from time to time by the Team to the best of the Dance Team Member’s
skill and ability, safely and diligently serve the Team, use Dance Team Member’s best efforts to
promote the interests and reputation of the Team and devote such time, attention and energy to
the business of the Team as, in the opinion of the Team, is necessary to carry out the duties of the
Dance Team Member. This would include things such as Dance Team Practices, Public
Appearances, and Express Home Games.

3. For all of the services to be rendered by the Dance Team Member to the Team, including for all
hours during regular work hours and outside of such regular hours (including hours worked on
weekends and holidays), the Team agrees to pay the Dance Team Member, and the Dance Team
Member agrees to accept $50.00 per Team Home Game. Installment payments will be made on
the 1st and 15th of each month for games worked prior.

4. No notice shall be required to be given by the Team to the Dance Team Member if there is just
cause for immediate termination. Just cause shall include, but not be limited to, any one or more
of the following by the Dance Team Member: being found guilty of a Criminal offence, dishonesty,
serious misconduct, significant violations of corporate policy, theft of property of the Team, failure
to obey directions given to the Dance Team Member by a supervisor or other official of the Team,
or violation of any term of this agreement.

5. The Dance Team Member acknowledges that fraternizing with the Team’s Basketball Players is
expressly forbidden due to the professional nature of the working arrangement.

6. The Dance Team Member acknowledges that participation on the Dance Team involves certain
risks (some of which I may not fully appreciate) and that injuries, death, property damage or other
harm could occur to others or me. I accept and voluntarily incur all risks of any injuries, damages,
or harm which arise during or result from my participation on the Dance Team, regardless of
whether or not caused in whole or in part by the negligence or other fault of Windsor Express
Basketball, WFCU Centre, City of Windsor and/or its or their departments, affiliates, employees,
officers, agents or insurers ("Released Parties"). I waive all claims against any of the Released
Parties for any injuries, damages, losses or claims, whether known and unknown, which arise
during or result from my participation on the Dance Team, regardless of whether or not caused in
whole or part by the negligence or other fault of any of the Released Parties. I release and forever
discharge the Released Parties from all such claims. I agree to indemnify and hold the Released
Parties harmless from all losses, liabilities, damages, costs or expenses (including but not limited to
reasonable attorneys' fees and other litigation costs and expenses) incurred by any of the Released
Parties as a result of any claims or suits that I (or anyone claiming by, under or through me) may
bring against any of the Released Parties to recover any losses, liabilities, costs, damages, or
expenses which arise during or result from my participation on the Dance Team, regardless of
whether or not caused in whole or part by the negligence or other fault of any of the Released.

7. Dance Team Member grants to the Team, and the Basketball Super League (BSL), separately
and together, the full authority to use her name, signature, likeness and/or picture for all publicity
and promotional purposes in newspapers, magazines, motion pictures, game programs, roster
manuals, all broadcasts and telecasts, digital media and all other publicity and advertising media.
Dance Team Member agrees to cooperate with the news media and to participate, upon request
and without further compensation that is specified herein, in any reasonable promotional
activities of Dance Team Member’s Club and/or the BSL including but not necessarily, limited to
the following: personal appearances, media, television and print interviews, autograph sessions,
videos and other media. Without limiting the generality of the foregoing, and in particular, Dance
Team Member shall make a reasonable number of promotional appearances and participate in a
reasonable number (as determined by the Team in good faith) of pre- or post- game autograph
sessions, all without claim for additional compensation. Dance Team Member also agrees not to
engage in any promotional, advertising, sponsorship or related activity for any entity or purpose
during the term of this Contract without the prior, written permission of the Team, and the BSL,
which permission will not be unreasonably withheld if the Team and the BSL Counsel finds that
such activity does not conflict with any and all BSL or Team protected trademarks, copyrights
and/or logos associated with the BSL or any BSL member Team or any other protected purpose of
the Team, the BSL or with any sponsors of the Team and/or the BSL.

The terms “publicity,” “endorsements,” and/or “promotions,” as used herein, will include, but will
not necessarily be limited to, the following: athletic gear and/or apparel supplied or provided by
the Team to Dance Team Member. In addition, the Team and the BSL may make pictures of Dance
Team Member alone or with others, for photographs, computer images, motion pictures, television
and other media known or unknown. The Team and the BSL may use the pictures, no matter by
whom taken, in any manner for publicity, advertising, promotional, or trade purposes. The rights in
any pictures and recordings belong to the Team and the BSL but not the Dance Team Member.
Dance Team Member may not use any logo, trademark and/or copyright of the BSL or any BSL
club for any purpose without the prior written consent of the BSL League.
Dance Team Member acknowledges and agrees that the BSL and Team shall have a paid-up,
royalty-free right to exploit in perpetuity Dance Team Member's name, signature, likeness and/or
picture in their copyrighted works and in works which record or depict Dance Team Member. The
BSL and the Team shall have and retain all rights afforded the owner of such rights. The BSL and
the Team shall have and retain all rights afforded the owner of such copyrighted works (including
a right to make derivative works incorporating in whole or in part later or preexisting works) for
any purpose whatsoever in any and all media or means of commerce, whether in existence or
hereafter devised, and that Dance Team Member has no rights whatsoever in and to the BSL’s and
the Team’s copyrighted works or exploitation of its copyrighted works including, but not limited
to, rights to any compensation for such exploitation.

8. Dance Team Member must wear the official uniform of the Dance Team at all games. Dance
Team Member may not remove, cover, obscure or otherwise alter any logo, name, color or mark
that appears on the foregoing apparel and equipment supplied by the BSL or Team. In addition,
Dance Team Member may not wear any additional identifying logo, name, colors, marks, or design
of any company, product or service at any BSL basketball game, practice or other occasion when
they represent the Team or the BSL including, but not limited to, logos, names, colors, marks or
designs on athletic shoes, and socks, without first obtaining the written consent of the BSL League
or Team, which consent may be withheld in the sole and absolute discretion of the BSL and/or
Team. Upon the termination of this Contract, or at the end of the season, Dance Team Member
must return to the Team all of the uniforms and equipment in their possession or issued to them.
As permitted by Provincial law, the Team may deduct up to $100.00 from any payment due to the
Dance Team Member, for the value of any uniform or equipment not returned by Dance Team
Member.
9. Must attend rehearsals and games.
The Dance Team Member acknowledges that they have read and understand this agreement.
