1. By way of the present bail application filed under Section 439

Cr.P.C., the applicant who is behind the bars for the allegation of

commission of offence under Section 302 of Indian Penal Code,

has prayed that he be granted interim bail so as to solemnize

marriage with one Ms. Anjali D/o Late Sh. Chandraveer Singh and

Smt. Ayodhya Devi on 08.12.2023.

2. A report of the police was furnished before the trial court. A

copy whereof was produced by the learned counsel for the

applicant for perusal of the Court.

3. On perusal of the report, this Court finds that the SHO has

reported that the place, which has been fixed as venue for the

marriage namely Ganesh Sarvajanik Park, 21/712, Chopasni

Housing Board, Jodhpur, does not exist.

4. That apart, this Court is unable to believe that a girl and her

family members would arrange for a marriage, fix a date of

marriage (08.12.2023) and book a venue knowing it fully well that

the boy is behind the bars.

5. Be that as it may.

6. If the girl namely Ms. Anjali is interested in marrying the

present applicant, instead of granting interim bail to the applicant,

this Court deems it appropriate to direct the jail authorities to

permit the marriage to be solemnized in the jail premises itself.

7. For such purpose, Ms. Anjali and four of her relatives and

one priest will be permitted to enter jail premises on 08.12.2023

on production of relevant IDs and after completing usual

formalities. Ms. Anjali and her relatives will be allowed to remain

present for three hours or till the time the formal marriage

ceremony is completed, whichever is earlier. The jail authorities

will provide for a suitable open area where the marriage ceremony

can be held.

8. This order will be confined to the formal marriage ceremony

and no other request for isolation of bride and groom and

presence of Ms. Anjali and her relatives in jail premises for other

purposes shall be acceded to.

9. Mr. Moti Singh, learned counsel in his generosity offers to

arrange for distribution of sweets in the jail premises for all the

prisoners.

10. The present interim bail application stands disposed of,

accordingly.
