AN ORDER SETTING UP DIFFERENT MECHANISMS TO PREVENT AND RESPOND TO


GENDER-BASED SEXUAL HARASSMENT

WHEREAS, the State values the dignity of every human person and guarantees full respect
of human rights and recognizes the role of women in nation building;

WHEREAS, Republic Act No. 11313, otherwise known as the Safe Spaces Act (SSA) expands
the law on sexual harassment in the country to cover all of its forms including verbal, non-
verbal and physical; and secure all persons regardless of sex, sexual orientation and gender
identity and expression from all kinds of gender-based violence and discrimination such as
sexual harassment, not only in private spaces but also in public spaces;

WHEREAS, Section 8 of the Safe Spaces Act mandates all LGUs to prevent and respond to
gender-based sexual harassment (GBSH) in streets and public spaces;

WHEREAS, the duties and responsibilities of the barangay government are stipulated in
DILG PCW Joint Memorandum Circular No. 2020-001 re: Localization of the Safe Spaces
Act;

NOW, THEREFORE, I, _________________________, Punong Barangay of ____________________,


Municipality of Bangar, Province of La Union, by virtue of the powers vested in me by law,
do hereby order the Setting Up of Different Mechanisms to Prevent and Respond to Gender
Based Sexual Harassment (GBSH);

SECTION 1. ESTABLISHMENT OF THE ANTI-SEXUAL HARASSMENT (ASH) DESK.

a. The Violence Against Women (VAW) Desk shall also serve as the Anti-Sexual
Harassment (ASH) Desk of Barangay;

b. VAW Desk Officer _____________________________ shall be further designated as the


ASH Desk Officer.

SECTION 2. FUNCTIONS OF THE ASH DESK OFFICER.

The ASH Desk Officer shall:


a. Receive document and respond to complaints and reports of GBSH in streets
and public spaces;

b. Facilitate the referral of cases and persons to the appropriate public and
private service providers for further assistance such as legal, medical, psychosocial,
safety, security, and other services;

c. Record the number cases of GBSH in streets and public spaces received and
referred to other agencies, and submit a quarterly report to the DILG City Field Office
and the City Social Welfare and Development Office (CSWDO);

d. Keep case records confidential and secure, and ensure that only authorized
personnel have access to these records;

e. Assist in the formulation/updating of policies, development of plans,


programs, projects, and activities, and educational and awareness campaigns to
address GBSH in streets and public spaces;

f. Coordinate with pertinent agencies in monitoring the status of GBSH-related


complaints and reports; and

g. Perform other related functions as may be assigned.

SECTION 3. DESIGNATION OF ANTI-SEXUAL HARASSMENT ENFORCERS.

The following officers shall be designated as Anti-Sexual Harassment Enforcers:

SECTION 4. FUNCTIONS OF ANTI-SEXUAL HARASSMENT ENFORCERS.

The ASHEs shall have the following functions:

a. Receive complaints on GBSH in streets and public spaces;

b. Immediately apprehend the perpetrator if caught in the act of committing the


crime;

c. Immediately bring the perpetrator to the nearest police station for appropriate
action; and

d. Together with the Women’s and Children’s Desk of the PNP stations, keep a
ledger of perpetrators for the purpose of determining if the perpetrator is a first-
time, second-time or third-time offender.

SECTION 5. ESTABLISHMENT OF THE ANTI-SEXUAL HARASSMENT REFERRAL


NETWORK

The following shall be the members of the ASH Referral Network:

SECTION 6. FUNCTION OS THE ANTI-SEXUAL HARASSMENT REFERRAL NETWORK


The ASH Referral Network shall have the following functions:

a. The ASH Referral Network shall provide legal, medical, psychosocial, safety,
security, and other relevant services;

b. The members shall receive and efficiently act on referrals from the ASH Desk and
ASH Hotline for the provision of services needed by victim-survivors and
witnesses of gender-based sexual harassment; and

c. Protocols in this connection may be formulated by through an executive order,


ordinance, or memorandum of agreement among the service providers.

SECTION 7. ESTABLISHMENT OF ASH DESK HOTLINE AND DESIGNATION OF ASH


HOTLINE OPERATOR.

a. There shall be an ASH Hotline that shall be disseminated and posted in


conspicuous places within the jurisdiction of the barangay.

b. The VAW/ASH Desk Officer and/or the duty officer of the day shall be the ASH
Hotline Operator who shall receive, record, maintain and update the database of
complaints/reports received through the ASH Hotline, and perform such other
functions as may be assigned by laws, rules and regulations.

SECTION 8. EFFECTIVITY.

This Order shall take effect immediately.
